The Party committees and the people’s governments of all provinces, autonomous regions and municipalities directly under the Central Government, all ministries and commissions under the State Council, and all institutions directly under the State Council,

The CPC Central Committee and the State Council have decided to newly add RMB 100 billion Yuan central investment (hereinafter referred to as newly-added central investment) this year, which shall be mainly used for the construction of livelihood projects, major infrastructures, ecological environment, independent innovation and industrial structural adjustment. It is a major measure to deal with the disadvantageous impact from international economic environment and accelerate the stable and quick development of economy. All the departments of all regions shall unify their thoughts and behavior to the analysis and judgment for economic situation of the Central Government, to the decision-making and disposition of the Central Government, and to the requirement of carrying out the scientific view of development. Under the situation of short time and heavy task, for the purpose of administration and use of the newly-added central investment in a full way, giving full play to the pulling role of newly-added central investment and making sure it is used in the major areas determined by the Central Government, accelerating construction schedule to change the investment into physical workload as soon as possible and ensuring the quality and safety of construction projects, it must strengthen the administration, supervision and inspection on the use of the newly-added central investment. Therefore, upon the consent of the leaders of the CPC Central committee and the State Council, we hereby notify the relevant issues as follows:

    各省、自治区、直辖市党委和人民政府,国务院各部委、各直属机构:

    党中央、国务院决定今年新增1000亿元中央投资(以下简称新增中央投资)主要用于民生工程、重大基础设施、生态环境、自主创新和产业结构调整等方面建设,这是应对国际经济环境对我国的不利影响,促进经济平稳较快增长的重大举措。各地区各部门必须把思想和行动统一到中央对经济形势的分析判断上来,统一到中央的决策部署上来,统一到贯彻落实科学发展观的要求上来。在时间紧、任务重的情况下,为管好用好新增中央投资,充分发挥新增投资的拉动作用并确保用于中央确定的重点领域,加快建设进度,尽快形成实物工作量,确保工程质量和生产安全,必须加强对使用新增中央投资的项目的管理和监督检查工作。为此,经请示党中央、国务院领导同志同意,现就有关事项通知如下。

I. All the departments of all regions shall, according to the disposition of the CPC Central Committee and the State Council, make the work of expanding domestic demand such as urgent implementation of the newly-added central investment as the top priority of current economic work, enhance confidence, take a prompt measure, make a uniform collaboration and be practical and efficient to organize and carry out the work.

       一、各地区各部门要按照党中央、国务院的工作部署,把紧急落实新增中央投资等扩大内需工作作为当前经济工作的重中之重,坚定信心,迅速行动,通力协作,务实高效,抓好组织落实。

II. All the departments of all regions and all the related entities shall earnestly exercise their respective functions and perform their respective duties. In light of the requirements of the State Council, the liability subjects of a central project shall be the relevant industrial competent departments and the central enterprises; the liability subjects of a local project shall be the people’s governments at the provincial levels. Each liability subject shall be responsible for the investment arrangement, project management, funds use and implementation effect of each project that they respectively take charge and detail the responsibility of each implementation step.

       二、各地区各部门和各相关单位要各司其职,各负其责。根据国务院要求,中央项目的责任主体是有关行业主管部门和中央企业,地方项目的责任主体是省级人民政府。各责任主体要对所属项目的投资安排、项目管理、资金使用、实施效果负总责,并细化落实各实施环节的责任制。

III. The development and reform departments shall in collaboration with the relevant industrial competent departments and regions to make and issue down the newly-added investment plan; the financial departments shall be responsible for appropriating funds as soon as possible subject to investment plan and budget. Central investment shall be appropriated in full amount to the project entities in a month after the plan was issued down according to the project schedule. The departments of land and resource and environmental protection shall timely mature the procedures of examination of land for project and environmental evaluation; the department of housing and urban-rural construction shall take effective measures to ensure that the project can be constructed as soon as possible and intensify the strength of supervision on quality of construction projects; the relevant banks shall guarantee the credit funds be in place timely; the auditing departments shall organize force to strengthen audit of relevant projects and funds.

       三、发展改革部门负责会同有关行业主管部门和地区,抓紧编制并下达新增投资计划;财政部门负责按照投资计划、预算尽快拨付资金,中央投资应在计划下达1个月内按照工程进度足额拨付到项目单位;国土资源、环保部门要及时完备项目用地审核和环评审核手续;住房城乡建设部门要采取有效措施,确保工程尽早开工建设,并加大对建设工程质量的监管力度;有关银行要保证信贷资金及时到位;审计部门要组织力量,加强对相关项目和资金的审计。

IV. All the project entities shall strengthen effort to speed up the schedule of projects construction and equipments procurement, ensure that the newly-added central investment can be changed into physical workload including land projects construction, equipments and materials procurement, installation and order. All the relevant entities of design, construction, equipment manufacture and transportation shall pull out all stops, strengthen the coordination, guarantee the demand of project construction and ensure the project construction to be carried out smoothly.

       四、各项目单位要加大工作力度,加快工程施工和设备采购进度,确保新增中央投资尽快形成包括土建工程施工,设备材料采购、安装和订货等内容在内的实物工作量。各设计、施工、设备制造、运输等相关单位要全力以赴,密切配合,保证项目建设需要,确保工程建设顺利进行。

V. According to the requirement of CPC Central Committee and the State Council, it shall establish a Work Leading Group for inspecting the implementation of policy of central expanding domestic demand to promote economic growth. The Work Leading Group shall be leaded by the Central Disciplinary Committee and Ministry of Supervision and consist of the State Development and Reform Commission, the Ministry of Finance and the National Audit Office. The office of the Work Leading Group is responsible for the daily work, which locates in the Ministry of Supervision. It shall transfer personnel from the Work Leading Group to form a team (hereinafter referred to as central inspection team) to inspect the implementation of policy of central expanding domestic demand to promote economic growth, which is responsible for the supervision and inspection on the newly-added central investment projects. According to the situation of investment and projects arrangement, it shall dispatch 24 central inspection teams in advance, whose heads shall be the leaders at the vice ministerial level designated by the Central Disciplinary Committee and Ministry of Supervision. If the liability subjects are relevant industrial competent departments and central enterprises, it shall carry out territorial inspection in accordance with the locus of the project or project management entity. The central inspection teams will be dispatched from late December, 2008.

       五、按照党中央、国务院要求,由中央纪委监察部牵头,成立有国家发展改革委、财政部、审计署参加的中央扩大内需促进经济增长政策落实检查工作领导小组,领导小组办公室设在监察部,负责日常工作。从领导小组成员单位抽调人员组成中央扩大内需促进经济增长政策落实检查组(以下简称中央检查组),对新增中央投资项目进行全过程监督检查。根据投资和项目安排情况,先期派出24个检查组,中央检查组组长均由中央纪委监察部选派副部级领导干部担任。对责任主体是有关行业主管部门和中央企业的,根据项目或项目管理单位所在地由中央检查组实行属地检查。中央检查组拟于2008年11月下旬陆续派出。

VI. The main functions of central inspection teams are: supervising and inspecting whether or not the implementation of central decision-making and disposition is in a unified and speedy way so as to ensure the smooth implementation of central governmental orders; whether or not the construction project planning and establishment conform to the requirements of scientific view of development and the investment orientation determined by Central Government so as to refrain from building “Vanity Projects” that waste both money and manpower and “Achievement Projects” that are impractical; whether or not the examination and approval of construction projects and the construction procedure are in pursuance of law so as to guarantee the use of newly-added investment and determination of construction project are scientific and have complete procedures; whether or not the administration and use of project construction funds are standardized and open so as to make safe, transparent and effective use of it; whether or not the projects construction are safe and qualified so as to prevent accident risks and put an end to “Jerry-built Projects”. The specific tasks are as follows:

(1) Urging all regions to strengthen leadership and speed up work schedule of newly-added central investment projects.

(2) Inspecting whether or not the newly-added central investment is used in industries with “high-pollution, high energy-consuming”, low-level redundant construction and excess production capacity; whether or not it is used for office buildings and other constructions of Party and political organs; whether or not the situations of discretionally raising or lowering construction standard, changing construction content, enlarging or reducing the scale of construction without approval exist.

(3) Inspecting whether or not the development and reform departments issue down newly-added central investment plan rapidly; whether or not the financial departments appropriate funds timely; whether or not the counterpart funds of regions and project entities are in full amount and in place; whether or not the management and use of funds are transparent; whether or not the situations of detainment, occupation, withholding, misappropriation as well as false report and collection and extravagance and waste of construction funds exist; whether or not the departments of land and resource, environmental protection, housing and urban-rural construction and relevant industrial administrative department handle with related procedures timely and effectively.

(4) Inspecting whether or not a construction project conforms to State relevant procedures of examination and approval, authorization and record-filing; whether or not it strictly executes the policies and administrative provisions of land, environmental protection and energy conservation; whether or not the implementation and administration are strictly subject to the requirements of the legal-person responsibility system of projects, bid invitation and tendering system, project supervision system and contract management system.

(5) Inspecting whether or not the projects and construction entities establish and implement the leader responsibility system of projects quality and work safety; whether or not the hidden risks of quality resulting from blindly seeking schedule exist; whether or not they strictly control the quality of projects.

(6) Inspecting whether or not the staff of State organs and related entities abuse their power, neglect their duties, engage in malpractice for personal gains or extort or take bribes in the process of projects construction; whether or not there are other issues on legal and disciplinary violation of project construction entities and staff thereof.

       六、中央检查组主要职责是:监督检查贯彻落实中央决策部署是否思想统一、行动迅速,保证中央政令畅通;工程项目规划、立项是否符合科学发展观的要求和中央规定的投向,严防搞劳民伤财的“形象工程”和脱离实际的“政绩工程”;工程建设项目审批和建设程序是否依法合规,确保新增投资的使用和建设项目的确定决策科学、程序完备;项目建设资金管理使用是否规范公开,确保安全、透明、有效;工程建设是否安全合格,防范事故风险和杜绝“豆腐渣工程”。具体任务为:

    (一)督促各地加强组织领导,加快新增中央投资项目的工作进度。

    (二)检查新增中央投资有无用于“两高”行业、低水平重复建设和产能过剩行业项目,有无用于党政机关办公楼等楼堂馆所项目,是否存在未经批准擅自提高或降低建设标准、改变建设内容、扩大或缩小建设规模的情况。

    (三)检查发展改革部门是否迅速下达新增中央投资计划,财政部门是否按规定及时拨付资金,地方和项目单位的配套资金是否足额到位,资金管理使用是否做到了公开透明,是否存在滞留、挤占、截留、挪用以及虚报冒领、铺张浪费建设资金等情况,国土资源、环保、住房城乡建设部门和有关行业管理部门是否及时有效办理相关手续。

    (四)检查建设项目是否履行国家有关项目审批、核准、备案程序,是否严格执行土地、环保、节能等政策和管理规定,是否严格按照项目法人责任制、招标投标制、工程监理制和合同管理制等要求实施和管理。

    (五)检查项目及施工单位是否建立和落实工程质量和安全生产领导责任制,是否存在盲目赶进度导致的质量安全隐患,是否严把工程质量关。

    (六)检查国家机关及有关单位工作人员在项目建设过程中是否存在滥用职权、玩忽职守、徇私舞弊、索贿受贿等违纪违法问题,项目建设相关单位和人员是否存在其他违纪违法问题。

VII. The work condition of the central inspection teams and problems found in the inspection shall be reported in written form to the Work Leading Group for inspecting the implementation of policy of central expanding domestic demand to promote economic growth; Any important circumstance shall be reported in a timely manner; the Work Leading Group shall make uniform collection according to the inspection condition and report it to the State Council.

       七、中央检查组工作情况和检查中发现的问题,要向中央扩大内需促进经济增长政策落实检查工作领导小组提交书面报告,重要情况要及时报告,领导小组根据检查情况统一汇总上报国务院。

VIII. All the departments of all regions shall support and cooperate with the central inspection team sin a full way, timely report the process of the newly-added central investment projects in their own regions and departments to the central inspection teams. The project investment plan and work briefing arranged by all the departments of all regions shall make a copy to the central inspection teams; any important circumstance concerning project investment arrangement shall notify the central inspection teams, any important meeting shall invite the central inspection teams to participate in. All the project entities shall accept inspection in a self-conscious manner and faithfully provide the related materials.

The central inspection teams shall timely communicate the supervision and inspection situation of newly-added central investment projects with the local people’s governments.

       八、各地区各部门及有关单位要全力支持配合中央检查组工作,及时向中央检查组报告本地区本部门的新增中央投资项目进展情况。各地区各部门安排的项目投资计划、工作简报等,应抄送中央检查组;有关项目投资安排等重大情况要通报中央检查组,有关重要会议应邀请中央检查组参加。各项目单位要自觉接受检查,如实提供相关资料。

    中央检查组应与派驻地人民政府及时沟通新增中央投资项目监督检查情况。

IX. The Work Leading Group for inspecting the implementation of policy of central expanding domestic demand to promote economic growth shall regularly hear each inspection team’s report and give guidance to their inspection work. For any important issue reflected by a inspection team, it shall timely report to the State Council.

       九、中央扩大内需促进经济增长政策落实检查工作领导小组将定期听取各检查组的情况汇报,并对检查工作给予指导,对检查组反映的重大问题,及时向国务院报告。

X. The central inspection teams shall timely bring forward opinions and advices to deal with the problems found in the inspection, the related regions and departments shall earnestly correct those problems. For those issues that the regions and departments fail to reasonably arrange projects, the investment orientation does not conform to requirements as well as tardy project construction, the central inspection teams may suggest that the development and reform departments to withdraw investment into central treasury, check and reduce the region and department’s investment amount. The issues on legal and disciplinary violation found in the inspection such as neglect of duties, falsification, embezzlement and acceptance of bribes and withholding, occupation and misappropriation of project construction funds, shall be timely transferred to the organs of discipline inspection and supervision, which shall impose upon the liable entity and person a Party and political disciplinary sanction. If any crime is constituted, they shall be transferred to the judicial organs for investigation of criminal liabilities.

       十、对检查中发现的问题,中央检查组要及时提出处理意见和建议,有关地区和部门要认真整改。对地区和部门项目安排不当、投资方向不符合要求以及项目建设进展缓慢等问题,中央检查组可建议发展改革部门收回投资,缴回中央国库,核减该地区、部门安排投资的数额。对检查中发现的玩忽职守、弄虚作假、贪污受贿和截留、挤占、挪用项目建设资金等违纪违法问题,要及时移交纪检监察机关,由纪检监察机关对责任单位和个人给予党纪政纪处分,构成犯罪的,移送司法机关追究刑事责任。
