To the departments (bureaus) of finance, the departments (bureaus) of civil affairs, the departments (bureaus) of labor and social security of all provinces, autonomous regions, municipalities directly under the Central Government, the Bureau of Finance, the Civil Affairs Bureau and the Bureau of Labor and Social Security of Xinjiang Production and Construction Corps:     

For the purposes of implementing the Regulations on Pensions and Preferential Treatment for Servicemen (Order No. 413 of the State Council and the Central Military Commission) and the Notice on Printing and Distributing the Measures for Guarantee of Medical Treatment for Special-care Recipients (Min Fa No. 101 [2007]) of the Ministry of Civil Affairs, the Ministry of Finance, the Ministry of Labor and Social Security and the Ministry of Health, regulating the administration of use of medical subsidy funds for special-care recipients and safeguarding the implementation of the medical treatment for special-care recipients, this Notice regarding relevant issues is hereby promulgated as follows:

    各省、自治区、直辖市财政厅(局)、民政厅(局)、劳动和社会保障厅(局),新疆生产建设兵团财务局、民政局、劳动和社会保障局:

    为贯彻落实《军人抚恤优待条例》(国务院、中央军事委员会第413号令)和民政部、财政部、劳动和社会保障部、卫生部《关于印发〈优抚对象医疗保障办法〉的通知》(民发〔2007〕101号),规范优抚对象医疗补助资金的使用管理,切实保障优抚对象医疗待遇的落实,现就有关问题通知如下:

1. The Central government and local governments at all places shall bear joint responsibility to earnestly implement the medical treatment for special-care recipients and settle their difficulties in medical treatment. The allocation of medical subsidy funds for special-care recipients from the finance of the Central Government reflects the regard of the Central Party Committee and the State Council for special-care work and their care for special-care recipients. The relevant departments of local governments at all levels shall unify their thoughts and enhance their cognition to raise medical subsidy funds for special-care recipients through various channels, formulate and improve the guarantee measures and preferential policies regarding the medical treatment for special-care recipients, establish long-term effective system to settle the medical difficulties of special-care recipients, and ensure the implementation of the medical treatment for special-care recipients.

       一、认真落实优抚对象医疗待遇,切实解决他们的医疗困难,是中央和地方政府共同的责任。中央财政安排优抚对象医疗补助资金,体现了党中央、国务院对优抚工作的重视和对优抚对象的关心,各级地方政府有关部门要统一思想,提高认识,多渠道筹集优抚对象医疗补助资金,制定和完善优抚对象医疗保障办法和医疗优惠政策,建立解决优抚对象医疗难问题的长效机制,确保优抚对象医疗待遇的落实。

2. The "special-care recipients" as mentioned in this Notice refers to the disabled servicemen, martyr dependents, the dependents of the servicemen who have sacrificed their lives in the course of duty, the dependents of the servicemen died due to illness, demobilized servicemen staying at their native places, the veterans returned to their native places due to illness and retired servicemen who are entitled to State pensions, subsidies and medical security in accordance with the relevant provisions.

       二、本通知所称优抚对象是指按规定享受国家抚恤补助和医疗保障的残疾军人、烈士遗属、因公牺牲军人遗属、病故军人遗属、在乡复员军人、带病回乡退伍军人和参战退役人员。

3. All places shall, based on the local economic and social development level and their respective financial capacity, formulate reasonable standards and medical security levels of various special-care recipients, which shall be raised with the development of economy. The medical subsidy funds for special-care recipients shall mainly be used as follows:     

(1) Subsidy to Insurance Payment. In accordance with the provisions of the Notice on Printing and Distributing the Measures for Guarantee of the Medical Treatment for Servicemen of Level one to Level six Disability (Min Fa No. 199 [2005]) of the Ministry of Civil Affairs, the Ministry of Finance and the Ministry of Labor and Social Security, the servicemen of level one to level six disability who are covered by the basic medical insurance for urban residents shall be entitled to subsidy to insurance payment.     

(2) Subsidy to Medical Expenses    

(i) The servicemen of level one to level six disability shall be entitled to appropriate subsidy to the medical expenses that are within stipulated range, under the minimum rate of pooled funds, or above the maximum amount payable, and the medical expenses shared by individuals;      

(ii) Adequate subsidy shall be granted to the special-care recipients covered by the basic medical insurance system for urban employees, the new rural cooperative medical insurance system and other urban and rural basic medical security systems who bear heavy sharing of payment after medical expense reimbursement;    

(iii) Adequate subsidy shall be granted to the special-care recipients not covered by the basic medical insurance system for urban employees, the new rural cooperative medical insurance system and other urban and rural basic medical security systems who bear heavy burden of medical expenses;    

(iv) Adequate subsidy shall be granted to the servicemen of level seven to ten disability whose employer is unable to pay their medical expenses or to the unemployed servicemen of level seven to ten disability for the medical treatment on recurred injuries; 

(v) People's governments at the levels of province, autonomous regions and municipalities directly under the Central Government shall grant other subsidies to medical treatment in accordance with the Regulations on the Pensions and Preferential Treatments of Servicemen.

       三、各地要根据本地区经济和社会发展水平、财政负担能力,合理制定各类优抚对象医疗补助标准和保障水平,并随经济发展有所提高。优抚对象医疗补助资金主要用于:

    (一)缴费补助。按照民政部、财政部、劳动保障部《关于印发〈一至六级残疾军人医疗保障办法〉的通知》(民发〔2005〕199号)规定,对一至六级残疾军人参加城镇职工基本医疗保险的缴费给予补助。

    (二)医疗费用补助。

    1.对一至六级残疾军人在规定范围内的、起付标准以下、最高支付限额以上,以及个人共付的医疗费用给予适当补助;

    2.对参加城镇职工基本医疗保险、城镇居民基本医疗保险、新型农村合作医疗等城乡基本医疗保障制度,按规定报销医疗费后个人自付医疗费较重的优抚对象给予适当补助;

    3.对未参加城镇职工基本医疗保险、城镇居民基本医疗保险、新型农村合作医疗等城乡基本医疗保障制度,个人医疗费用负担较重的优抚对象给予补助;

    4.对所在单位无力支付和无工作单位的七至十级残疾军人旧伤复发的医疗费用给予补助;

    5.省、自治区、直辖市人民政府依据《军人抚恤优待条例》规定的其他医疗费用补助。

4. All places shall raise medical subsidy funds for special-care recipients through fiscal budget, lottery welfare fund, social donation and other channels. The fiscal departments of the Central Government shall, considering the quantity of special-care recipients, financial capacity, work effect and other factors of all provinces, autonomous regions and municipalities directly under the Central Government, allocate the medical subsidy funds. More funds shall be allocated to places with large number of special-care recipients. When distributing the subsidy funds allocated by the fiscal departments of the Central Government, the fiscal departments at provincial level shall make an overall coordination between the funds and that raised by local places.

       四、各地应通过财政预算、彩票公益金,以及社会捐赠等多种渠道筹集优抚对象医疗补助资金。中央财政根据各省、自治区、直辖市优抚对象人数、财力状况和工作成效等因素安排优抚对象医疗补助资金,重点向优抚对象人数较多的困难地区倾斜。省级财政部门在分配中央财政补助资金时,应与地方安排资金统筹考虑。

5. The medical subsidy funds for special-care recipients shall be allocated and paid in accordance with the relevant provisions of the management system of finance and treasury and shall be listed under the item "medical subsidy for special-care recipients" of the category "medical security" of the classified subjects of public income and expenditure. The amount of the funds used for subsidizing the payment for medical insurance of the servicemen of level one to level six disability covered by the basic medical insurance for urban employees shall be directly transferred, after verification, to the special fiscal account for social security funds according to the number of insurance attendees and subsidizing rate. The funds shall be included in the special account for basic medical insurance funds for urban employees of the above-mentioned special fiscal account for accounting purposes. The medical subsidy funds payable to other special-care recipients shall be paid, after being examined and approved, in accordance with the fund-allocation plan provided by a department of civil affairs at county level.

       五、优抚对象医疗补助资金按照财政国库管理制度的有关规定拨付,列政府收支分类科目“医疗保障”款“优抚对象医疗补助”项下。用于补助一至六级残疾军人参加城镇职工基本医疗保险缴费部分,由统筹地区财政部门根据参保人数和补助标准,直接核拨至社会保障基金财政专户,并纳入该财政专户城镇职工基本医疗保险基金专账中核算;用于补助其他优抚对象的医疗补助资金应按县级民政部门提供的用款计划审核拨付。

6. A department of civil affairs at county level shall implement special management on the medical subsidy funds for special-care recipients, apply separate accounting system, and shall neither set up separate account nor mix the funds with pensions, urban and rural medical aids and other special funds. None of these funds may be used as a subsidy for the living of special-care recipients, a subsidy to medical institutions, or the payment for the expenditure of basic medical insurance agencies and departments of civil affairs in the work of management. The balance at the end of a year may be rounded up to next year.

       六、县级民政部门应对优抚对象医疗补助资金实行专项管理、分账核算,不得单独开设账户,不得与抚恤、城乡医疗救助等专项资金混用,不得用于优抚对象生活困难补助,不得用于医疗机构补助,不得用于基本医疗保险经办机构和民政部门管理工作等支出。年末结余资金,可结转下年度继续使用。

7. The local departments of finance, civil affairs, labor and social security at all levels shall closely cooperate to formulate measures for reinforcing the management over the use of the medical subsidy funds for special-care recipients. The financial management system shall be established and improved. The medical subsidy funds shall be granted by banks if permitted. Methods of medical expense reimbursement shall be formulated through negotiation to ensure the proper medical treatment of special-care recipients and provide medical convenience for the recipients and, at the same time, strengthen the relevant management and prevent wastefulness. The departments of finance, civil affairs, labor and social security at the provincial level shall reinforce their instruction on work, regularly or irregularly supervise and examine the management over the use of the medical subsidy funds for special-care recipients and correct any problems once discovered. The Ministry of Finance, the Ministry of Civil Affairs, the Ministry of Labor and Social Security shall make a spot check on the use of the medical subsidy funds for special-care recipients in different places if necessary.

       七、地方各级财政、民政、劳动和社会保障部门要密切配合,制定措施,加强优抚对象医疗补助资金的使用管理。要建立健全财务管理制度,有条件的地区推行医疗补助资金银行发放,协商制定医疗费报销办法,既要保证优抚对象的医疗待遇,方便优抚对象就医,又要加强管理,防止浪费。省级财政、民政、劳动和社会保障部门要加强工作指导,定期不定期地对优抚对象医疗补助资金的使用管理进行监督检查,对发现的问题应及时纠正。财政部、民政部、劳动和社会保障部根据需要,对各地优抚对象医疗补助资金使用情况进行抽查。

8. Specific measures for raising, management and use of the medical subsidy fund for special-care recipients may be formulated in different places based on the respective local situations.

       八、各地可根据实际情况，制定优抚对象医疗补助资金筹集、管理和使用的具体办法。
