Notification on the Relevant Issues Regarding Effecting the Basic Medical Insurance on the Retired Personnel under the Socialized Administration from the Bankrupted Enterprises

Bureaus of Labor and Social Security, Bureaus of Finance of All Districts and Counties of Beijing Municipality, All Committees, Offices, Bureaus, and Parent Companies Directly under this Municipality, and All Enterprises Directly under the State Planning:

In order to guarantee the basic medical treatment for the retired personnel under the socialized administration from the bankrupt enterprises, we hereby notify the relevant issues on their effecting of the basic medical insurance as follows in accordance with the Rules of Beijing Municipality on the Basic Medical Insurance (Order No. 68 of the People's Government of Beijing Municipality issued on 20th February 2001) in combination of the practical situation of this Municipality:

    各区县劳动和社会保障局、财政局,各委、办、局、总公司,各计划单列企业:

    为了保障破产企业实行社会化管理退休人员的基本医疗,根据《北京市基本医疗保险规定》(2001年2月20日北京市人民政府第68号令),结合我市实际情况,现就其参加基本医疗保险有关问题通知如下:

I. The retired personnel under the socialized administration from the bankrupt enterprises shall, in accordance with the relevant provisions on the basic medical insurance, effect the basic medical insurance and take part in the large-amount mutual medical aid, and enjoy the corresponding treatment.

       一、破产企业实行社会化管理的退休人员,应当按照基本医疗保险有关规定参加基本医疗保险和大额医疗互助,享受相应的医疗保险待遇。

II. The retired personnel from the bankrupt enterprises shall not enjoy the corresponding medical insurance unless they have complemented the insurance premium by themselves only for one time in accordance with the provisions on the basic medical insurance, provided the accumulated premium payment years are less than 25 years and 20 years for the male and the female respectively. Where the accumulated premium payment years are less than 25 years and 20 years for the male and the female retired personnel respectively due to the enterprises' bankruptcy, the bankrupt enterprises shall complement the corresponding insurance premium that should be paid by the enterprises for the years of advanced retirement.

       二、破产企业退休人员,累计缴费年限男不满25年、女不满20年的,应当按照基本医疗保险规定由个人一次性补足应缴费用后方可享受相应的医疗保险待遇。

    因企业破产而提前退休的人员,累计缴费年限男不满25年、女不满20年的,补缴费用时提前退休年限对应的企业缴费部分,由破产企业补缴。

III. In order to mitigate the personal burden of the medical expenses after effecting the basic medical insurance by the bankrupt enterprises' retired personnel under the socialized administration, the supplementary medical insurance system shall be established for them according to the following measures:

(1) Withdrawing the supplementary medical insurance funds in advance. The medical insurance funds shall be withdrawn in advance based on 6% of the average wages for this Municipality's employees the year before bankruptcy, the actual number of the retried personnel from a bankrupt enterprise, and the year (years) of all retired personnel' actual age to the average life expectancy of this Municipality's residents. The supplementary medical insurance funds withdrawn by enterprises in advance shall be paid to the social insurance fund management centers of the local districts or counties, and the social insurance fund management centers at the county level shall turn such funds over to the Municipal Social Insurance Fund Management Center. Such funds shall be deposited in the municipal specialized social insurance account for management. The supplementary medical insurance funds shall be withdrawn from the cashed bankrupt's estates or the received payment from transferring the land use rights. Regarding the state-owned enterprises' bankruptcy, the insufficiency of the funds withdrawn in advance shall be complemented by the finances at the same levels.

(2) Using the supplementary medical insurance fund. The medicinal expenses borne by individuals within the coverage of the overall fund for the basic medial insurance (excluding parts below the minimum payment standards) shall be paid by the supplementary medical insurance funds by half. The medial expenses borne by individuals within the coverage of the large-amount mutual medical aid funds (excluding the parts of outpatient services below RMB 1,500) shall be paid by the supplementary medical insurance funds by 60%.

       三、为了减轻破产企业实行社会化管理退休人员参加基本医疗保险后个人医疗费用负担,按以下办法为其建立补充医疗保险制度:

    (一)预提补充医疗保险资金。以企业破产上一年本市职工平均工资的6%为基数,按破产企业实有退休人员数以及全部退休人员实际年龄距本市居民平均期望寿命的年限进行预提。企业预提的补充医疗保险资金应当一次性足额缴纳到所在区、县的社会保险基金管理中心,区县按照规定时间上缴到市社会保险基金管理中心,并纳入市社保财政专户管理。

    补充医疗保险资金从企业破产财产变现收入或土地使用权转让所得中预提。国有破产企业,预提资金不足部分由同级财政补足。

    (二)补充医疗保险资金的使用。基本医疗保险统筹基金支付范围内(不含起付标准以下的部分)由个人负担的医疗费用,补充医疗保险资金支付50%;大额医疗互助资金支付范围内(不含门诊1500元以下的部分)由个人负担的医疗费用,补充医疗保险资金支付60%.

IV. Before handing over to be under the socialized administration, the basic medical insurance of the retired personnel from the bankrupted enterprises shall go through formalities for the effecting by the enterprises. After the takeover, the social security offices of streets where these retired personnel registered their permanent residence shall be responsible for the routine administration of these personnel, such as collecting the medical expenses from these personnel, going through formalities of examination, approval, and clearing with the medical insurance handling organizations of districts or counties, etc.

       四、破产企业退休人员,在移交社会化管理前由单位办理参加基本医疗保险手续,移交后由户口所在街道社会保障事务所负责日常管理工作,如汇总退休人员医疗费用并到区县医疗保险经办机构办理审核结算手续等。 

V. The retired Chinese personnel from the foreign invested enterprises shall, after effecting the basic medical insurance, enjoy not only the basic medical insurance and the large-amount mutual medical aid, but also their respective enterprises' supplementary medical insurance. Foreign invested enterprises may also, after withdrawing the supplementary medical insurance funds and paying them in full only by one time to the social insurance fund management centers of the local districts or counties based on the standards on the supplementary medical insurance funds for the retired personnel under the socialized administration from the bankrupt enterprises, pursue the socialized administration over the supplementary medical insurance for their retired personnel.

       五、外商投资企业中方退休人员参加基本医疗保险后,除享受基本医疗保险和大额医疗互助待遇外,享受本企业的补充医疗保险待遇。 

    外商投资企业也可参照破产企业实行社会化管理退休人员补充医疗保险的标准预提费用并一次性足额缴纳到所在区、县社会保险基金管理中心后,对其退休人员的补充医疗保险实行社会化管理。 

VI. The retired personnel under the socialized administration shall, pursuant to the Municipal uniform arrangement, go through the relevant formalities for effecting the basic medical insurance with the social security offices of the streets within the prescribed time limit, and commence to enjoy the relevant treatment given by the basic medical insurance, the large-amount mutual medical aid, and the supplementary medical insurance as of the next month.

       六、已经实行社会化管理的退休人员,应按市里的统一部署,在规定时间内到街道社会保障事务所办理参加基本医疗保险的有关手续,并从次月开始享受基本医疗保险、大额医疗互助和补充医疗保险的相关待遇。 

VII. This Notification shall take effect as of 1st May 2002. Where provisions issued before the effect date of this Notification contradict this Notification, this Notification shall prevail.

       七、本文件自2002年5月1日起执行,以往与本文件规定不一致的,以本文件规定为准。
