Departments (bureaus) of Finance of all the provinces, autonomous regions, municipalities directly under the Central Government and the cities specifically designated in the state plan, the Bureau of Finance of the Xinjiang Production and Construction Corps, and the financial supervision commissioner's offices of the Ministry of Finance in all the provinces, autonomous regions, municipalities directly under the Central Government and the cities specifically designated in the State plan.

Since the implementation of the policy of Domestic Demand Stimulation for Economic Growth by the Central Government, finance departments at all levels have taken immediate actions, practically enhanced organization and leadership, and performed due diligence. Budgetary planning has been carried out on a centralized basis, funds have been appropriated for policy implementation, and relevant operations have been satisfactorily supervised and inspected, all contributing to the initial success of the implementation of the policy. At present, for the purpose of fund regulation and further implementing the policy of Domestic Demand Stimulation for Economic Growth, relevant matters are hereby notified as follows:

    中央实施扩大内需促进经济增长政策以来,各级财政部门紧急行动,切实加强组织领导,履职尽责,统筹好预算安排、资金拨付和政策落实、监督检查各方面工作,取得了初步成效。当前,为进一步做好扩大内需促进经济增长政策落实和资金监管工作,现就有关事项通知如下:

1.   Studying and implementing the spirit of the Central Government, further improving ideological understanding. The Central Economic Work Conference held at the end of the year 2008 placed the issue of maintaining steady and rapid economic growth at the top of the economic agenda for 2009, noting that the top priority should be given to economic growth, which is dependent on effective stimulation of domestic demand. A report meeting was recently held by the Central Leading Group for the Supervision and Inspection of the Implementation of the Policy of Domestic Demand Stimulation for Economic Growth to summarize effective efforts made by Central Supervision and Inspection Group, relevant Central departments and government departments of all the provinces (autonomous regions and municipalities directly under the Central Government) during the implementation of the policy and relevant supervision and inspection operations. Also, the meeting clarified requirements for the next stage. It was also pointed out during the National Finance Work Conference that relevant governmental departments shall unify ideas, strengthen resolve, change work attitude and do a solid job to ensure the full implementation of various Central decisions and plans. Finance departments at all levels and the public finance leadership shall, from the vantage point of the Party and the State, fully understand the significance and urgency of the implementation of the policy of Domestic Demand Stimulation for Economic Growth and fund regulation, and therefore further enhance the awareness of responsibility and the sense of mission, earnestly perform duties and work hard to create a solid basis for the effective implementation of relevant Central decisions and plans. In doing so, we aim to achieve the goal of maintaining sustainable economic development.

       一、学习贯彻中央精神,进一步提高思想认识去年年底召开的中央经济工作会议把保持经济平稳较快发展作为今年经济工作的首要任务,强调要着力在保增长上下功夫,把扩大内需作为保增长的根本途径。近日,中央扩大内需促进经济增长政策落实检查工作领导小组召开中央检查组阶段性汇报会,对前一阶段各中央检查组、中央有关部门和各省(区、市)政府部门采取有力措施,积极开展政策落实和监督检查工作进行总结,并明确下一阶段工作要求。刚刚召开的全国财政工作会议也明确提出,要统一思想,坚定信心,转变作风,扎实工作,确保中央各项决策部署落实到位。各级财政部门和广大财政干部要从党和国家工作全局的高度,充分认识做好扩大内需、促进经济增长政策落实和资金监管工作的重要性和紧迫性,进一步增强责任感和使命感,认真履职,扎实工作,为贯彻落实中央决策部署,实现经济发展目标提供坚强有力保证。

2.   Based on careful analysis, effectively addressing issues arising from the supervision and inspection process. As for problems involving financial management encountered during the implementation of the policy and fund supervision operations, finance departments at all levels shall attach great importance to relevant issues exposed, conduct earnest studies, make prompt corrections, and enhance administration. Where organization and coordination is inadequate and improvement in relevant mechanisms is needed for the effective implementation of Central investment projects, departments concerned shall be instructed and urged to enhance their understanding of relevant issues, in a bid to establish and maintain relevant coordination and supervision mechanisms in an efficient manner; in cases where local funds fail to be appropriated, project financing gap is relatively large, or the project distributed are inconsistent with the Central investment plan or budget, relevant departments shall be urged to address such issues in strict accordance with relevant regulations; manage investment allocation in a strict way to ensure that newly added Central investments are spent for intended purposes; enhance financial management of project construction entities according to the "rationality and sophistication" requirements to ensure that relevant funds are being used safely, properly and effectively; in the case of ambiguity in the understanding of relevant financial policies, interpretation thereof shall be clarified in time to ensure all financial management provisions will be effectively performed.

       二、认真研究检查中发现的问题,及时加以解决针对前一阶段政策落实和资金监管中反映的涉及财政管理方面的问题,各级财政部门要高度重视,认真研究,及时改进工作,促进加强管理。对落实中央投资项目组织协调不力、相关机制不够健全的,要指导和督促其提高认识,尽快建立完善相关协调机制和监管机制;对地方配套资金不到位、项目投资资金缺口较大的,以及分解下达的项目与中央投资计划、预算不一致的,要督促有关部门严格按现行规定处理;要严格资金投向,保证新增中央投资按规定投资方向落实到位;要按照科学化、精细化管理的要求,加强对项目建设单位财务管理,保证资金安全、规范、有效使用;对财政政策理解模糊的,要及时作出政策解释,确保各项财政管理规定得到有效执行。

3.   Toughening up on the control of investment, establishing and maintaining an integrated supervision mechanism. Finance departments at all levels shall, based on experiences acquired during the previous stages, establish and maintain an integrated supervision mechanism (covering preparatory, execution and post-execution operations) to ensure the safety of relevant projects in terms of project appraisal, investment and management; ensure that relevant funds are fully and regularly appropriated and complete formalities of examination and approval, without compromising relevant standards and operating procedures; toughen up the allocation of relevant investments, fund resource, procedure control, system guarantee and responsibility ascertainment. In 2009, Central Government investments as well as the number of relevant engineering projects are expected to increase. The Ministry of Finance shall organize joint supervision and inspection operations at all levels, focusing on selected key fields, key areas and investment-intensive key projects with far-reaching influences, which are of critical relevance to the people's livelihood. Local financial supervision commissioner's offices (hereinafter referred to as "commissioner's offices") under the Ministry of Finance and provincial finance departments shall make early interference and carry out pre-inspection investigations to acquire an accurate understanding of the real situation, maintain project record and database, determine key projects through analysis, and make full preparation for relevant special inspections. 

       三、进一步严格把关,建立健全全过程监督机制各级财政部门要在总结前一阶段工作经验的基础上,进一步建立健全事前事中事后全过程监督机制,促进项目论证安全,资金使用安全,项目管理安全。既要保证资金及时足额拨付,又要严格履行各项审批程序,做到标准不能降,程序不能减,严把资金投向关、资金来源关、程序控制关、制度保障关、责任落实关。2009年,中央投入的资金量将更大,工程项目将更多,财政部将选择涉及民生的重点领域、重点地区以及投资规模大影响面广的重点项目,组织开展上下联动监督检查。财政部驻各地财政监察专员办事处(以下称专员办)和各省级财政部门要提前介入,开展查前调查摸底,建立项目档案和数据库,通过梳理分析,确定重点项目,为专项检查做好充分准备。

4.   Strengthening policy study, perfecting relevant policies and standardizing administration operations. It is a long-term and primary task to enhance the implementation of the Central policy of Domestic Demand Stimulation for Economic Growth and fund regulation. Finance departments at all levels shall, based on the current situation and a long-term approach, accumulate experience and discover inherent laws involved in the implementation of the policy of Domestic Demand Stimulation for Economic Growth and fund regulation. They shall collect more information, get to the grass root level, and keep track of the progress made in implementation operations. Strengthening the study of relevant policies: as for new situations and new problems encountered, make prompt study and provide advice and strategies for enhancing and improving work. Enhance ability in problem solving: as for problems arising from the supervision and inspection process concerning the policy, system, management and leaders' work style, promptly put forward advices and suggestions to local CPC committees and governments and urge them to solve problems exposed. Perfecting the report system: report relevant information in a timely manner so that it can be used by the Central Government during the decision-making process. Seriously summarize experience, especially good practices and experience created by the grass-roots in promoting policy implementation, and apply them to actual work. 

       四、加强政策调研,不断完善政策和规范管理加强对中央扩大内需促进经济增长政策落实和资金监管是一项长期的重要任务。各级财政部门要立足当前、着眼长远,为今后扩大内需促进经济增长政策落实和资金监管工作积累经验、摸索规律。要加强信息收集,深入基层和实际,及时了解和掌握政策执行情况。要加强政策研究,对发现的新情况新问题,及时研究提出加强和改进工作的对策建议。要推动解决问题,针对监督检查中发现的有关政策、制度、管理以及干部作风等方面存在的问题,及时向当地党委和政府提出意见建议,督促其切实予以解决。要完善报告制度,快速反映信息,为中央决策提供借鉴和参考。要认真总结经验,特别是基层在推动政策落实和监督检查方面创造的好做法好经验,加以提炼概括和推广运用。

5.   Focusing on coordination and cooperation and improving the results of relevant supervision operations. Finance departments at all levels shall improve the standard of their work in support of relevant operations carried out by the Central Supervision and Inspection Group. Financial leaders who are also members of the Central Supervision and Inspection Group shall perform their duties in terms of communication and coordination between the Supervision and Inspection Group and the Ministry of Finance, and promptly report major events and policy-related issues to their superiors for approval. Commissioner's offices and local finance departments at all levels shall take the initiative to contribute to the leadership mechanism of local CPC committees and governments to stimulate domestic demand, and establish effective work mechanism with local discipline supervision and inspection departments, development and reform departments and audit departments. Finance departments within the Ministry of Finance shall also establish a comprehensive and highly interactive supervisory network with joint actions at all levels; offices in charge of budget and fund management and departments for supervision and inspection shall maintain two-way information smoothness. Finance departments (bureaus) shall forward relevant fund arrangement documents to commissioner's offices so that the commissioners are able to take control and carry out the work. Ensure that active efforts are being made by finance departments at lower levels to supervise relevant projects and funds on a real-time basis, making full use of their advantages of being close to the public and familiar with the situation. Make full use of the professional resources of social intermediaries such as investment assessment institutions and certified public accountants, and give full play to the supervisory functions of the society to form the overall supervision effect.

       五、注重协调配合,不断提高监管工作实效当前,各级财政部门要进一步配合好中央检查组的工作。参加中央检查组的财政干部要切实承担起检查组与财政部之间的沟通协调职责,遇到重大情况和政策问题及时请示上报。专员办和地方各级财政部门要主动加入到当地党委、政府扩大内需领导机制当中,与纪检监察、发展改革、审计等部门建立协调顺畅的工作机制。财政部门内部也要建立起上下联动、覆盖全面的监管网络,负责预算和资金管理的业务处室与监督检查部门之间要保持信息的双向畅通,财政厅(局)要将相关资金安排文件抄送专员办,便于专员办及时掌握,开展工作。要发挥基层财政部门贴近一线,熟悉掌握情况的优势,积极开展资金、项目的实时监管。还要充分利用投资评审机构、注册会计师等社会中介机构的专业力量,并积极发挥社会监督的能动性,形成监管的整体效应。

6.   Strictly enforcing work disciplines and firmly investigating and punishing acts in violation of relevant rules and disciplines. Finance departments at all levels shall strictly enforce political disciplines and reinforce administrative accountability, strengthen responsibility investigation, and firmly correct acts such as non-compliance with relevant regulations and prohibitions, trickery and deliberate misleading actions, to ensure the smooth implementation of new Central investment projects. Firstly, where Central decisions and measures of the Ministry of Finance fail to be implemented or are delayed in implementation, or financial staffs found guilty of buck-passing or slackness, especially obstructions of implementation caused by negligence of staff members which resulted in serious consequences, people with direct responsibility for such misconducts and relevant leaders shall be investigated seriously. Secondly, seriously investigate and punish leaders failing to follow prescribed procedures while deciding the use of large-amount funds or arrangements of major projects, or interfering bidding and tendering of engineering construction projects and government procurement in violation of relevant regulations; investigate and punish people involved in bribery, corruption, embezzlement and misappropriation or other similar misconducts during the project implementation and fund allocation process, in strict accordance with the Regulation on Penalties and Sanctions against Illegal Fiscal Acts (Decree of the State Council No. 427). In cases where a crime is made out, the offenders shall be handed over to relevant judicial authorities.

       六、严肃工作纪律,坚决查处违规违纪问题各级财政部门要严明政治纪律,强化行政问责,严格责任追究,坚决纠正有令不行、有禁不止,弄虚作假、欺上瞒下等行为,确保新增中央投资项目顺利实施。一是对贯彻落实中央决策和财政部部署措施不力、行动迟缓的,财政工作人员在工作中推诿、拖办,特别是因失职渎职致使政策得不到落实、造成严重后果的,要严肃追究直接责任人和相关领导责任。二是严肃查处领导干部个人决定大额度资金使用和重大项目安排、违反规定插手工程建设项目招投标及政府采购等行为,从严查处在项目实施和资金分配使用过程中索贿受贿、贪污私分、截留克扣、挪用挤占等违法违纪问题,严格按照《财政违法行为处罚处分条例》(国务院令第427号)进行处理,涉嫌犯罪的,移交司法机关处理。
