Finance departments (bureaus) and competent commercial departments of all provinces, autonomous regions, municipalities directly under the Central Government and cities separately designated under the State plan, the Finance Bureau and the Commerce Bureau of the Xinjiang Production and Construction Corps, 

In accordance with the Notice of the Ministry of Finance and the Ministry of Commerce on Managing Well the Administration of Relevant Funds for Supporting the Invigoration of Circulation and Expansion of Consumption (Cai Jian [2009] No. 16), the Notice of the Ministry of Finance on Printing and Distributing the Interim Administrative Measures for the Special Development Funds of Small and Medium-sized Commerce and Trade Enterprises (Cai Jian [2009] No. 229) and the spirits of relevant operational guidance documents of the Ministry of Commerce (MOFCOM) and the Ministry of Finance (MOF), relevant issues are hereby notified as follows with a view to regulating the use and administration of the special development funds of small and medium-sized commerce and trade enterprises in 2009 (hereinafter referred to as the Dedicated Funds):

    为规范2009年度中小商贸企业发展专项资金(以下简称专项资金)使用管理,根据《财政部商务部关于做好支持搞活流通扩大消费有关资金管理的通知》(财建[2009]16号)和《财政部关于印发<中小商贸企业发展专项资金管理暂行办法>的通知》(财建[2009]229号)以及商务部、财政部有关业务指导文件精神,现就有关事项通知如下:

1. The focus and standards of the support

The Dedicated Funds of 2009 shall mainly be used to support subsidies of financing guarantee expenses and subsidies of domestic trade credit insurance expenses of small and medium-sized commerce and trade enterprises, and to support qualified small and medium-sized commerce and trade enterprises to attend exhibitions, cultivate brands, etc. 

(1) The contents and standards of support for projects of subsidies of financing guarantee expenses 

The support shall take the form of financial subsidy. As from January 1, 2009, any guarantee without other central financial subsidies as provided by a qualified credit guarantee institution for a small and medium-sized commerce and trade enterprise for a single loan of RMB 8 million or less shall be granted a subsidy of not more than 1% of the loan guarantee. Specific proportions of the subsidy shall be determined by finance departments at the provincial level in conjunction with commercial departments on a classified manner in light of the business scale, the term of the loan and the nature of the project.

A credit guarantee institution applying for the subsidy shall meet all the requirements as follows: the institution shall be qualified as an independent legal person, and has a paid-up capital of more than RMB 40 million if the institution is located in Eastern China or more than RMB 20 million if in Mid-Western China; for a credit guarantee institution at the county level, the paid-up capital may be reduced to RMB 20 million if the institution is located in Eastern China and RMB 10 million if in Mid-Western China; the institution have sound financial administration systems, and accrue, manage and use all reserves in accordance with the provisions; the institution shall demonstrate good profitability, without any unfavorable records in terms of accounting, tax payment and bank credit or any record of violation of laws or regulations in the past three (3) years; during the period of project application, the amount of loan guarantee provided for small and medium-sized commerce and trade enterprises accounts for more than 20% of the total amount of loan guarantee of the organization; the total amount of loan guarantee in the last year more than doubles the paid-up capital; the guarantee rate is not more than 50% of the benchmark loan interest rate of banks at the corresponding period; both the use of the loans guaranteed and the small and medium-sized commerce and trade enterprises so guaranteed are in conformity to the macroeconomic policies, industrial policies and regional development policies of the State. In addition, the institution shall encourage and support the financing of entities undertaking such projects as "Household Eclectic Appliances Going to the Countryside", "Cars and Motorcycles Going to the Countryside", "Project of Two Hundred Markets", "Market Project of Thousands of Villages and Townships", "Breakfast Project ", "Project of Two Entry", "Project of Direct Connection between Agricultural Products and Supermarkets" and "Safe Meat".

The subsidy funds received by credit guarantee institutions shall only be used to make up for losses for subrogated payment or supplement risk reserves.

(2) The contents and standards of support for projects of subsidies of domestic trade credit insurance expenses

The support shall take the form of financial subsidy. With respect to qualified small and medium-sized commerce and trade enterprises that are insured the domestic trade credit insurance and other enterprises that buy the domestic trade credit insurance with small and medium-sized commerce and trade enterprises as the party at risk, the subsidy granted shall be 50% of insurance premium actually paid by the enterprises that buy the insurance.

An insurance institution that meets all the requirements as follows may file an application with the MOFCOM for handling insurance premium subsidy, and the MOFCOM shall determine the qualifications to handle insurance premium subsidy upon review in conjunction with the MOF and the China Insurance Regulatory Commission (CIRC): the insurance institution shall be registered within mainland China with a registered capital of more than RMB 4 billion; the insurance institution shall have more than three (3) years of business experience in domestic trade credit insurance and mature products, and have corresponding qualifications if the institution is engaged in mid-term or long-term domestic trade credit insurance business; the institution shall have professionals, specialized technologies and information channels necessary for credit risk prevention and control; the institution shall have a sound network of branch offices nationwide, which is capable of providing good services for clients; the institution shall have established accounts dedicated for domestic trade credit insurance subsidy funds and relevant accounting and administration systems.

Any small and medium-sized commerce and trade enterprise that already bought the domestic trade credit insurance from an undertaking insurance institution and paid the insurance premium or any other enterprise that already bought the domestic trade credit insurance from an undertaking insurance institution and paid the insurance premium, with a small and medium-sized commerce and trade enterprise as the party at risk (purchaser) may apply for the insurance premium subsidy if all the following requirements are met: the enterprise shall be registered within mainland China and be qualified as an independent legal person; the enterprise shall sell credits to domestic enterprises and customers; the products sold by the enterprise shall meet the industrial policies and relevant provisions of the State; the enterprise shall have no unfavorable records in terms of accounting, tax payment and bank credit or records of grave violation of laws or regulations in the past three (3) years; the enterprise applying for the subsidy and the products thereof shall be in compliance with the macroeconomic policies, industrial policies and regional development policies of the State. The enterprise shall encourage and support the credit sales of entities undertaking such projects as "Household Eclectic Appliances Going to the Countryside", "Cars and Motorcycles Going to the Countryside", "Project of Two Hundred Markets", "Market Project of Thousands of Villages and Townships", "Breakfast Project ", "Project of Two Entry", "Project of Direct Connection between Agricultural Products and Supermarkets" and "Safe Meat".

(3) The contents and standards of support for projects of market development of small and medium-sized commerce and trade enterprises 

(a) With respect to expenses for attendance at exhibitions incurred by eligible small and medium-sized commerce and trade enterprises after January 1, 2009, the support shall take the form of financial subsidy. Where a small and medium-sized commerce and trade enterprise attends trade investment discussion fairs and exhibitions aimed at invigorating circulation and expanding consumption, including the China Food Exposition, China Green Food Exposition, China International Silk Exposition, the Fourth Transnational Retail Group Procurement Fair, Procurement and Discussion Fair of Exported Goods for Domestic Sales of the China Export and Import Commodity Fair sponsored by the MOFCOM, and other 33 exhibitions guided and supported by the MOFCOM (see appendix 1 for the catalogue), the subsidy granted shall equal to 70% of the expenses actually paid for exhibition booths. The subsidy for each exhibition booth of exhibitions sponsored by the MOFCOM shall be no more than RMB 3,000 (RMB 10,000 in the case of the Procurement and Discussion Fair of Exported Goods for Domestic Sales of the China Export and Import Commodity Fair), and the total subsidy for each exhibition shall be no more than RMB 1.65 million The subsidy for each standard exhibition booth of the 33 exhibitions guided and supported by the MOFCOM shall be no more than RMB 1,000 and the total subsidy for each exhibition shall be no more than RMB 500,000.

(b) With respect to expenses incurred for the protection and technological transformation of trademarks of China's time-honored brands, the support shall take the form of financial subsidy. In 2009, the pilot implementation shall cover the following nine (9) regions with concentrated presence of China's time-honored brands, i.e. Beijing, Tianjin, Shanghai, Jiangsu, Zhejiang, Shandong, Qingdao, Guangdong and Sichuan. In particular, support shall be rendered to enterprises owning China's time-honored brands with profound cultural accumulation and unique processing techniques to make protective registration of trademarks of China's time-honored brands within China and in relevant countries and regions, and to initiate technological transformation and process innovation, etc. Any expenses incurred by an enterprise with time-honored brands for the above-mentioned activities shall be granted a subsidy at 50% of the expenses. Specifically, the subsidy funds for domestic protective registration of trademarks under the general category by an enterprise shall be no more than RMB 30,000, the subsidy funds for Madrid international trademark registration shall be no more than RMB 40,000, and. the subsidy funds for technological transformation and process innovation by an enterprise shall be no more than RMB 500,000.

(c) With regard to the building of a specialized sales network for silk products, the support shall take the form of financial subsidy. In 2009, the pilot implementation shall over regions including Liaoning, Dalian, Jiangsu, Zhejiang, Shandong and Guangdong. In particular, support shall be rendered to the establishment of a manufacturer contact mechanism between and among commerce and trade enterprises specializing in silk products and foreign trade enterprises for market development, to the innovation of new marketing models for silk products, and to the exploration of market models involving silk culture, science popularization, tourism, commerce and trade and other characteristics. Subsidies shall be granted to cover the rental of specialty stores or counters for silk products set up by commerce and trade enterprises, entry fees, and expenses incurred for participation in various promotional activities, for planning and publicizing innovative marketing models and for inviting investors. Specific subsidy standards shall be determined by finance departments at the provincial level in consultation with commercial departments. 

       一、支持重点和支持标准

    2009年专项资金重点用于支持中小商贸企业融资担保费用补助、国内贸易信用险费用补助,支持符合条件的中小商贸企业参展、品牌培育等。

    (一)融资担保费用补助项目支持内容和标准。

    采取财政补助方式予以支持。对2009年1月1日以后,符合条件的信用担保机构为中小商贸企业提供的单笔贷款800万元以下、未获得其他中央财政补贴的担保业务,给予不超过贷款担保额1%的补助,具体补助比例由省级财政部门会同商务部门根据业务规模、贷款期限、项目性质等情况分类确定。

    申请补助资金的信用担保机构,须同时具备以下条件:具有独立的法人资格,实收资本东部地区达到4000万元以上,中西部地区达到2000万元以上,县属担保机构实收资本东部地区可降至2000万元,中西部地区可降至1000万元;财务管理制度健全,按规定提取、管理和使用各项准备金;经济效益良好,会计、纳税、银行信用等方面无不良记录;三年内无违法违规记录;项目申报期内为中小商贸企业提供的贷款担保额占其担保总额的20%以上;上年度贷款担保总额达实收资本的2倍以上;担保费率不超过银行同期贷款基准利率的50%;担保的中小商贸企业及贷款用途符合国家宏观经济政策、产业政策和区域发展政策,鼓励支持“家电下乡”、“汽车摩托车下乡”、“双百市场工程”、“万村千乡市场”、“早餐工程”、“双进工程”、“农超对接”和“放心肉”等项目承办单位的融资。

    信用担保机构收到的补助资金,只能用于弥补代偿损失或补充风险准备金。

    (二)国内贸易信用险费用补助项目支持内容和标准。

    采取财政补助方式予以支持。对符合条件的中小商贸企业投保国内贸易信用险,以及其他企业以中小商贸企业为风险方投保国内贸易信用险的,按投保企业实际缴纳保费给予50%的补助。

    同时具备以下条件的保险机构可向商务部提出保费补助承办申请,商务部会同财政部、保监会审核后确定承办资格:在我国境内注册、注册资本40亿元以上;具有3年以上的国内贸易信用保险业务经验和成熟产品,开展中长期国内贸易信用保险业务的还应具备相应资质;具有信用风险防控所需要的专门人才、专业技术和信息渠道;在全国范围内拥有完善的分支机构体系,能为客户提供良好服务;建立国内贸易信用险补贴资金专用账户及核算和管理制度。

    向承办保险机构投保国内贸易信用保险并已缴纳保费的中小商贸企业,以及以中小商贸企业为风险方(买方)向承办保险机构投保国内贸易信用保险并已缴纳保费的其他企业,同时符合以下条件的,可申请保费补助:在我国境内注册,具有独立企业法人资格;面向国内企业和消费者开展信用销售,所售产品符合国家产业政策及相关规定;会计、纳税、银行信用等方面无不良记录;三年内无严重违法违规行为记录;申请补贴的企业及其产品符合国家宏观经济政策、产业政策和区域发展政策。鼓励支持“家电下乡”、“汽车摩托车下乡”、“双百市场工程”、“万村千乡市场工程”、“早餐工程”、“双进工程”、“农超对接”、“放心肉”等项目承办单位的信用销售。

    (三)中小商贸企业市场开拓项目支持内容和标准。

    1、对符合条件的中小商贸企业2009年1月1日以后发生的参展费用,采取财政补助方式予以支持。中小商贸企业参加以搞活流通、扩大消费为主要目的的贸易投资洽谈会和展览会,包括商务部主办的中国食品博览会、中国绿色食品博览会、中国国际丝绸博览会、第四届跨国零售集团采购会、中国进出口商品交易会出口商品内销采购洽谈会以及商务部引导支持的33个展会(目录见附件1),按实际支付展位费的70%予以补助。商务部主办的展会每个展位补助额最高不超过3000元(中国进出口商品交易会上举办的出口商品内销采购洽谈会最高不超过10000元),且每个展会补助总额不超过165万元;商务部引导支持的33个展会每个标准展位补助额最高不超过1000元,且每个展会补助总额不超过50万元。

    2、对于中华老字号商标保护和技术改造等费用,采取财政补助方式予以支持。2009年先在北京、天津、上海、江苏、浙江、山东、青岛、广东、四川等9个老字号比较集中的地区试点,重点支持一批文化底蕴深厚、生产加工技艺独特的中华老字号企业,在国内及有关国家和地区进行老字号商标的保护性注册、开展技术改造和工艺创新等。对老字号企业开展上述活动所发生的费用,按50%予以补助。其中,企业国内商标保护性通类注册补贴资金不超过3万元,马德里商标国际注册补贴资金不超过4万元,企业技术改造和工艺创新补贴资金不超过50万元。

    3、对于专业丝绸商品销售网络建设,采取财政补助方式予以支持。2009年在辽宁、大连、江苏、浙江、山东、广东试点,重点支持专营丝绸的商贸企业与外贸企业建立厂商联系机制、开拓市场,支持创新丝绸营销模式,探索集丝绸文化、科普、旅游、商贸等各具特色的营销模式。对商贸企业开设丝绸专卖店或专柜的租金、进场费,参加各类促销推介活动的费用,创新营销模式的策划、宣传、招商等费用予以补助,具体补助标准由省级财政部门商商务部门确定。

2. The procedures for the use and administration of the Dedicated Funds 

(1) With respect to projects of subsidies of financing guarantee expenses incurred by small and medium-sized commerce and trade enterprises, the Dedicated Funds shall first be allocated to all regions by using the factor method. Specific procedures for the use and administration of the Dedicated Funds are as follows:

(a) Formulate operational measures. All finance departments at the provincial level shall, in conjunction with commercial departments, formulate the specific operational measures for the use and administration of the Dedicated Funds within their respective regions in accordance with the Dedicated Funds allocated by and relevant provisions of the central finance, and report the same to (the Economic Construction Department of) the MOF and (the Finance Department of) the MOFCOM for record-filing purposes prior to August, 31. The operational measures shall clarify detailed requirements for such specific procedures as fund application, examination and checking, and appropriation and the materials required in the region concerned.

(b) Project review and assessment and fund appropriation. All finance departments and commercial departments at the provincial level shall organize the application for, examination and verification, and appropriation of the subsidy funds of financing guarantee expenses once semiannually. The examination and verification and appropriation of subsidy funds in the first half and second half of 2009 shall be completed prior to September 30, 2009 and December 31, 2009 respectively. Information on the examination and verification and appropriation of funds shall be summarized and be reported to the MOF and the MOFCOM within ten (10) days upon expiration of the deadline of application (see Appendix 2 for the format of the summary statement), and electronic data shall be submitted via www.creditsys.gov.cn in the meantime. Information on the examination and verification, and appropriation of funds in 2009 shall be submitted to the MOF and the MOFCOM by the end of January, 2010.

When applying for subsidy funds, credit guarantee institutions shall furnish the following materials: statement of the profile of the guarantee institution (see Appendix 3 for format); the application form of projects of subsidy funds for guarantees against loans to small and medium-sized commerce and trade enterprises during the period of project application as examined and verified by intermediaries and confirmed and stamped by the cooperative bank (see Appendix 4 for format); accounting statements (including the balance sheet, cash flow statement, profit statement, statement of changes in the balance of guarantees) as of the end of the project application period as examined and verified by intermediaries; proof of tax payment and summary statement during the period of project application; and other materials required. In the case of a first application, photocopies of the duplicate of the enterprise legal person business license and the articles of association shall be provided.

(2) With respect to projects of subsidies of domestic trade credit insurance premium, the project management approach shall be adopted. Specific application procedures are as follows:

(a) Project application. Local branch offices of undertaking insurance institutions shall summarize eligible projects that occur between January 1, 2008 and August 31, 2009 to form the Application Form of Subsidy of Domestic Trade Credit Insurance Premium (See Appendix 5 for format) and the electronic version thereof, and submit the same to finance departments and commercial departments at the provincial level at the locus of the branch offices prior to September 10, 2009. 

(b) Project review and assessment. All finance departments and commercial departments at the provincial level shall examine and verify, and confirm the projects under application by branch offices of undertaking insurance institutions in a timely manner, and summarize the same in the Statement of Subsidy Information on Financial Subsidy Funds for Domestic Trade Credit Insurance (see Appendix 6 for format), and submit the statement to the MOF and the MOFCOM prior to September 15, 2009. Meanwhile, the said finance departments and commercial departments shall provide feedback to branch offices of undertaking insurance institutions, and the latter shall be responsible for submitting the summary statement to the MOF, the MOFCOM and the CIRC.

(c) Fund appropriation. The MOF shall examine and verify application materials of various regions in a timely manner in conjunction with the MOFCOM, and whereupon appropriate the funds. Upon receipt of the subsidy funds, all finance departments at the provincial level shall transfer the funds to the insured enterprises in a timely manner through the branch offices of undertaking insurance institutions. 

(d) Project summarization. Undertaking insurance institutions shall submit the report on the use of the project subsidy funds in 2009 and the electronic version thereof to the MOF and the MOFCOM by the end of January, 2010. The report shall cover: business situation of the domestic trade credit insurance, the role of the subsidy funds in promoting credit sales of enterprises and stimulating domestic demand, as well as the revenue, expenditure and balance of the subsidy funds, etc.

(3) Application procedures for subsidies for relevant projects of market development of small and medium-sized commerce and trade enterprises 

(a) With regard to projects of subsidies for exhibition participation expenses, the project management approach shall be adopted. Specific application procedures are as follows:

With respect to an exhibition sponsored by the MOFCOM, upon closing of the exhibition, the competent commercial department at the provincial level at the place where the exhibition is held shall organize participating enterprises to file applications, conduct preliminary examination on the application materials thereof (including the contract on exhibition participation, proof of payment for expenses of exhibition booth, deals concluded during the exhibition and photos of the exhibition booth) and put forward preliminary opinions on arrangement. Upon final examination of the application materials, the finance department at the provincial level shall, in conjunction with commercial department at the same level, file the application with the MOF and the MOFCOM for subsidy funds for exhibition participation expenses (in the case of the China Import and Export Commodity Fair, the application shall be directly submitted by the undertaking organization). The MOF shall, in conjunction with the MOFCOM, examine application materials submitted by all regions in a timely manner, and whereupon appropriate the Dedicated Funds. Upon receipt of the subsidy funds, all finance departments at the provincial level shall transfer the funds to the entities undertaking the projects in a timely manner.

With respect to an exhibition guided and supported by the MOFCOM, upon closing of the exhibition, the sponsor of the exhibition shall organize participating enterprises to file applications, conduct preliminary examination on the application materials thereof (including the contract on exhibition participation, proof of payment for expenses of exhibition booth, deals made during the exhibition and photos of the exhibition booth), and file the application with the MOF and the MOFCOM for subsidy funds, The MOF shall appropriate the funds after examination and confirmation.

(b) With respect to projects of continuing the development of China's time-honored brands and projects of building the specialized sales network for silk products, the Dedicated Funds shall be allocated to all regions by the factor method upon approval of the plans of pilot implementation of all regions The specific procedures for the use and administration of the Dedicated Funds are as follows:

(i) Determine the plan of pilot implementation. Commercial departments at the provincial level shall propose a plan of pilot implementation in conjunction with relevant departments. Finance departments at the provincial level shall conduct final review thereof and submit the same in conjunction with the commercial departments to the MOF and the MOFCOM prior to August 31. Upon confirmation of the plan of pilot implementation in conjunction with the MOFCOM, the MOF shall appropriate the funds. The plan of pilot implementation shall specify the principles and standards of project arrangement in the region, opinions on specific project arrangement, such safeguarding measures as local supporting funds, and detailed requirements on such specific procedures as fund application, examination and verification, and appropriation.

(ii) Project implementation, and inspection and acceptance. Commercial departments of regions under the pilot implementation shall, in conjunction with relevant departments, organize project implementation and timely perform acceptance and inspection in accordance with the approved plans of pilot implementation. Where adjustment to specific project arrangement is needed based on project implementation, and inspection and acceptance, the same shall be reported the MOF and the MOFCOM for record-filing purposes.

(iii) Fund appropriation. Finance departments of regions under the pilot implementation shall consult with commercial departments, based on the results of the inspection and acceptance, timely appropriate the Dedicated Funds to entities undertaking the projects in accordance with the specified procedures.

(iv) All commercial departments at the provincial level shall submit the formal report on project inspection and acceptance and fund arrangement in 2009 to the MOFCOM by the end of January, 2010.

       二、使用管理程序

    (一)中小商贸企业融资担保费用补助项目,采取因素法将专项资金先行分配地方,具体使用管理程序如下:

    1、制订操作办法。各省级财政部门会同商务部门,按照中央财政下达的专项资金及相关规定,制订本地区资金使用管理具体操作办法,于8月31日前报财政部(经济建设司)、商务部(财务司)备案。操作办法中应明确本地资金申报、审核、拨付等具体程序和所需材料等方面的详细要求。

    2、项目评审和资金拨付。各省级财政、商务部门,每半年组织一次融资担保费用补助资金的申报和审核拨付,2009年上半年和下半年的资金审核拨付工作应分别于2009年9月30日前和2009年12月31日前完成。资金审核拨付情况应于申报期结束后10日内汇总报财政部、商务部(汇总表格式见附件2),同时通过www.creditsys.gov.cn报送电子数据。2009年度资金审核拨付情况应于2010年1月底前报财政部、商务部。

    信用担保机构申请补助资金时应提供下列资料:担保机构的基本情况表(格式见附件3);经中介机构审核、合作银行盖章确认的项目申报期内中小商贸企业贷款担保业务补助资金项目申报表(格式见附件4);经中介机构审核的项目申报期末的会计报表(包括资产负债表、现金流量表、利润表、担保余额变动表等);项目申报期完税证明及汇总表;其他需要的资料。首次申报时还需提供企业法人营业执照副本及章程的复印件。

    (二)国内贸易信用险保费补助项目,采取项目法管理,具体申报程序如下:

    1、项目申报。承办保险机构在地方的分支机构应将2008年1月1日至2009年8月31日发生的符合条件的项目汇总形成《国内贸易信用险保费补助申请表》(格式见附件5)及电子版于2009年9月10日前报送所在地省级财政、商务部门。

    2、项目评审。各省级财政、商务部门应及时对承办保险机构分支机构申报项目进行审核确认,并汇总填写《国内贸易信用险财政补助资金资助情况表》(格式见附件6),于2009年9月15日前报送财政部、商务部,同时向承办保险机构分支机构反馈并由承办保险机构负责汇总报财政部、商务部、保监会。

    3、资金拨付。财政部会同商务部对各地申报材料及时审核,根据审核结果由财政部拨付资金,各省级财政部门收到补贴资金后应当及时通过承办保险机构分支机构转拨投保企业。

    4、项目总结。承办保险机构应于2010年1月底前,向财政部、商务部报送2009年项目补助资金使用情况报告及电子版。报告内容应包括:国内贸易信用保险业务情况,补助资金对促进企业开展信用销售、拉动内需的作用,补助资金的收入、支出和结余情况等。

    (三)中小商贸企业相关市场开拓补助项目申报程序。

    1、参展费补助项目采取项目法管理,具体申报程序为:

    对于商务部主办的展会,在展会结束后,由承办地省级商务主管部门组织参展企业申报,并对企业申报材料(包括参展合同、展位费支付凭证、参展期间成交情况以及展位图片等)进行初审并提出安排初步意见,省级财政部门终审后会同同级商务部门向财政部、商务部提出参展费补助资金申请(中国进出口商品交易会直接由承办单位提出申请)。财政部会同商务部对各地申报材料及时审核,根据审核结果财政部下达专项资金,各省级财政部门收到补贴资金后应当及时转拨到项目承担单位。

    对于商务部引导支持的展会,由展会主办单位在展会结束后组织企业申报并对企业申报材料(包括参展合同、展位费支付凭证、参展期间成交情况以及展位图片等)进行初审后,向财政部、商务部提出资金支持申请。财政部审核确认后拨付资金。

    2、中华老字号传承发展和专业丝绸商品销售网络建设项目,各地试点工作方案审核通过后,再采取因素法将专项资金分配到地方,具体使用管理程序如下:

    (1)确定试点工作方案。省级商务部门会同有关部门提出试点工作方案,省级财政部门终审后会同商务部门于8月31日前报财政部、商务部。财政部会同商务部对试点工作方案进行确认后,财政部下达专项资金。试点工作方案应明确本地区项目安排的原则和标准、具体项目安排意见、地方配套资金等保障措施以及资金申报、审核、拨付具体程序等方面的详细要求。

    (2)项目实施和验收。试点地区商务部门会同有关部门,按照批准的试点工作方案,组织项目实施,并及时进行验收。根据项目实施和验收情况需对具体项目安排进行调整的,应报财政部、商务部备案。

    (3)拨付资金。试点地区财政部门商商务部门,根据验收结果按规定程序及时将专项资金拨付到项目承担单位。

    (4)各省级商务部门应于2010年1月底之前,将2009年项目验收和资金安排情况以正式文件报送商务部。

3. Relevant requirements 

All administrative regions shall effectively manage well project application, review and assessment, organization of implementation, examination and verification, inspection and acceptance, fund appropriation, etc, and effectively use the Dedicated Funds in accordance with relevant provisions. The MOFCOM shall be responsible for the dynamic supervision over project construction and shall organize random inspection on an irregular basis. With respect to regions that fail to carry out the work as required, whose working progress is too slowly or that has problems with the use and administration of the funds, the MOF shall reduce the scale of the Dedicated Funds allocated thereto accordingly.

Credit guarantee institutions in all regions shall regulate its own management in accordance with relevant requirements of the State on financing guarantee institutions, innovate new guarantee methods targeted at the characteristics of commerce and trade enterprises, and actively provide guarantee services for small and medium-sized commerce and trade enterprises with such guarantee as guarantee against warehouse receipts, accounts receivable, and shop leasing right, closed guarantee between members, and mutual guarantee between enterprises, etc. At the same time of strengthening risk management, commercial banks and other financial institutions shall actively support the financing guarantee business of credit guarantee institutions for small and medium-sized commerce and trade enterprises, and reasonably share credit risks. Insurance companies undertaking subsidy for domestic trade credit insurance premiums shall reinforce risk prevention and control, develop insurance products, actively develop credit insurance business for small and medium-sized commerce and trade enterprises, and fully take advantage of the risk sharing and credit enhancement functions of the credit insurance.

       三、相关要求

    各地要切实做好有关项目申报、评审、组织实施、审核验收和资金拨付等工作,按规定用好专项资金。商务部负责对项目建设情况实行动态监管,并组织不定期抽查。财政部对专项资金使用情况实行动态监管,并组织不定期抽查。对于未按要求开展工作、工作进度过慢或资金使用管理存在问题的地区,财政部将相应调减专项资金分配规模。

    各地信用担保机构要按照国家对融资性担保机构的相关要求规范管理,针对商贸企业特点创新担保方式,发展仓单、应收账款、商铺租赁权及会员封闭式、企业互助式等担保方式,积极为中小商贸企业提供担保服务。商业银行等金融机构在加强风险管理的同时,要积极支持信用担保机构中小商贸企业融资担保业务,合理分担信贷风险。承办国内贸易信用保险费用补贴的保险公司要加强风险防控、开发保险产品,积极发展中小商贸企业的信用保险业务,充分发挥信用保险的风险分担和信用提升功能。
