Chapter 1: General Provisions

第一章  总则

  Article 1   In order to regulate and strengthen the administration of development funds for small and medium enterprises (SMEs) in distinctive local industries and to improve the efficiency in fund utilization, these Measures are formulated in accordance with relevant provisions of the Budget Law of the People's Republic of China and other laws and regulations.

       第一条  为规范和加强地方特色产业中小企业发展资金管理,提高资金使用效率,根据《中华人民共和国预算法》等法律、法规的有关规定,制定本办法。

  Article 2   The development fund for SMEs in distinctive local industries (hereinafter referred to as the "fund for distinctive local industries") is the fund which is arranged under the central financial budget in accordance with the Certain Opinions of the State Council on Further Promotion of the Development of Small and Medium Enterprises (Guo Fa [2009] No. 36), specially for supporting SMEs within distinctive local industry clusters and concentrated distinctive industry areas in terms of technological progress, energy conservation and emission reduction, and cooperation and supporting to promote the adjustment and optimization of industrial structure.

       第二条  地方特色产业中小企业发展资金(以下简称特色产业资金)是根据《国务院关于进一步促进中小企业发展的若干意见》(国发[2009]36号),由中央财政预算安排,专门用于支持地方特色产业集群和特色产业聚集区内中小企业技术进步、节能减排、协作配套,促进产业结构调整和优化的资金。

  Article 3   The term "distinctive local industry" as mentioned in these Measures refers to market-oriented, scale, intensive and chain production and operation groups with geographical advantage and resource superiority as the basis and centering on the production, sale, service etc. of featured products.

       第三条  本办法所称地方特色产业是指以地域和资源优势条件为基础,围绕特色产品的生产、销售、服务等而形成的市场化、规模化、集约化和链条化的生产经营群体。

  Article 4   The standard for defining SMEs shall be subject to the current relevant provisions of the State.

       第四条  中小企业的划分标准,按照国家现行有关规定执行。

  Article 5   The administration of the fund for distinctive local industries shall follow the principles of openness and transparency, dedicated use, scientific management and reinforced supervision to ensure the regulatory, safe and efficient use of the fund.

       第五条  特色产业资金的管理应当遵循公开透明、定向使用、科学管理、加强监督的原则,确保资金使用规范、安全和高效。

Chapter 2: Contents and Methods of Support

第二章  支持内容及方式

  Article 6   The fund for distinctive local industries shall be mainly used for the following aspects:

(1) Promoting the technological innovation, and the transformation of achievements by SMEs. Support shall be focused on projects on technological innovation and transformation of scientific and technological achievements, carried out by SMEs within distinctive local industry clusters and concentrated distinctive industry areas, which comply with the State industrial technology policy, and have high innovation standard, strong market competitiveness, good anticipated economic and social benefits, and clear intellectual property rights.

(2) Encouraging SMEs to conserve energy and reduce emissions. Support shall be focused on technological upgrading projects for the production or application of energy conservation and emission reduction products by SMEs within distinctive local industry clusters and concentrated distinctive industry areas, and the construction, rebuilding and expansion as well as technological upgrading of comprehensive control and utilization projects for wastes such as waste water, waste gas, and waste residue within the clusters and concentrated areas.

(3) Strengthening the specialized cooperation between SMEs and key enterprises. Support shall be focused on technological upgrading projects and rebuilding and expansion projects for key products of leading SMEs within distinctive local industry clusters and concentrated distinctive industry areas which have close cooperation and supporting relationship, and technological upgrading projects and rebuilding and expansion projects through which SMEs establish and strengthen the cooperation and supporting relationship with key enterprises and improve the quality in their specialized production.

(4) Supporting the industry upgrading and extension of SMEs. Support shall focus on the industry upgrading of SMEs within distinctive local industry clusters and concentrated distinctive industry areas, the project construction and technological upgrading of SMEs in emerging strategic industries such as new energy, new materials, energy conservation and environmental protection, biology and medicine, information network and high-end manufacturing, and technological upgrading projects through which SMEs in leading industries within the clusters and concentrated areas make extension to front-end and back-end of high value-added industries.

(5) Improving service environment for SMEs. Support shall be focused on projects for providing to SMEs within distinctive local industry clusters and concentrated distinctive industry areas the public services, such as research and development, design, intellectual property protection, engineering technology management, and business information exchange.

Each project undertaking organization may apply only for one of the above support contents in a year.

       第六条  特色产业资金主要用于以下几个方面:

    (一)促进中小企业技术创新和成果转化。重点支持地方特色产业集群和特色产业聚集区内中小企业开展的符合国家产业技术政策、创新水平较高、市场竞争力较强、预期经济和社会效益较好、知识产权清晰的技术创新和科技成果转化项目。

    (二)鼓励中小企业节能减排。重点支持地方特色产业集群和特色产业聚集区内中小企业生产或应用节能减排产品的技术改造项目,集群和聚集区内废水、废气、废渣等废弃物综合治理利用项目的建设、改扩建和技术改造等。

    (三)加强中小企业与骨干企业专业化协作。重点支持地方特色产业集群和特色产业聚集区内有较强协作配套关系的中小龙头骨干企业重点产品技术改造和改扩建项目,中小企业为建立和加强与龙头骨干企业协作配套关系、提高专业化生产水平而进行的技术改造和改扩建项目。

    (四)支持中小企业产业升级和延伸。重点支持地方特色产业集群和特色产业聚集区内中小企业产业升级改造,新能源、新材料、节能环保、生物医药、信息网络及高端制造等战略性新兴产业中小企业项目建设和技术改造,集群和聚集区内主导性产业中小企业向附加值高的产业前端和后端延伸而进行的技术改造项目。

    (五)改善中小企业服务环境。重点支持为地方特色产业集群和特色产业聚集区内中小企业提供研究开发、设计、知识产权保护、工程技术管理、商务信息交流等公共服务项目。

    同一年度,每个项目单位只能选择以上一项内容申请支持。

  Article 7   The fund for distinctive local industries is used for support by way of free financial appropriation and discount loans. Only one method may be applied for each project in a year.

       第七条  特色产业资金的支持方式采用无偿资助、贷款贴息方式。同一年度,每个项目只能申请一种支持方式。

  Article 8   The amount of financial appropriation of the fund for distinctive local industries shall in general be limited to RMB 3 million for each project.

The amount of the discount loan of the fund for distinctive local industries shall be determined according to the amount of a loan and the benchmark loan interest rate of the corresponding period quoted by the People's Bank of China. For each project, the discount period shall not exceed two years in general, the annual discount rate shall not exceed the benchmark loan interest rate of the corresponding period, and the amount of discount loan shall not exceed RMB 3 million in general.

       第八条  特色产业资金无偿资助的额度,每个项目一般不超过300万元。

    特色产业资金贷款贴息的额度,根据项目贷款额及人民银行公布的同期贷款基准利率确定。每个项目的贴息期限一般不超过2年,年贴息率不超过同期贷款基准利率,贴息额度一般不超过300万元。

Chapter 3: Application for Project Funds

第三章  项目资金的申请

  Article 9   An enterprise or organization that applies for the fund for distinctive local industries shall meet the following conditions:

(1) Being located in a distinctive local industry cluster or a concentrated distinctive industry area;

(2) Having qualifications as an independent legal person;

(3) Having a sound financial system;

(4) Having accurate and complete accounting data, and good tax credit and bank credit; and

(5) The project under application complies with the support contents provided for in these Measures.

       第九条  申请特色产业资金的企业或单位须同时具备下列条件:

    (一)位于地方特色产业集群或特色产业聚集区内;(二)具有独立的法人资格;

    (三)财务管理制度健全;

    (四)会计信息准确完整,纳税信用和银行信用良好;

    (五)申报项目符合本办法规定的支持内容。

  Article 10   The application materials for the fund for distinctive local industries shall in general include:

(1) The written application for the fund;

(2) Feasibility report for the project;

(3) Documents on the production and operation conditions or business status;

(4) Accounting statements audited by a certified public accountant;

(5) Duplicate of the business license and the Articles of Association (photocopies) of the project undertaking organization; and

(6) Other materials as required.

       第十条  特色产业资金的申报材料一般应包括:

    (一)资金申请文件;

    (二)项目可行性报告;

    (三)生产经营情况或业务开展情况;

    (四)经注册会计师审计的会计报表;

    (五)承担项目单位法人执照副本及章程(复印件);

    (六)其他需提供的资料。

Chapter 4: Examination and Verification of Projects and Fund Appropriation

第四章  项目审核及资金拨付

  Article 11   The finance departments of all provinces, autonomous regions, municipalities directly under the Central Government, specifically designated cities in the State plan and the Xinjiang Production and Construction Corps (hereinafter referred to as "the financial departments at the province level") shall be responsible for the project application and review of the fund for distinctive local industries in their regions, and the establishment of project libraries.

The fees for review of a project shall be included in the fund for distinctive local industries, and shall be strictly controlled within not more than 0.5% of the amount of the fund for distinctive local industries allocated to its region.

       第十一条  各省、自治区、直辖市、计划单列市及新疆生产建设兵团财政部门(以下简称省级财政部门)负责组织本地区特色产业资金的项目申报、评审工作,并建立项目库。

    项目评审费用在特色产业资金中列支,按照不超过下达各地特色产业资金额度的0.5%从严控制。

  Article 12   The financial departments at the province level shall, according to the overall plan for national economy development and the development plan for distinctive industries etc. in their regions, conduct research to bring forth the needs, support focuses, support plans and implementation plans of the fund for distinctive local industries for the next year, and report the same with the implementation of the fund for distinctive local industries for the then-current year to the Ministry of Finance by the end of each December.

       第十二条  省级财政部门根据本地区国民经济发展总体规划和特色产业发展规划等,研究提出下年度特色产业资金需求、扶持重点、扶持计划和组织实施方案,连同本年度特色产业资金预算执行情况,在每年12月底前上报财政部。

  Article 13   The Ministry of Finance shall, according to the factor method, allocate the fund for distinctive local industries based on the budget of the then-current year and the relevant economy development indexes etc.

       第十三条  财政部按照因素法,根据当年预算和各地有关经济发展指标等分配特色产业资金。

  Article 14   After the public announcement, the financial departments at the provincial level shall, according to the budget indexes issued by the Ministry of Finance and the information pertaining to the review of projects, formulate the annual plans for use of the fund for distinctive local industries in their own region, and submit the same to the Ministry of Finance for record-filing by the end of April of the then-current year. The plan shall include: the names of the organizations and the projects to be supported, support contents, industries, regions, name of industry clusters (or concentrated areas), support methods and amounts etc.

       第十四条  省级财政部门根据财政部下达的预算指标和项目申报评审情况,公示结束后,提出本地区特色产业资金年度使用计划,并于当年4月底前上报财政部备案。具体包括:计划支持单位和项目名称、支持内容、归属产业、地区、产业集群(或聚集区)名称、计划支持方式及金额等。

  Article 15   The financial departments at the provincial level shall allocate the fund for distinctive local industries to the project undertaking organizations in a timely manner in accordance with the relevant provisions on the administration over budget after submitting the annual plans for use of the fund for distinctive local industries in their own region to the Ministry of Finance for record-filing.

       第十五条  省级财政部门将本地区特色产业资金年度使用计划报财政部备案后,按照预算管理的有关规定,及时将特色产业资金拨付给项目单位。

Chapter 5: Supervision and Administration

第五章  监督管理

  Article 16   The Ministry of Finance shall examine support contents, support methods and amounts etc., according to the annual plans for use of the fund for distinctive local industries in their own region submitted by the financial departments at the provincial level for record-filing. Problems shall, if any, be notified to the financial departments at the provincial level in a timely manner for adjustment.

       第十六条  财政部根据省级财政部门上报备案的本地区特色产业资金年度使用计划,对支持内容、支持方式及金额等进行审查。如发现问题,及时通知有关省级财政部门予以调整。

  Article 17   The Ministry of Finance shall on a random basis conduct a selective examination over the administration and use of the fund for distinctive local industries. Local finance departments shall strengthen the supervision and inspection over the administration and use of the fund for distinctive local industries in their regions.

       第十七条  财政部对特色产业资金管理和使用情况进行不定期抽查。地方财政部门应当加强对本地特色产业资金管理和使用情况的监督检查。

  Article 18   The financial departments at the provincial level shall establish a mechanism for the follow-up on the efficiency in the use, and performance assessment, of the fund for distinctive local industries, and report the effect of the implementation of the fund, problems, and policy suggestions etc. to the Ministry of Finance by the end of each March.

       第十八条  省级财政部门应建立特色产业资金使用跟踪问效和绩效评估机制,并将特色产业资金实施效果、存在问题及政策建议等,于每年3月底前上报财政部。

  Article 19   The fund for distinctive local industries shall be used for the dedicated purpose. If the fund for distinctive local industries, after being arranged for use, is verified to be used in violation of the provisions or obtained through deception, the Ministry of Finance shall draw back the fund, and handle such act in accordance with the relevant provisions of the Regulations on Penalties and Sanctions for Fiscal Violations (Decree No. 427 of the State Council).

       第十九条  特色产业资金必须专款专用,对违反规定使用、骗取资金的行为,一经查实,财政部将收回已安排的特色产业资金,并按照《财政违法行为处罚处分条例》(国务院令第427号)的相关规定进行处理。

Chapter 6: Supplementary Provisions

第六章  附则

  Article 20   The financial departments at the provincial level shall, according to the relevant requirements of these Measures, conduct research and formulate specific operating measures that meet the actual needs of their region, and submit the measures to the Ministry of Finance for record-filing within two months after the issuance of these Measures.

       第二十条  省级财政部门根据本办法的有关要求,研究制定符合本地区实际的具体操作办法,并在本办法下发后2个月内报财政部备案。

  Article 21   These Measures shall be implemented on the date of release.

       第二十一条  本办法自印发之日起施行。

  Article 22   The Ministry of Finance shall be responsible for the interpretation of these Measures.

       第二十二条  本办法由财政部负责解释。
