The main administrative departments and finance departments (bureaus) in charge of small and medium enterprises of all provinces, autonomous regions, municipalities directly under the Central Government, and cities specifically designated in the State's plan; and National Development and Reform Commission and finance bureau of Xinjiang Production and Construction Corps:

For the purposes of thorough implementation of the requirements put forward by the Central Government in "accelerating the transformation of the mode of economic development, adjusting and optimizing the economic structure, actively advancing and paving the economy along the track of innovation driven and endogenously grown development", bringing into full play the impact of fiscal funds from the Central Government in promoting excellent and rapid development of the small and medium enterprises, the 2010 funds dedicated to the development of the small and medium enterprises (hereinafter referred to as "dedicated funds") shall focus on supporting the structural adjustments of and stabilization of employment in small and medium enterprises, and improving the financing environment and public service conditions of the small and medium enterprises. For the purpose of managing well the project declaration work for dedicated funds, the relevant matters are hereby notified as follows in accordance with Notice from Ministry of Finance and Ministry of Industry and Information regarding the Printing and Distribution of "Administrative Measures for Funds Dedicated to the Development of Small and Medium Enterprises" (Cai Qi [2008] No. 179, hereinafter referred to as "Administrative Measures") and Notice from Ministry of Finance and Ministry of Industry and Information regarding Printing and Distribution of "Interim Administrative Measures for Credit Guarantee Funds for Small and Medium Enterprises" (Cai Qi [2010] No. 72, hereinafter referred to as " Measures for Guarantee Funds").

    各省、自治区、直辖市、计划单列市中小企业主管理部门、财政厅(局),新疆生产建设兵团发改委、财务局:

    为贯彻落实中央提出的“加快转变经济发展方式,调整优化经济结构,大力推动经济进入创新驱动、内生增长的发展轨道”的要求,充分发挥中央财政资金在促进中小企业又好又快发展中的作用,2010年中小企业发展专项资金(以下简称专项资金)重点支持中小企业结构调整、稳定就业,改善中小企业融资环境及公共服务条件。为做好专项资金项目申报工作,根据《财政部、工业和信息化部关于印发〈中小企业发展专项资金管理办法〉的通知》(财企[2008]179号,以下简称《管理办法》)和《财政部、工业和信息化部关于印发〈中小企业信用担保资金管理暂行办法〉的通知》(财企[2010]72号,以下简称《担保资金办法》),现将有关事项通知如下:

1. Focus of support

(1) Construction projects for fixed assets

A. Technological transformation projects undertaken by enterprises

(a) Structural adjustment projects: The focus is on small and medium enterprises in the light industry, textile, and electronic information industries to support technological transformation projects for new products, new technologies, new processes, promoting industrial upgrading, and advancing industrial migration.

(b) Development projects on specialization: The focus is on technological transformation projects of small and medium enterprises that manufacture supporting products for equipping enterprises in the manufacturing, automobile, ship, iron and steel, non-ferrous metal, and petrochemical industries.

(c) Energy saving and emission reduction projects: The focus is to support technological transformation projects of small and medium enterprises in using energy saving and emission reduction products, technological transformation projects of enterprises that produce energy saving products, and technological transformation projects of industry clusters that carry out centralized pollution control and emission reduction.

(d) Projects for increasing job openings: The focus is to support technological transformation projects that increase job openings at the labor-intensive enterprises that produce products with market and projects on intensive processing of agricultural products that increase job openings. 

B. Construction projects of emerging industries: The focus is on sectors such as electronic information, biotechnology, alternative energy, new materials, etc to support construction projects undertaken in year 2009 by startup enterprises.

C. Projects for improving service environment

(a) Projects for transformation of the environment for starting new business by small enterprises: The focus is on transformation projects on premises and the corresponding public utilities required and the public service facilities required for the development of new businesses of small enterprises.

(b) Transformation projects for service enterprises: The focus is on transformation and upgrading projects for enterprises that provide technology services to small and medium enterprises, projects for transformation of warehouse conditions and construction of service platform for logistic information of logistic enterprises which are situated within industrial clusters, industrial cluster zones or industrial parks for small and medium enterprises and oriented towards small and medium enterprises.

(2) Subsidy schemes for guarantee (re-guarantee) business

A. Subsidy schemes for guarantee business: To provide subsidy to business developed in second half of year 2009 in providing guarantees for financing granted to eligible small and medium enterprises by credit guarantee institution (hereinafter referred to as guarantee institution) that cater to small and medium enterprises.

B. Subsidy projects for re-guarantee business: To grant subsidies to eligible credit re-guarantee institutions that cater to small and medium enterprises (hereinafter referred to as re-guarantee institution) and engage in providing general obligation bonds and proportionate risk sharing businesses (hereinafter referred to as re-guarantee business) to the guarantee institutions in year 2009.

C. Insurance premium subsidy projects: Under the premise of not raising the standard of other charges, to grant insurance premium subsidies to guarantee institutions engaging in low-fee financing guarantee business in the second half of year 2009.

(3) Subsidy projects for events that improve the qualities of enterprises

A. Subsidy projects for improving the management standard of enterprises. The focus is to support the application of information management systems in daily operation, finance, inventories, control of manufacturing process, sales, etc and projects for improving the management standard of the enterprises.

B. Subsidy projects for enterprises applying for patents. To focus on supporting small and medium enterprises that carry out projects on patent development and applications.

(4) Subsidy projects for China International Small & Medium Enterprises Fair

To grant subsidies for the costs of exhibition booths incurred by small and medium enterprises in participating at the 7th China International Small & Medium Enterprises Fair (hereinafter referred to as China Fair) within the territories of China.

       一、支持重点

    (一)固定资产建设类项目

    1、企业技术改造项目

    (1)结构调整项目:以轻工、纺织、电子信息行业中小企业为重点,支持采用新产品、新技术、新工艺,促进产业升级、推进产业转移的技术改造项目。

    (2)专业化发展项目:重点是为装备制造、汽车、船舶、钢铁、有色金属、石化行业企业生产配套产品的中小企业技术改造项目。

    (3)节能减排项目:重点支持中小企业应用节能减排产品的技术改造项目;生产节能产品企业的技术改造项目;产业集群中进行集中治污减排的技术改造项目。

    (4)增加就业岗位项目:重点支持产品有市场的劳动密集型企业增加就业岗位的填平补齐技术改造项目和增加就业岗位的农产品深加工项目。

    2、新兴产业建设项目:以电子信息、生物技术、新能源、新材料等领域为重点,支持2009年初创企业的建设项目。

    3、服务环境改善项目

    (1)小企业创业环境改造项目:重点是小企业创业发展所需场地及相应的公用工程、必要的公共服务设施等改造项目。

    (2)服务企业改造项目:重点是为中小企业提供技术服务企业的改造升级项目;中小企业产业集群、产业集聚区、工业园区内面向中小企业的物流企业仓储条件改造和物流信息服务平台建设项目。

    (二)担保(再担保)业务补助项目

    1、担保业务补助项目:对符合条件的中小企业信用担保机构(以下简称担保机构)2009年下半年开展的中小企业融资担保业务给予补助。

    2、再担保业务补助项目:对符合条件的中小企业信用再担保机构(以下简称再担保机构),2009年开展的为担保机构提供一般责任保证和比例风险分担业务(以下简称再担保业务)给予补助。

    3、保费补助项目:在不提高其他费用标准的前提下,对担保机构2009年下半年开展的低收费融资担保业务给予保费补助。

    (三)企业提高素质活动补助项目

    1、提升企业管理水平补助项目。重点支持中小企业在日常办公、财务、库存、生产过程控制、销售等方面应用信息管理系统,提高企业管理水平的项目。

    2、企业专利申请补助项目。重点支持中小企业开展专利开发、申请项目。

    (四)中国国际中小企业博览会补助项目

    对我国境内参加第七届中国国际中小企业博览会(以下简称中博会)的中小企业的展位费给予补助。

2. Eligibility for declaration

A declaring enterprise must meet the requirements under Article 9 of Administrative Measures. Projects under declaration must meet the support focus of industry policies. Each enterprise is only allowed to apply for one item of subsidy within the same year. Eligible guarantee institution may apply for business subsidy and insurance premium subsidy at the same time.

(1) Eligibility for declaration of construction projects for fixed assets.

A. An enterprise declaring technological transformation projects shall be established prior to June 2008 (construction project for emerging industry shall be applicable to an enterprise that has been established in year 2009), and have independent capacity as a business entity. The number of employees as of end of year 2009 shall be less than 2000 persons, product sales revenue shall be less than RMB 300 million and total assets shall be less than RMB 400 million.

B. A project shall be examined and approved by, or filed for record with a department or an organization equipped with the function of auditing investment projects, and be completed prior to the end of year 2011 as well as not exceed 2 years of construction period. The project construction period shall be based on the time stated in the approved or filed documents. If the approved or filed documents do not specify the construction period, the date of commencement of the project construction shall be taken as the time of approval or record filing.

C. In respect of project for which application for gratuitous subsidy will be made, the total investment of the project shall not exceed RMB 45 million and the investment scale for fixed assets shall not exceed RMB 30 million. Project for which application for interest subsidy on loan will be made, the total project investment shall not exceed RMB 60 million and the investment scale of fixed assets shall not exceed RMB 40 million.

D. In respect of a small and medium enterprise producing supporting products and engages in the development project for specialization, the sales amount for supporting products in year 2009 shall take up more than 50% of the total sales revenue.

E. A project for improving service environment shall meet the following conditions: Ability to assist an enterprise in developing new products, opening up market, securing orders, stabilizing employment, and increasing job openings. A project that does not acquire new land, or a project where the existing factory, infrastructure or other resource is being transformed.

F. New product, new technology or new process refers to the patented technology related to the project being declared and adopted by an enterprise during the period of validity or technology for key new product accredited by the State or new product accredited at the provincial level since year 2007. In respect of purchased technology, the relevant proof of purchase shall be provided.

Energy saving products refer to products that have been listed in the Directory for Advancement of National Key Energy Saving Technology (First Batch) (Notice number 36 issued by National Development and Reform Commission in year 2008) and have already entered the application phase of advancement.

After the completion of the project for increasing job openings, the newly added employed personnel of the enterprise shall exceed 15% of existing number of employees.

(2) Eligibility for declaration of subsidy project for guarantee (re-guarantee) business

Guarantee institutions and re-guarantee institutions applying for subsidies must meet the requirements as stated in Article 7 and Article 8 of Measures for Guarantee Funds. Among which the amount of newly increased guarantee business of the guarantee institutions for second half of the year 2009 shall be more than 1.5 times of the net assets.

(3) Eligibility for declaration of subsidy projects for events that improve the quality of the enterprises 

A. Declaring enterprise shall be established prior to June 2008 with independent capacity as a business entity. The number of personnel at the end of year 2009 shall be less than 2000 persons, product sales revenue shall be less than RMB 300 million and the total assets shall be less than RMB 400 million.

B. Subsidy projects for improving the management standard of the enterprises. These shall be enterprises with construction projects completed in year 2008, operating well in year 2009 and with significant improvement in project related indicators such as inventory turnover ratio, accounts receivable turnover ratio, operating profit margin, growth rate in sales, etc.

C. Subsidy projects for application of enterprises' patents. These shall be for enterprises that have been granted with more than 10 items of patented technologies (more than 5 items of which shall be patents for invention) accepted and authorized by China Patent Office between the period from years 2007 to 2009, and the said patented technologies have already been adopted in the products.

(4) Eligibility for declaration of subsidy projects for China Fair

Small and medium enterprises that have been established within the territories of China and participate in China Fair in year 2010.

       二、申报条件

    申报企业必须符合《管理办法》第九条要求,申报项目须符合产业政策的支持重点,每个企业在同一年度中只能申请一项补助。符合条件的担保机构可以同时申请业务补助和保费补助。

    (一)固定资产建设类项目申报条件

    1、申报技术改造项目的企业须为2008年6月前设立(新兴产业建设项目为2009年新设立的企业),具有独立企业法人资格,2009年末从业人员数低于2000人、产品销售收入低于3亿元、资产合计低于4亿元。

    2、项目须经过具有投资项目审核职能的部门或机构核准或备案,2011年底前建成且建设期不超过2年的在建项目。项目建设期以核准或备案文件中的时间为准,若核准或备案文件中未注明建设期,项目建设起始日期为核准或备案时间。

    3、申请无偿资助的项目,项目总投资不超过4500万元,固定资产投资规模不得超过3000万元;申请贷款贴息的项目,项目总投资不超过6000万元,固定资产投资规模不得超过4000万元。

    4、专业化发展项目中生产协作配套产品的中小企业,2009年协作配套产品销售额应占全部销售收入50%以上。

    5、服务环境改善项目应符合以下条件:能够帮助企业开发新产品、开拓市场,争取订单,稳定就业,增加就业岗位。项目不新征用土地,对现有厂房、基础设施等资源条件进行改造的项目。

    6、新产品、新技术、新工艺是指企业采用与申报项目相关的有效期内的专利技术,或者具有国家重点新产品证书、2007年以来获得的省部级新产品鉴定证书的技术。其中购买技术应提供相关购买证明。

    节能产品是指列入“国家重点节能技术推广目录(第一批)”(国家发展改革委公告2008年第36号)及已进入推广应用阶段的产品。

    增加就业岗位项目完成后,企业新增就业人数须超过现有职工人数的15%。

    (二)担保(再担保)业务补助项目申报条件

    申请补助的担保机构和再担保机构必须符合《担保资金办法》第七条、第八条要求,其中2009年下半年担保机构新增担保业务额须达净资产1.5倍以上。

    (三)企业提高素质活动补助项目申报条件

    1、申报企业须为2008年6月前设立,具有独立法人资格,2009年末从业人员数低于2000人、产品销售收入低于3亿元、资产合计低于4亿元。

    2、提升企业管理水平补助项目。应为2008年完成项目建设,2009年运行良好,与项目相关的存贷周转率、应收账款周转率、营业利润率、销售增长率等指标显著提高的企业。

    3、企业专利申请补助项目。应为在2007年至2009年期间,获得国家专利局受理和授权的专利技术超过10项(其中发明专利超过5项),且专利技术已在产品中使用的企业。

    (四)中博会补助项目申报条件

    在我国境内依法设立并参加2010年中博会的中小企业。

3. Method and limit of funding support

 (1) Construction projects for fixed assets

Where gratuitous subsidy method is adopted, the subsidy amount for enterprise technological transformation projects and construction projects for emerging industries shall not exceed 10% of the amount invested in fixed assets and total amount of equity capital already injected into the enterprise. The subsidy amount for projects on transformation of service environment shall not exceed 30% of the amount invested in the fixed assets and total amount of equity capital already injected into the enterprise. The maximum subsidy amount for each project shall not exceed RMB 3 million.

Where the method of interest subsidy loan is adopted, the interest subsidy period shall not exceed two years. The maximum interest subsidy amount for each project shall not exceed RMB 3 million.

(2) Subsidy projects for guarantee (re-guarantee) business

To grant subsidies in certain proportion to eligible business according to the business scale. In respect of business where the guarantee period is less than one year, it shall be annualized. 

A. Subsidy projects for guarantee business

The scope of guarantee shall cover loan guarantee business provided to small and medium enterprises in respect of guarantee sum below RMB 15 million per loan granted in the second half of year 2009. In respect of guarantee sum below RMB 3 million per loan, the proportion of subsidy shall not be higher than 2%. Where it is between RMB 3 million to RMB 8 million (inclusive), the proportion of subsidy shall not be higher than 1%. Where it is between RMB 8 million to RMB 15 million (inclusive), the proportion of subsidy shall not be higher than 0.5%.

B. Subsidy projects for re-guarantee business

The scope of subsidy covers re-guarantee business for guarantee sum of RMB 15 million (inclusive) and below per loan newly granted in year 2009. The proportion of subsidy for re-guarantee business in respect of general obligation bonds shall not be higher than 0.1% of the loan guarantee sum. The proportion of subsidy for re-guarantee business in respect of proportionate risk sharing shall not be higher than 0.5% of the loan guarantee sum.

C. Insurance premium subsidy projects

The scope of subsidy covers guarantee business in respect of loans granted to small and medium enterprises where the rate of guarantee fee is lower than 50% of the benchmark interest rate of bank loans for the same period. The proportion of subsidy shall not exceed the difference between 50% of the benchmark interest rate of bank loans for the same period and the actual rate of guarantee fee.

The maximum subsidy amount per guarantee institution or re-guarantee institution shall not exceed RMB 30 million. The subsidy funds received by guarantee institution or re-guarantee institution shall be used in making up for compensatory loss.

(3) Subsidy projects for events that improve the quality of enterprises

A. Subsidy projects that improve the management standard of enterprises. The subsidy sum shall not exceed 50% of the actual investment sum for the project (software and hardware). The maximum subsidy per enterprise shall not exceed RMB 3 million.

B. Subsidy projects for application of enterprises' patents. The subsidy sum for each patent granted (including patents already accepted) in the period from years 2007 to 2009 shall not exceed RMB 50,000. The maximum subsidy sum per enterprise shall not exceed RMB 3 million.

(4) Subsidy projects for China Fair

Each standard exhibition booth rented by small and medium enterprises within the mainland shall be granted a subsidy of RMB 3,000. In respect of participating enterprises from zone severely afflicted by disaster and zone highly afflicted by disaster (hereinafter referred to as "earthquake disaster zone), as well as earthquake zone in Yushu of Qinghai, additional subsidy of RMB 3800 will be granted for each standard exhibition booth on this basis.

       三、资金支持方式和额度

    (一)固定资产建设类项目

    采取无偿资助方式的,企业技术改造项目、新兴产业建设项目资助额不超过该项目固定资产投资额的10%和企业已投入的自有资金总额;服务环境改造项目资助额不超过该项目固定资产投资额的30%和企业已投入的自有资金总额。每个项目最高资助额不超过300万元。

    采取贷款贴息方式的,贴息期限不超过两年,每个项目最高贴息额不超过300万元。

    (二)担保(再担保)业务补助项目

    对符合条件的业务按业务额给予一定比例的补助,担保期不足一年的业务按年折算。

    1、担保业务补助项目

    补助范围为2009年下半年新发生的,单笔贷款担保额1500万元(含)以下的,为中小企业提供的贷款担保业务。单笔贷款担保额300万元(含)以下的,补助比例不高于2%;300万元至800万元(含)的,补助比例不高于1%,800万元至1500万元(含)的,补助比例不高于0.5%。

    2、再担保业务补助项目

    补助范围为2009年新发生的,单笔贷款担保额1500万元(含)以下的再担保业务,一般责任保证再担保业务补助比例不高于贷款担保额的0.1%,比例风险分担再担保业务补助比例不高于贷款担保额的0.5%。

    3、保费补助项目

    补助范围为2009年下半年新发生的,单笔贷款担保额1500万元(含)以下的,担保费率低于银行同期贷款基准利率50%的中小企业贷款担保业务,补助比例不超过银行同期贷款基准利率50%与实际担保费率之差。

    单个担保机构、再担保机构最高补助额不超过3000万元。担保机构、再担保机构收到的补助资金,用于弥补代偿损失。

    (三)企业提高素质活动补助项目

    1、提升企业管理水平补助项目。补助额不超过项目实际投资额(软、硬件)的50%,单个企业最高补助额不超过300万元。

    2、企业专利申请补助项目。2007年至2009年期间获得的专利(含已受理专利),每个专利补助额不超过5万元,单个企业最高补助额不超过300万元。

    (四)中博会补助项目

    境内中小企业租用的每个标准展位补助3000元。对《民政部发展改革委财政部国土资源部地震局关于印发汶川地震灾害范围评估结果的通知》(民发[2008]105号)确定的极重灾区和重灾区(以下简称“地震重灾区”)及2010年青海玉树地震灾区内的参展企业,在此基础上每个标准展位再补助3800元。各参展企业按此补助标准减交展位费。

4. Project declaration

 (1) Project declaration shall be reported through the mode of paper-based documents and electronic documents at the same time. Project audit shall be based primarily on the electronic documents. The electronic documents for each project shall be done in such a way that the data is accurate, information is complete and scanned images are clear. The specialist and provincial city shall, upon examination and audit, provide their opinions on the authenticity and integrity of the materials declared, at the same time, elaborate on the supporting justification. Otherwise, it shall not be accepted.

(2) The project declaration organization shall download the "Project Declaration System on Dedicated Funds for the Development of Small and Medium Enterprises" (hereinafter referred to as declaration software) and instruction for the use from China information website for small and medium enterprises (www.sme.gov.cn), fill up and provide relevant information (refer to Appendix 1), and submit the project application to the administrative department for small and medium enterprises and finance department at the registration domicile of the enterprise in accordance with the principle of localization.

(3) There shall be no more than 40 declarations of construction projects for fixed assets (including 10 projects for improvement of service environment), and no more than 10 subsidy projects for events that improve the quality of enterprises for a province, autonomous region and municipality directly under the Central Government; no more than 20 declaration of construction projects for fixed assets (including 5 projects for improvement of service environment) and no more than 5 subsidy projects for events that improve the quality of enterprises for a city designated in the State's plan and Xinjiang Production and Construction Corps.

There shall be no more than 40 declarations of subsidy projects for guarantee (re-guarantee) business in a province, autonomous region and municipality directly under the Central Government and no more than 20 declaration projects for a city designated in the State's plan and Xinjiang Production and Construction Corps.

There shall be no more than 4500 of exhibition booths subsidized by subsidy projects for China Fair 

(4) Administrative departments in charge of small and medium enterprises (hereinafter referred to as administrative department for small and medium enterprise at provincial level) and finance department (hereinafter referred to as finance department at provincial level) at various provinces, autonomous regions, municipalities directly under the Central Government, cities designated in the State's plan and Xinjiang Production and Construction Corps shall carry out the work in accordance with the Administrative Measures and Measures for Guarantee Funds. At the same time, submit reports and project information (two copies each) on project applications for funds dedicated to the development of small and medium enterprises to the Ministry of Finance and Ministry of Industry and Information before 10 June 2010. Project information shall include paper-based documents and electronic documents. Reporting submitted after the stipulated time limit shall not be accepted.

(5) Administrative department for small and medium enterprise at provincial level shall retain all information provided by the organizations that submit the project declaration for record filing.

       四、项目申报

    (一)项目申报采取纸质文件与电子文件同时上报方式,项目审核以电子文件为主。每个项目的电子文件应做到数据准确、资料齐全、扫描图像清晰。专家和省市对申报资料的真实性、完整性提出审核意见,并阐述支持理由。否则不予受理。

    (二)项目申报单位从中国中小企业信息网(www.sme.gov.cn)下载“中小企业发展专项资金项目申报系统”(以下简称申报软件)和使用说明,填写和提供有关资料(见附件1),按照属地化原则,向企业注册地中小企业管理部门和财政部门提出项目申请。

    (三)省、自治区、直辖市申报固定资产建设项目数不超过40个(含服务环境改善项目10个),企业提高素质活动补助项目不超过10个,计划单列市、新疆生产建设兵团申报固定资产建设项目数不超过20个(含服务环境改善项目5个),企业提高素质活动补助项目不超过5个。

    省、自治区、直辖市申报担保(再担保)业务补助项目数不超过40个,计划单列市、新疆生产建设兵团申报项目数不超过20个。

    中博会补助项目补助展位数不超过4500个。

    (四)各省、自治区、直辖市、计划单列市及新疆生产建设兵团中小企业管理部门(以下简称省级中小企业管理部门)和财政部门(以下简称省级财政部门)按照《管理办法》和《担保资金办法》开展工作,并于2010年6月10日前向财政部、工业和信息化部报送中小企业发展专项资金项目申请报告和项目资料(各两份),项目资料包括纸质文件和电子文件。超过规定时限上报的不予受理。

    (五)省级中小企业管理部门应保存项目申报单位提供的全部资料以备查。

5. To strengthen the leadership, and conscientiously manage well the use and administration of dedicated funds for development.

The administrative department for small and medium enterprise at provincial level and the finance department at the same level shall strictly follow the provisions in the relevant documents, make known of information about the organizations and projects, strictly examine the information, evaluate and argue scientifically, and ensure the timeliness, quality and quantity assurance of the declaration work.

In respect of matters not covered in this Notice, these shall be implemented in accordance with the Administrative Measures and Measures for Guarantee Funds.

       五、加强领导,认真做好发展专项资金的使用和管理工作

   省级中小企业管理部门和同级财政部门要严格按照有关文件规定,公开组织项目、严格审查资料、科学评估论证,确保申报工作按时、保质、保量完成。

    本通知未尽事宜,按照《管理办法》和《担保资金办法》执行。
