Development Planning Committees, Price Control Bureaus, and Financial Departments (Bureaus) of All Provinces, Autonomous Regions, and Municipalities Directly under the Central People's Government, the Development Planning Committee and Financial Department of Xinjiang Production and Construction Corps:

According to the provisions of the Notification of the State Development Planning Commission and the Ministry of Finance on Completely Adjusting Charges for the Housing Construction and Canceling Some Charging Items (Ji Jia Ge [2001] No. 585), we hereby make the following notification on the relevant issues on standardizing the charging modes and standards for the official fees for registration of housing ownership:

    各省、自治区、直辖市计委、物价局、财政厅(局),新疆生产建设兵团计委、财务局:

    根据《国家计委、财政部关于全面整顿住房建设收费取消部分收费项目的通知》(计价格[2001]585号)的规定,现就规范房屋所有权登记费计费方式和收费标准等有关问题通知如下:

I. The official fees for registration of the housing ownership mean the registration fees collected by the administrative departments in charge of real estate of the local people's governments at or above the county level from the housing owners for registering the housing ownership and issuing the housing ownership certificates according to law, excluding the housing survey and mapping (or measurement) fees collected by the corresponding institutions.

       一、房屋所有权登记费是指县级以上地方人民政府行使房产行政管理职能的部门依法对房屋所有权进行登记,并核发房屋所有权证书时,向房屋所有权人收取的登记费,不包括房产测绘机构收取的房产测绘(或勘丈)费用。

II. Registration of the housing ownership consists of the preliminary registration of the ownership, registration modification, registration transfer, and registration write-off.

 

       二、房屋所有权登记包括所有权初始登记、变更登记、转移登记、注销登记等内容。

III. The charging modes and standards for registration of the housing ownership shall be based on the following provisions:

1. Regarding collection of the official fees for housing for living purposes, it shall be standardized uniformly to collect the fees for registration by a suite, neither by the fixed ratio of the housing value, nor by the fixed ratio or fixed amount of building area, nor by the fixed amount for a suite any longer. The charging standard for each suite is RMB 80. It shall be standardized uniformly to collect the official fees for registration of housing for other purposes by the fixed amount for a unit, and the specific charging standards shall be checked and ratified by the administrative departments in charge of price control and finance of provinces, autonomous regions, and municipalities directly under the Central People's Government. The collection of official fees for registration of the ownership of housing built by farmers shall be based on the Notice of the State Development Planning Commission, the Ministry of Finance, the Ministry of Agriculture, the Ministry of Land and Resources, the Ministry of Construction, and the Office for Amending Unhealthy Tendencies of the State Council on Developing the Specialized Rectification for Collection of Charges from Farmers for Their Building of Housing (Ji Jia Ge [2001] No. 1531).

2. Write-off of registration shall not be charged.

The aforesaid provisions shall be applicable with reference to all localities' collection of the official fees for registration of other housing titles (including mortgage rights and pledge rights) based on the approved management powers.

       三、房屋所有权登记费的计费方式和收费标准,按下列规定执行:

    (一)对住房收取的,从现行按房屋价值量定率计收、按房屋建筑面积定率或定额计收、按套定额计收等,统一规范为按套收取,每套收费标准为80元。住房以外其他房屋所有权登记费,统一规范为按宗定额收取,具体收费标准由省、自治区、直辖市价格、财政部门核定。农民建房收费按照《国家计委、

    财政部、农业部、国土资源部、建设部、国务院纠风办关于开展农民建房收费专项治理工作的通知》(计价格[2001]1531号)规定执行。

    (二)注销登记不得收费。

    各地按照规定管理权限批准收取的房屋他项权利(包括抵押权、典权等)登记费,比照上述规定执行。

IV. The administrative departments in charge of real estate shall not collect the production cost for issuing a housing ownership certificate according to the relevant provisions, and may collect the production cost of RMB 10 for adding a housing ownership (co-ownership) certificate for two or more housing owners.

Where a housing owner applies for re-issuing a certificate due to loss or damage, or it is required to re-issue a certificate according to the relevant provisions, but the ownership remains unchanged, the production cost of RMB 10 shall be collected for a certificate.

 

       四、行使房产行政管理职能的部门按规定核发一本房屋所有权证书免于收取工本费;向一个以上房屋所有权人核发房屋所(共)有权证书时,每增加一本证书可按每本10元收取工本费。

    权利人因丢失、损坏等原因申请补办证书,以及按规定需要更换证书且权属状况没有发生变化的,收取证书工本费每本10元。

V. The Ministry of Finance shall be responsible for examining and approving the charging items of the official fees for registration of the housing ownership jointly with the State Development Planning Commission, and the State Development Planning Commission shall be responsible for checking and ratifying the charging standards jointly with the Ministry of Finance. Apart from the charging items and standards as specified herein, the administrative departments in charge of real estate shall not collect any other charges such as the housing measurement fees in the course of registration of the housing ownership.

       五、房屋所有权登记费项目由财政部会同国家计委负责审批,收费标准由国家计委会同财政部负责核定。除本通知规定的收费项目和收费标准外,房产行政主管部门在房屋所有权登记过程中不得收取房屋勘丈费等其他任何费用。

VI. In order to collect the official fees for registration of the housing ownership, the charging licenses shall be obtained from the designated administrative departments in charge of price control in accordance with the relevant provisions of the State, and the receipts for the administrative charges made and printed by the administrative departments in charge of finance of all provinces, autonomous regions, and municipalities directly under the Central People's Government shall be used. The charging units shall announce the prescribed charging items and standards, pursue the collection of fees by showing licenses, and be consciously subject to the supervision and inspection of the administrative departments in charge of price control and finance.

       六、收取房屋所有权登记费,应按照国家有关规定到指定的价格主管部门办理收费许可证,并使用各省、自治区、直辖市财政部门统一印制的行政事业性收费票据。执收单位要公布规定的收费项目和收费标准,实行亮证收费,自觉接受价格、财政部门的监督检查。

VII. The official fees for registration of the housing ownership are the administrative charges, shall be put into the budgets of the local finances at the same levels, and shall be subject to the management of "two lines of incomes and expenses" in accordance with the relevant provisions of the Notification of the Ministry of Finance on the Relevant Issues on Subsuming the Administrative Charges under the Budget Control (Cai Yu [1994] No. 37). Specifically, the administrative departments in charge of real estate shall, within three days upon obtainment of the aforesaid incomes, turn over such incomes as the official fees for registration of the housing ownership to the local treasuries at the same levels in full on the spot. For turning over such incomes to treasuries, the General Pay-in Warrant shall be used, and these departments shall fill in the heading of Incomes from the Administrative Charges for Construction under Paragraph 4203 of Category 42 "Incomes from the Administrative Charges" under the government budget title "General Budgetary Incomes and Expenses". The expenses shall be based on the approved budgets.

       七、房屋所有权登记费等收费属于行政性收费,应当按照《财政部关于行政收费纳入预算管理有关问题的通知》(财预[1994]37号)的有关规定,纳入同级地方财政预算,实行“收支两条线”管理。即:房产行政主管部门,应在取得以上收入后的3日内,就地将房屋所有权登记费等收费收入全额上缴同级地方国库,缴库时使用“一般缴款书”,并填列政府预算科目“一般预算收支”科目第42类“行政性收费收入”第4203款“建设行政性收费收入”科目,支出按批准的预算安排使用。

VIII. This Notification shall take effect as of 1st May 2002. The provisions on the official fees for registration of the housing ownership of Article IV of the Notification on Issuing the Charging Items and Standards for the Administrative Charges of the Construction System under the Central People's Government (Ji Fei Zi [1992] No. 179), and the local provisions on such fees shall be repealed simultaneously.

       八、本通知自2002年5月1日起执行,原国家物价局、财政部《关于发布中央管理的建设系统行政事业性收费项目及标准的通知》(价费字[1992]179号)中第四条有关房屋所有权登记费的规定,以及各地有关房屋所有权登记费的规定同时废止。
