Commerce authorities and finance departments (bureaus) of all the provinces, autonomous regions, municipalities directly under the Central Government, the cities specifically designated in the state plan and Xinjiang Production and Construction Corps, Shanghai Headquarter, all branches, departments of operation management, central branches( stationed in the capitals of all the provinces and autonomous regions) of the People's Bank of China, and banking regulatory bureaus and insurance regulatory bureaus in all the provinces, autonomous regions, municipalities directly under the Central Government, the cities specifically designated in the state plan and Xinjiang Production and Construction Corps:

To implement the Opinions of the General Office of the State Council on Reviving Circulation and Expanding Consumption (Guo Ban Fa [2008] No. 134) and promote healthy development of credit sales, we hereby give the following opinions on relevant work:

    各省、自治区、直辖市、计划单列市及新疆生产建设兵团商务主管部门、财政厅(局),中国人民银行上海总部、各分行、营业管理部、各省会(首府)城市中心支行,各省、自治区、直辖市、计划单列市及新疆生产建设兵团银监局、保监局:

    为了贯彻《国务院办公厅关于搞活流通扩大消费的意见》(国办发〔2008〕134号),推动信用销售健康发展,现就有关工作提出以下意见:

1.   To fully appreciate the significance of credit sale

Credit sales is a method that allows enterprises to sell their goods or services to entities or individuals by means of installment payments or deferred payments. It is a basic form of commodity transaction under the market-oriented economy, and is an important means of direct credit not only between operators, but also between operators and consumers.

As impacted by the global financial crisis and economic slowdown, China's economy is facing tough challenges. Expanding domestic demands, boosting consumption, and maintaining fast and steady economic growth have become the primary task of our macroeconomic regulation. The development of credit sales may assist in expanding domestic demands, triggering consumption growth, accelerating capital turnover, improving economic efficiency; diversifying methods of financing, fostering coordinated development of bank credit and business credit, and alleviating the difficulty of small and medium-sized enterprises with financing and improve the credit environment in the market and the social credit system. Therefore, we shall view credit sales as an important means to expand domestic demands and ensure economic growth, and take robust measures to promote it.

       一、充分认识发展信用销售的重要意义

    信用销售是企业通过分期付款、延期付款等方式向单位或个人销售商品或服务的交易方式,是市场经济中商品交易的基本形态,是生产经营者相互之间、以及生产经营者与消费者之间直接信用的重要形式。

    当前,受世界金融和经济危机冲击,我国经济发展面临严峻挑战,扩大内需、促进消费、保持经济平稳较快发展成为宏观调控的首要任务。发展信用销售,有助于扩大国内需求,刺激消费增长;有助于加快资金周转,提高经济运行效率;有助于丰富融资途径,促进银行信用和商业信用协调发展,缓解中小企业融资困难;有助于优化市场信用环境,完善社会信用体系。要把信用销售作为扩大内需、保证经济增长的重要途径,采取切实有力的措施,积极予以推动。

2.   To promote the comprehensive and healthy development credit sale 

We shall develop credit sales between enterprises to allow sellers to locate their target markets in advance and expand the sales scale, and buyers to expand their purchase scale and improve efficiency of capital utilization with less capital in longer payment periods.

We shall also promote credit sales between enterprises and consumers. In addition to the consumption credits provided by banks, large retailers shall be encouraged to conduct credit sales directly with consumers. Retailers shall be encouraged to conduct credit sales businesses in collaboration with commercial banks and credit guarantee companies to expand immediate consumption.

       二、推动信用销售全面健康发展

    发展企业之间的信用销售,使卖方企业通过信用销售提前锁定目标市场,扩大销售规模;使买方企业以较少的资金投入和较长的支付周期,扩大采购规模,提高资金利用效率。

    发展企业与消费者之间的信用销售。在银行消费信贷的基础上,鼓励大型零售企业向消费者直接开展信用销售,鼓励零售企业与商业银行、信用担保公司合作开展各类信用销售业务,扩大即期消费。

3.  To establish and improve the risk prevention & sharing mechanism for credit sale

Credit risk prevention and sharing is the key for ensuring healthy development of credit sales. We shall, based on the conditions of specific industries and fields, lead and prompt enterprises to improve their credit sale risk management systems (such as credit risk evaluation & decision-making, and management of client credit profiles and account receivables) and properly use risk management tools. Also, we shall encourage enterprises to purchase credit services and products provided they do not undermine creditors' legal rights and interests, study enterprise credit trading data exchange & sharing mechanism and collect & analyze such trading data as account receivables and relevant credit information.

We shall promote the development of credit insurance for domestic trades and provide professional services to help enterprises to properly evaluate client credit and make the right decisions. In the event of credit risks, insurance institutions shall compensate for the losses incurred as agreed to decrease the losses suffered by the enterprises. We shall also guide insurance companies to reduce risks and costs associated with insurance and minimize premiums paid by insured enterprises through large-scale operation and appropriate management. Enterprises shall be encouraged to purchase credit insurance, and the State shall provide medium and small-size enterprises with proper support.

       三、建立完善信用销售的风险防范分担机制

    防范分担信用风险,是确保信用销售健康发展的关键。要根据不同行业和领域的具体情况,引导和推动企业健全信用风险评估与决策、客户信用档案、应收账款管理等信用销售风险管理制度,科学利用各种风险管理工具。在不损害信用主体合法权益的前提下,鼓励企业购买信用服务和产品;探索企业信用交易数据交换共享机制,汇集和分析客户的应收账款等交易数据和相关信用信息。

    促进国内贸易信用保险的发展,通过专业服务,帮助企业科学评价客户信用,作出正确决策;在发生信用风险时,保险机构按照约定及时赔付,减少企业损失。引导保险公司通过规模经营、科学管理降低承保风险和成本,减轻企业保费负担。鼓励企业购买信用保险,国家对中小商贸企业给予适当支持。

4.   To develop patterns of financing suitable for credit Sale

To enhance finance support to credit sales. We shall encourage commercial banks to strengthen their cooperation with enterprises and insurance institutions, develop trade financing under credit insurance, reduce credit risks of their own, and help enterprises address financing difficulty in their credit sales. Commercial banks are encouraged, based on characteristics of credit sales, to innovate the means of guarantee and develop pledge loans with movables, warehouse receipts and account receivables as well as new finance businesses such as factoring.

       四、发展适应信用销售特点的融资模式

    加强对信用销售的融资支持。鼓励商业银行加强与企业、保险机构之间的合作,发展信用保险项下的贸易融资,降低自身信贷风险,帮助企业解决信用销售中的融资困难。鼓励商业银行针对信用销售特点,创新担保方式,发展动产、仓单、应收账款等质押贷款,发展保理等新型融资业务。

5.   To facilitate and regulate development of service industries in connection with credit sale

We shall regulate the development of the industry of commercial debts collection, promote the standardization and specialization of the collection and management of account receivables, perform pilot implementation of factoring business, foster circulation of account receivables, develop capital disposing service, facilitate circulation of debt paying assets, encourage credit service institutions to develop credit services and products to meet enterprises' credit management needs.

       五、促进和规范信用销售相关服务业的发展

    要规范商账追收服务行业的发展,促进应收账款追收、管理的规范化和专业化;开展商业保理业务试点,促进应收账款流转;发展资产处置服务业,促进抵债资产流转;鼓励信用服务机构开发信用服务产品,满足企业信用管理需求。

6.   Meticulous organization, effective leadership and steady advancement

Commerce and finance authorities, branches of the People's Bank of China, banking regulatory commissions and insurance regulatory commissions across the Country shall pay much attention to credit sales and conduct in-depth research and investigation, provide ongoing instruction and promote steady progress in an integral way according to conditions of respective regions and characteristics of the industries, shall strengthen publication and training for credit sales and credit risk management, and shall ensure effective information communication, and report the development of credit sales and relevant problems on a timely basis to the Ministry of Commerce, the Ministry of Finance, the People's Bank of China, the China Banking Regulatory Commission and the China Insurance Regulatory Commission.

    各地商务、财政、人民银行分支机构、银监、保监等部门,要高度重视信用销售工作,依据地区和行业特点,深入研究,跟踪指导,统筹安排,稳步推进;加强对信用销售和信用风险管理的宣传培训;加强信息沟通,将信用销售发展的情况和问题及时向商务部、财政部、人民银行、银监会、保监会反馈。
