To economic and trade commissions (economic commissions, commerce commissions, domestic trade offices or finance and trade offices), departments (bureaus) of commerce, and finance departments (bureaus) of relevant provinces, autonomous regions and municipalities directly under the Central Government, local finance commissioner's offices of the Ministry of Finance, branches and business management departments of the People's Bank of China, the Industrial and Commercial Bank of China, Agricultural Bank of China, Bank of China, China Construction Bank, China Merchants Bank and Bank of Communications,

With a view to supporting the pilot program on logistics agency system, and addressing problems related to the policy-related losses suffered by pilot distribution enterprises prior to the commencement of the pilot program, the Ministry of Finance, the People's Bank of China, the State Administration of Taxation, the former State Economic and Trade Commission, and the former State Administration for Domestic Trade jointly printed and distributed the Notice on Issues Concerning the Policy of Suspending the Repayment of Bank Loans and Interest in Respect of Policy-related Losses Incurred by Pilot Distribution Enterprises Prior to the Commencement of the Pilot Program on Logistics Agency System (Cai Jian [2000] No. 62) (hereinafter referred to as the "Notice") in 2000. Pursuant to the Notice, 24 central and local distribution enterprises participating in pilot program on logistics agency system, after being examined and verified by related departments, no longer need to repay the principal and interest of loans in respect of policy-related losses, provided that the unpaid principal and interest are still recorded under the names of the said enterprises. The policy so described expired on December 20, 2003. With a view to investigating the implementation of the policy by enterprises, and working out new policy measures for further promoting the development of modern distribution methods such as the agency system, relevant tasks to be accomplished following the expiry of the said policy are hereby notified as follows:

    有关省、自治区、直辖市经贸委(经委、商委、内贸办、财贸办)、商务厅(局)、财政厅(局)、财政部驻当地财政监察专员办事处,中国人民银行各分行、营业管理部,中国工商银行,中国农业银行,中国银行,中国建设银行,招商银行,中国交通银行:为支持物资代理制试点工作,解决试点流通企业试点前政策性亏损问题,2000年,财政部、人民银行、税务总局、原国家经贸委、原国家国内贸易局印发了《关于对物资代理制试点流通企业试点前政策性亏损实行挂帐停息的有关问题的通知》(财建[2000]62号,以下简称《通知》)。《通知》对通过有关部门审核和核实的24家中央和地方物资代理制试点流通企业发生的政策性亏损所占用的贷款本金和利息实行挂帐停息。2003年12月20日挂帐停息政策到期。为了解企业执行政策情况,研究进一步推进代理制等现代流通方式发展的政策措施,现就做好挂帐停息政策到期后相关工作通知如下:

1. Pilot enterprises shall conscientiously summarize the experience during the implementation of pilot program on logistics agency system. The summary shall cover the basic information on steel and automobile agency business carried out since the commencement of the pilot program, practices that help the enterprises fully enter the market, establish nationwide sales networks, and improve sales and service functions, information on their restructuring, reorganization, transformation and reinforced efforts in management, problems arising in the course of their development, etc.

       一、试点企业要对开展物资代理制试点工作进行认真总结。包括:企业实行代理制试点工作以来开展钢材、汽车代理业务的基本情况;企业全面走向市场,建立全国销售网络,完善销售和服务功能的做法;企业改制、改组、改造和加强管理的情况;企业发展中存在的问题等。

2. Pilot enterprises shall submit the summary report on their operation conditions and financial status since the implementation of the policy of suspending the repayment of bank loans and interest in respect of policy-related losses, fill in and submit the Questionnaire on Information Concerning Distribution Enterprises Participating in the Pilot Program on Logistics Agency System from 1998 to 2003 (Appendix 2), and submit the balance sheet and income statement for the year of 2003. The aforesaid information and data shall be true, accurate and comprehensive, and shall, after being examined and confirmed by the signature and seal of local competent departments, lending banks and local finance commissioner's offices of the Ministry of Finance, be submitted to the Department of Commercial Reform and Development of the Ministry of Commerce by the end of this March.

       二、试点企业要将实行挂帐停息以来的经营情况和财务状况汇总上报,按要求填报《1998-2003年物资代理制试点流通企业有关情况调查表》(附件2),提交2003年资产负债表和损益表。上述数据必须真实、准确、全面,并经当地主管部门、承贷银行和财政部驻当地财政监察专员办事处审核签章后,于3月底前上报商务部商业改革发展司。

3. Competent commerce departments shall actively follow the progress of the implementation of pilot program on logistics agency system, and according to the list of enterprises (see Appendix 2) contained in Schedule 1 to the Notice, organize all the enterprises concerned to conscientiously and truthfully submit the summary report on their implementation of the pilot program on agency system and their operation conditions, and put forward relevant policy proposals. Any change of the property rights due to the restructuring of enterprises and any other reasons shall be truthfully and comprehensively reported.

       三、商务主管部门要积极了解物资代理制试点工作的开展情况,按照《通知》附表一所列的企业名单(见附件2),组织所有企业认真、如实地总结上报开展代理制试点工作情况和企业的经营状况,提出相关的政策建议。企业由于改制等出现的产权变化情况也要如实报告,不能遗漏。

4. Lending banks shall sum up the implementation of the policy of suspending the repayment of bank loans and interest in respect of policy-related losses and the problems in connection therewith, examine the amount involved and repayment ability of the enterprises concerned, and actively assist the enterprises in financial reporting.

       四、各承贷银行要总结挂帐停息政策的执行情况及存在的问题,审核企业挂帐停息金额和企业的还贷能力,积极配合企业做好相关的财务申报工作。

5. Finance departments shall properly supervise and examine the financial status of the enterprises concerned.

       五、财政部门要做好企业财务情况的监督审查工作。

6. Competent commerce departments, finance departments and banks of all regions shall closely collaborate with each other, conscientiously summarize the experience upon expiry of the policy of suspending the repayment of bank loans and interest in respect of policy-related losses, and according to the actual conditions of the enterprises concerned, actively offer policy suggestions to local governments for further supporting the reform of logistics enterprises to the extent affordable by financial resources.

       六、各地商务主管部门、财政部门和银行部门要积极配合,认真做好挂帐停息政策到期后的总结工作,根据企业的实际情况,积极向地方政府提出在财力许可范围内进一步支持物资流通企业改革的政策建议。
