  Article 1  Objectives and Basis

In order to further regulate administration and usage of leading fund for service industry development, increase fund benefits, exert leading and guiding role of financial fund, improve development environment of service industry, and guide increase of social capital from various sources to input into service industry, These Measures have been formulated in accordance with spirits of relevant documents of State Council and requirements of Shanghai municipal party committee and government on speeding up the formation of industrial structure mainly in service economy and on the basis of trial implementation of Trial Measures for Usage and Administration of Leading Fund for Service Industry Development of Shanghai Municipality (Hu Fu [2007] No.1) .

       第一条  目的和依据

    为进一步规范服务业发展引导资金的管理和使用,提高资金效益,发挥财政资金的引导带动作用,改善服务业发展环境,引导各类社会资本加大对服务业的投入,根据国务院有关文件精神和上海市委、市政府加快形成以服务经济为主产业结构的要求,在试行《上海市服务业发展引导资金使用和管理试行办法》(沪府〔2007〕1号)的基础上,制订本办法。

  Article 2   Sources of Fund

Leading fund for service industry development (hereinafter referred to as leading fund) is a kind of subsidized fund which is arranged to be specially used for service industry development of Shanghai municipality within local budget. Finance of Shanghai municipality shall yearly arrange RMB 20 million as budget, and all districts and counties acquiring support of leading fund of Shanghai municipality shall arrange matching fund no less than a proportion of one to one. 

       第二条  资金来源

    服务业发展引导资金(以下简称“引导资金”)是由地方财政预算内安排的专项用于全市服务业发展的补助性资金。市级财政预算每年安排2亿元,获得市级引导资金支持的区(县)应按照不低于1∶1的比例安排配套资金。

  Article 3   Usage Scope

Leading fund shall be mainly used in weak links, key areas, important regions and new industry of service industry development to promote internationalization, marketization, socialization and large-scale development of service industry. It is mainly used in following areas:

1. Encourage all enterprises of Shanghai municipality to apply for various state leading funds for service industry and provide them with matching funds. 

2. Support development of major areas of service industry complied with List of Industry Development of Shanghai Municipality to Be Given Special Support, including shipping services, information services, modern logistics, professional services, cultural services, exhibition, tourism, modern commerce and trade, educational training, medical services, creative industries, etc., and provide appropriate subsidies and loan discounts to key projects that play a leading role in their fields.

3. Support development of service trade, and give performance support, loan discounts, insurance expense subsidies, certification allowance, overseas promotion cost subsidies, etc. to key enterprises; and support development of service outsourcing business. Specific supporting ways for service trade and service outsourcing shall be otherwise formulated by development and reform commission, commerce commission and financial bureau of Shanghai municipality.

4. Encourage manufacturing enterprises to develop productive service industry and provide appropriate subsidies and loan discounts to their key projects. 

5. Support construction of public service platform that may provide service support such as information, technology, talents, trade, and funds to support and improve whole development environment of service industry, and give appropriate subsidies and loan discounts to their key projects. 

6. Support construction of various types of modern service industry cluster districts that play important demonstrating and leading roles, and give appropriate subsidies to functions and buildings of their core areas, and preliminary planning and demonstration of their multidimensional traffic organization.

7. Other matters approved by people's government of Shanghai municipality necessary to be supported.

       第三条  使用范围

    引导资金主要用于服务业发展中的薄弱环节、关键领域、重点区域和新兴行业,促进服务业的国际化、市场化、社会化和规模化发展。主要用于如下方面:

    (一)鼓励本市企业申请国家各类服务业引导资金,并提供配套资金。

    (二)支持符合《上海产业发展重点支持目录》的服务业重点领域发展,包括航运服务、信息服务、现代物流、专业服务、文化服务、会展、旅游、现代商贸、教育培训、医疗服务、创意产业等,对该领域中发挥引领作用的重点项目给予适当补贴或贷款贴息。

    (三)支持服务贸易发展,对重点企业给予绩效支持、贷款贴息、保险费用补贴、认证补贴及境外推广费用补贴等;支持服务外包业务发展。对服务贸易和服务外包的具体支持方式,由市发展改革委、市商务委和市财政局另行制定。

    (四)鼓励制造业企业发展生产性服务业,对其重点项目给予适当补贴或贷款贴息。

    (五)支持能提供信息、技术、人才、贸易、资金等服务支撑、完善服务业整体发展环境的公共服务平台建设,对其重点项目给予适当补贴或贷款贴息。

    (六)支持具有示范带动作用的各类现代服务业集聚区建设,对其核心区域功能、建筑及立体交通组织的前期规划论证给予适当补贴。

    (七)经市政府批准其他需要支持的事项。

  Article 4   Supporting Ways and Credit Line

Municipal leading fund shall adopt supporting ways of gratuitous sponsorship or loan discount (alternative).

If a way of gratuitous sponsorship is adopted, the proportion of fund support for a single project shall not exceed 20% of the total investment amount or total expense of this project and the amount shall not exceed RMB 3 million. If a way of loan discount is adopted, we shall determine the loan discount in terms of credit line of the project and statutory benchmark interest rate published by People's Bank of China in the same period. Discount deadline of each project shall not exceed two years and discount credit line of each project shall not exceed RMB 4 million.

       第四条  支持方式和额度

    市级引导资金的支持,采用无偿资助或贷款贴息方式(二者选一)。

    采用无偿资助方式支持的,单个项目资金支持比例最高不超过项目总投资额或总费用的20%,金额不超过300万元。采用贷款贴息方式支持的,根据项目贷款额度及人民银行公布的同期贷款法定基准利率确定。每个项目的贴息期限最高不超过2年,贴息额度不超过400万元。

  Article 5   Declaration and Approval Procedures

An evaluation group consisting of development and reform commission, economic informationization commission, commerce commission and financial bureau of Shanghai municipality shall be responsible for such work as declaration, acceptance, evaluation, management, examination, approval, supervision and inspection of leading fund. Office of the evaluation group shall be located in development and reform commission of Shanghai municipality.

Municipal enterprises and units may directly report to competent industrial departments of Shanghai municipality, and other enterprises and units may report to relevant departments located in the districts or counties of their tax registrations. Competent industrial departments of Shanghai municipality and relevant departments of the districts or counties applying for leading fund shall, in accordance with usage orientations of leading fund and key supporting fields, compile annual application reports of leading fund and submit them to the evaluation group by the end of April each year. Any Project that already received financial subsidies or support from government shall not be accepted. Competent industrial departments of Shanghai municipality and relevant departments of the districts or counties shall be responsible for authenticity of declaration materials.

For declaration materials submitted by competent industrial departments of Shanghai municipality and relevant departments of the districts or counties, the evaluation group shall be responsible for organizing panel of experts to conduct expert evaluation and entrust intermediaries to evaluate. For projects having been evaluated and approved by the evaluation group, development and reform commission of Shanghai municipality shall release investment plan of leading fund to various competent industrial departments and relevant departments of the districts or counties.

       第五条  申报和审批程序

    由市发展改革委、市经济信息化委、市商务委、市财政局等部门组成评审小组,负责引导资金的申报受理、评估管理、审核批复、监督稽查等工作。评审小组办公室设在市发展改革委。

    市属企业和单位可直接向市行业主管部门申报,其他企业和单位可向其税务注册地的所在区县有关部门申报。申请引导资金的市行业主管部门和区县有关部门根据引导资金使用方向和重点支持领域,编写引导资金年度申请报告,于每年4月底前,送交评审小组办公室。已经安排政府资金补贴或支持的项目不予受理。市行业主管部门和区县有关部门须对申报材料的真实性负责。

    对市行业主管部门和区县有关部门报送的申请材料,评审小组负责组织专家组进行专家评审,委托中介机构进行评估。对经评审小组审核同意的项目,由市发展改革委会同相关部门下达引导资金投资计划至各行业主管部门和区县。

  Article 6  Materials submitted for Application

Competent industrial departments of Shanghai municipality and relevant departments of the districts or counties applying for leading fund shall submit annual application reports of leading fund which mainly include the following aspects: analysis of effect of key project to be promoted on optimizing structures, boosting energy levels, increasing tax revenues, expanding employment, etc.; analysis of significance & necessity of key public service platform to be promoted, construction of modern service industry Cluster district and various activities on perfecting development environment of service industry and accelerating development of service industry. Thereinto, finance of districts or counties shall be ensured in application reports of the districts and counties to give matching funds no less than a proportion of one to one on projects applying for support of municipal leading fund. And at the same time, the following annexes shall be provided:

1. Summary sheet for leading fund application, mainly including main purpose of fund, total investment amount, applied amount of leading fund and other sources of fund, etc. 

2. Application form for leading fund, mainly including basic information of applicant entities, basic information and nature of projects, necessities of projects, implementation of external conditions of projects, building contents & goals of projects, schemes of projects and feasibility analysis, planning schedules (projects under construction or to be construct within the year), qualitative index of social benefits, information of project fund, etc. Thereinto, main usage structure of leading fund shall be cleared, mainly including equipment purchase and installation, software development, system integration, staff training, technology transfer, design consultancy, construction load interest, etc. 

3. Applicant entities shall provide business licenses or certificates of legal persons, investment certificates of project funds collected by their own, etc.

4. Key projects using leading fund shall be attached with relevant approval documents, that is, the feasibility study reports of government-invested projects or approval documents of examination and approval (filing) of enterprise-invested projects and opinions of such departments as planning departments, land departments and environment protection departments. 

5. Projects applied for loan discounts shall present loan agreements or contracts entered between project units and relevant financial institutions. Supporting projects in planning field shall provide relevant payment instruments or relevant contracts and agreements.

6. Other relevant documents such as achievements or certificates.

       第六条  申请提交的材料

    申请引导资金的市行业主管部门和区县有关部门,需要提交引导资金年度申请报告,主要包括:拟重点推进的项目对优化结构、提升能级、增加税收和扩大就业等作用分析;拟重点推进的公共服务平台、现代服务业集聚区建设、举办各类活动对完善服务业发展环境、加速服务业发展的重要性和必要性分析。其中,区县申请报告中要承诺区县财政对申请市级引导资金支持的项目,以不低于1∶1的比例给予配套。同时,需要提供以下附件:

    (一)引导资金申请汇总表,主要包括:资金的主要用途、总投资额、申请引导资金数额及其他资金来源等。

    (二)引导资金项目申请表,主要包括:申报单位基本情况、项目基本情况及性质、项目的必要性、项目外部条件落实情况、项目建设内容及目标、项目方案及可行性分析、计划进度(必须是在建或年内开工项目)、社会效益定性指标、项目资金情况等。其中,须明确申请的引导资金主要用途构成,主要包括:设备购置安装、软件开发、系统集成、人员培训、技术转让、设计咨询、建设期利息等。

    (三)申报单位须提供营业执照或法人证书以及项目自筹资金出资证明等。

    (四)使用引导资金的重点项目必须附有关批准文件,即政府投资项目的可行性研究报告或企业投资项目的核准(备案)的批准文件以及规划、土地、环保等部门意见。

    (五)申请贴息的项目须出具项目单位与有关金融机构签订的贷款协议或合同。规划类支持项目须提供相关支付凭证或有关合同、协议。

    (六)成果或证书等其他相关文件。

  Article 7   Usage Supervision and Evaluation Administration

For projects examined and approved by the evaluation group, fund shall be allocated by financial bureau of Shanghai municipality in accordance with relevant regulations of financial fund budget and administration.

All competent industrial departments of Shanghai municipality and relevant departments of the districts or counties using leading fund shall strengthen supervision, and be responsible for such daily management works as inspecting implementation of service industry development planning and promoting the implementation, inspection and acceptance of specific projects. If any major problem is discovered, please timely report it to the evaluation group. 

Development and reform commission, economic informationization commission, commerce commission, financial bureau and audit bureau of Shanghai municipality, together with other departments shall supervise, audit and check usage information of leading fund and implementation of projects in accordance with relevant regulations. 

All competent industrial departments of Shanghai municipality and relevant departments of the districts or counties using leading fund shall timely summarize development of service industry, usage information of fund and implementation of projects, and submit usage report of leading fund of last year to the office of the evaluation group before the end of next February. The evaluation group shall be responsible for comprehensively evaluating the summaries submitted thereby and adjust arrangement of leading fund of next year in accordance with evaluation results. After evaluating, the prominent competent industrial departments of Shanghai municipality and districts or counties shall have priority in arrangement of leading fund. If fail to meet the criterion, the competent industrial departments of Shanghai municipality and districts or counties shall be suspended the qualification to apply for leading fund in next year.

Leading fund shall be used exclusively for its designated purpose and shall not be withheld or misappropriated. Key supporting contents of leading fund shall not be changed. If any act in violation of national laws and regulations or disciplines arises, the relevant punishment shall be given for project units and relevant persons in charge, besides, the following treatments shall be made: recovering the allocated leading fund with a deadline, publishing and cancelling the qualifications of the legal persons of the projects and persons in charge of projects to continue to apply for projects, suspending qualifications of the competent industrial departments of Shanghai municipality and districts or counties on applying for leading fund in next year, etc.

       第七条  使用监督和评估管理

    市财政局对经评审小组审核同意的项目,按照财政资金预算管理的有关规定拨付资金。

    凡使用引导资金的市行业主管部门和区县有关部门,应加强监管,负责检查服务业发展规划的落实情况以及推进具体项目的实施、验收等日常管理工作。如发现重大问题,应及时向评审小组反馈。

    市发展改革委、市经济信息化委、市商务委、市财政局会同市审计局等部门按照有关规定对引导资金的使用情况和项目执行情况进行监督、审计和稽察。

    凡使用引导资金的市行业主管部门和区县有关部门,应及时总结服务业发展情况以及资金使用情况、项目执行情况,并将上年度引导资金使用报告在次年2月底前送交评审小组办公室。评审小组负责对市行业主管部门和区县的总结进行综合评估,并根据评审结果,调整下一年度引导资金的安排。经考核,对表现突出的市行业主管部门和区县,在下一年度优先安排引导资金;对未达标的市行业主管部门和区县,暂停其下一年度申请引导资金资格。

    引导资金必须专款专用,严禁截留、挪用。凡使用引导资金的项目,不得擅自改变主要建设内容和建设标准。引导资金重点扶持内容不得变动。对弄虚作假、截留、挪用等违反国家法律法规或有关纪律的行为,除按照国家规定对项目单位和有关负责人给予相关处罚外,还将作出以下处理:限期收回已拨付的引导资金;予以公示并取消项目法人和项目负责人继续申报项目的资格;暂停所在市行业主管部门或区县下一年度申请引导资金资格等。

  Article 8  Supplementary Provisions

These measures shall be interpreted by development and reform commission, economic informationization commission, commerce commission and financial bureau of Shanghai municipality.

These measures shall be effective from the date of issuance to the end of 2012. Trial Measures for Usage and Administration of Leading Fund for Service Industry Development of Shanghai Municipality (Hu Fu [2007] No.1) shall be abolished therefrom.

       第八条  附则

    本办法由市发展改革委会同市经济信息化委、市商务委、市财政局负责解释。

    本办法自印发之日起执行,执行至2012年底。《上海市服务业发展引导资金使用和管理试行办法》(沪府〔2007〕1号)即行废止。
