These procedures are formulated with a view to establishing and perfecting a population and family planning benefit-oriented policy system, mitigating the special difficulties of families practicing family planning and promoting the building of a harmonious socialist society, and in accordance with "The Decision of the Central Committee of Communist Party of China and the State Council on Enhancing the Population and Family Planning Work in an All-round Way and Making Overall Arrangement for Settling the Population Issue"(CCCPC G [2006] No. 22), the "Opinions of Shanghai Municipal Committee of Communist Party of China and Shanghai Municipal People's Government on Implementing 'The Decision of the Central Committee of Communist Party of China and the State Council on Enhancing the Population and Family Planning Work in an All-round Way and Making Overall Arrangement for Settling the Population Issue'" (SMCCPC G [2007] No. 6) and the "Notice of National Population and Family Planning Commission and the Ministry of Finance on Printing and Distributing the Pilot Scheme of the Support System for Families with a Single Child Who is Injured, Disabled or Dead"(NPFPC G [2007] No. 78).

    为了建立和完善人口和计划生育利益导向政策体系,缓解计划生育家庭的特殊困难,促进社会主义和谐社会建设,根据《中共中央国务院关于全面加强人口和计划生育工作统筹解决人口问题的决定》(中发〔2006〕22号)、《中共上海市委、上海市人民政府关于贯彻〈中共中央国务院关于全面加强人口和计划生育工作统筹解决人口问题的决定〉的意见》(沪委发〔2007〕6号)以及《国家人口计生委、财政部关于印发全国独生子女伤残死亡家庭扶助制度试点方案的通知》(国人口发〔2007〕78号),制定本办法。

I. Main Purposes

Since the implementation of the family planning policy, many families practicing family planning, especially those with a single child who is injured, disabled or dead, contribute a lot to the society, but these families are inevitably faced with actual difficulties in production, living and old age care, so a stable system guarantee is needed to provide them with material assistance and spiritual comfort, enabling them to preferentially share the fruits of the reform and development. The establishment and implementation of the special support system for families practicing family planning is the perfection and development of the population and family planning policy and the specific practice of all-round implementation of the important thought of Three Represents and the scientific viewpoint of development, further implementation of the spirit of the Seventeenth CPC National Congress and promotion of the building of a harmonious socialist society, which is conducive to orienting the population and family planning work to management by law and benefit, perfecting the social security system for families practicing family planning, and promoting the harmony of families, thereby providing a good population environment for bringing about development in a scientific way.

       一、主要目的

    实行计划生育以来,广大计划生育家庭特别是一些独生子女伤残死亡家庭,为社会作出了巨大贡献,这些家庭不可避免地面临着生产、生活和养老方面的实际困难,需要通过稳定的制度保障,为这些家庭提供物质上的救助、精神上的慰藉,使其更好地优先分享改革发展的成果。建立和实施计划生育家庭特别扶助制度,是人口和计划生育政策的完善和发展,是全面落实“三个代表”重要思想和科学发展观,深入贯彻十七大精神,促进社会主义和谐社会建设的具体实践,有利于促进人口计生工作向依法管理和利益导向转变,完善计划生育家庭社会保障制度,增进家庭和谐,为科学发展提供良好的人口环境。

II. Basic Contents

1. Objects of support 

A person with his/her household register in this Municipality that meets all of the following conditions may enjoy the special subsidy for families practicing family planning:

(1) The person is born after January 1, 1933 or is born before January 1, 1933 but holds an Honorary Certificate of Single-Child's Parents;  

(2) The wife of a couple is 49 years old or older or the person himself/herself is 49 years old or older;

(3) The person has only given birth to a single child or legally adopted a single child;

(4) The person has no child alive or has a child holding the Certificate of Disabled Person of the People's Republic of China (hereinafter referred to as Certificate of Disabled Person) with disability of Grade III or above (including disability of under low grade) ;

(5) The person does not give birth to another child or adopt another child.

2. Standard of support

(1) A person who does not give birth to or adopt another child after his/her single child's death may be granted a subsidy of RMB150 yuan per month by the district(county) government until the person's death.

(2) A person who does not give birth to or adopt another child after his/her single child is injured or disabled may be granted a subsidy of RMB120 yuan per month by the district (county) government until the person's death or the child's recovery.

(3) If an object of support is above 49 years old when these Procedures are implemented, his/her actual age is taken as the time of starting to grant the subsidy until the object dies or his/her child recovers.

3. The application and registration of objects of support

(1) The period between January 1st and March 31st of each year is the time of the application for and registration of special support qualification for families practicing family planning in the whole Municipality.

(2) A person meeting the conditions for the objects of special support for families practicing family planning as provided in these Procedures shall attend to relevant formalities within the provided time of application and registration and, if failing to do this within such time, he/she shall be deemed to spontaneously waive the qualification for support for that year. 

4. Materials needing to be provided by the objects of support

A person that applies for receiving the special subsidy for families practicing family planning shall provide the following basic materials:

(1) ID certificate;

(2) household register certificate;

(3) marital status certificate;

(4) a statement on the status of his/her existing child; and

(5) two recent certificate photos.

Relevant certifying documents need to be additionally provided in the following cases:

(1) A person born before January 1, 1933 needs to provide the Honorary Certificate of Single-Child's Parents.

(2) Where a person's child dies, the person needs to provide the death certificate issued by a medical institution or a public security organ above township level or by the villagers' (neighborhood) committee at the place where the person's household register is located.

(3) A person whose child is disabled shall provide a Certificate of Disabled Person.

(4) A person adopting a child shall provide the certificate of adoption.

(5) A person canceling the adoptive relationship with his/her adopted child shall provide the cancellation certificate of adoptive relationship.

(6) A divorced person shall provide the certificate of divorce. 

(7) A person whose spouse has died shall provide the death certificate issued by a medical institution or a public security organ above township level or the villagers' (neighborhood) committee at the place where the person's household register is located.

5. The confirmation principle of objects of support

(1) The confirmation of age. The confirmation of age is subject to the birth date on a person's ID card. The age of those who have never handled ID cards is subject to the birth date registered in their household registers.

(2) The confirmation of the acts of child birth and adoption. No provisions of relevant laws, rules and policies are violated at the time of child birth or adoption.

(3) The confirmation of the number of children. The number of children of a person indicates the number of children alive who are given birth or adopted by the person. Giving birth only to one child includes the situation where one or more than one child has been given birth in line with the provisions of laws, rules, regulations or provisions in policy documents but only one child is alive. 

(4) The confirmation of disability grade. The confirmation of disability grade is subject to the disability grade specified in the Certificate of Disabled Person. If no grade is specified therein, it is subject to the disability grade certificate issued by the district (county) disabled persons' federation.

6. The confirmation procedure of qualification for support

(1) The applicant shall submit an application form for support to the villagers' (neighborhood) committee at the place where the person's household register is located and provides prescribed materials (one set each of the original and the duplicate thereof).

(2) The villagers' (neighborhood) committee shall conduct a preliminary inspection and give deliberation opinions within 10 working days from the date of receiving the application form for support and all the prescribed materials.

(3) The villagers' (neighborhood) committee shall submit the deliberation opinions, all the application materials and the name list to the township (town) government or the sub-district office within 2 workings days after the expiry of the period of application and registration. 

(4) The township (town) government or sub-district office shall put forward their review opinions sand submit such opinions, all the application materials and the name list to the district (county) population and family planning commission within 10 working days from the date of receiving all the materials submitted by the villagers' (neighborhood) committee.

(5) The district (county) population and family planning commission shall, within 7 working days from the date of receiving all the materials submitted by the township (town) government or the sub-district office, put forward their checking opinions and distribute the preliminarily determined name list of rewarded objects to the township (town) government or the sub-district office, which shall put up bulletins to announce the name list. The bulletins shall include the names and the age of the objects of support, the category of support and the amount of subsidy. The announcement shall last a period of 10 days. Meanwhile, the district (county) population and family planning commission shall set up a reporting mailbox and announce a reporting telephone number.

(6) In case of no objection, the district (county) population and family planning commission shall, within 2 working days after the expiry of the announcement period, submit the confirmed result, the funds needed and the name list to the municipal population and family planning commission for record, and report them to the finance department at the same level, with a cope thereof sent to the township (town) government or the sub-district office. In case of any objection, the district (county) population and family planning commission shall reexamine the issue. 

(7) The district (county) population and family planning commission shall be responsible for issuing the Certificate of Granting the Special Subsidy for Families Practicing Family Planning (hereinafter referred to as the Certificate of Grant) to the confirmed objects of support; the township (town) government or the sub-district office shall be responsible for delivering the Certificate of Grant to the objects of support.

7. The annual verification of the qualification for support

The objects of special support for families practicing family planning that hold the Certificate of Grant shall attend to the formalities of verification at the local villagers' (neighborhood) committee with their own household registers within the time of application and registration prescribed for the following year and meanwhile submit their application forms for annual verification, ID certificates and the statement on the status of their existing children and whether there exists the a condition for terminating the qualification for enjoying the support.

After receiving all the prescribed materials, the villagers' (neighborhood) committee shall conduct verification level by level according to the confirmation procedure of qualification for support.

8. The cancellation of qualifications for support

A person entitled to the special support for families practicing family planning shall cease enjoying the subsidy in one of the following cases:

(1) The person is dead;

(2) The person's household register is moved out of this Municipality;

(3) The person permanently settles down outside mainland China;

(4) The person gives birth to a child or children or adopts a child or children.

(5) The person's single child has recovered.

Where an applicant is found to falsely claim or receive the subsidy by improper means such as deceiving, he/she shall be ordered to return it within a time limit and his/her qualification for support shall be cancelled.

       二、基本内容

    (一)扶助对象

    同时符合下列条件的本市户籍人员,可以享受计划生育家庭特别扶助金:

    1.1933年1月1日以后出生或者1933年1月1日以前出生但持有《独生子女父母光荣证》;

    2.女方年满49周岁的夫妻双方或者本人年满49周岁;

    3.依法只生育或者合法收养一个子女;

    4.现无存活子女或者子女持有《中华人民共和国残疾人证》(以下简称《残疾人证》),且残疾等级为三级以上(包括残疾等级为轻度以上);

    5.未再生育和未再收养子女。

    (二)扶助标准

    1.独生子女死亡后未再生育和未再收养子女的人员,由区(县)政府给予每人每月150元扶助金,直至亡故为止。

    2.独生子女伤残后未再生育和未再收养子女的人员,由区(县)政府给予每人每月120元扶助金,直至亡故或者子女康复为止。

    3.本办法实施时如果扶助对象已超过49周岁的,以实际年龄为发放起点,直至亡故或者子女康复为止。

    (三)扶助对象的申请与登记

    1.每年的1月1日至3月31日期间,为全市计划生育家庭特别扶助资格的申请登记时间。

    2.符合本办法规定的计划生育家庭特别扶助对象条件的人员,应当在规定的申请登记时间内办理相关手续,逾期视作主动放弃当年扶助资格。

    (四)扶助对象需要提供的材料

    申请领取计划生育家庭特别扶助金的人员,应当提供下列基本材料:

    1.身份证明;

    2.户籍证明;

    3.婚姻状况证明;

    4.已有子女状况声明;

    5.近期免冠一寸照片2张。

    属于下列情形的,还需要提供相关证明材料:

    1.1933年1月1日以前出生的,提供《独生子女父母光荣证》。

    2.子女死亡的,提供乡级以上医疗机构或者公安机关或者户口所在地村(居)民委员会出具的死亡证明。

    3.子女残疾的,提供《残疾人证》。

    4.收养子女的,提供收养证明。

    5.与养子女解除收养关系的,提供解除收养关系证明。

    6.离婚的,提供离婚证明。

    7.丧偶的,提供乡级以上医疗机构或者公安机关或者户口所在地村(居)民委员会出具的死亡证明。

    (五)扶助对象的确认原则

    1.年龄的确认。以本人身份证的出生时间为准。如果从未办理过身份证的,则以户口簿登记的出生时间为准。

    2.生育和收养行为的确认。生育和收养子女时没有违反相关的法律、法规和政策规定。

    3.子女数的确认。按本人生育或者收养且存活的子女数计算。只生育一个子女,包括符合法律、法规、规章或政策性文件规定曾生育过一个及以上子女但只存活一个子女的情况。

    4.残疾等级的确认。以《残疾人证》注明的残疾等级为准。如果《残疾人证》未注明等级的,以区(县)残联出具的残疾等级证明为准。

    (六)扶助资格的确认程序

    1.由申请人向本人户籍所在地的村(居)民委员会提交扶助申请表,并提供规定的材料(原件及复印件各一套)。

    2.村(居)民委员会应当自收到扶助申请表及规定的全部材料之日起10个工作日内进行初审,提出审议意见。

    3.在申请登记期过后2个工作日内,村(居)民委员会应当将审议意见、全部申请材料及名册报乡(镇)政府或者街道办事处。

    4.乡(镇)政府或者街道办事处应当自收到村(居)民委员会报送的全部材料之日起10个工作日内提出审核意见,并将审核意见、全部申请材料及名册报送区(县)人口计生委。

    5.区(县)人口计生委应当自收到乡(镇)政府或者街道办事处报送的全部材料之日起7个工作日内提出复核意见,将初步确定的奖励扶助对象名册发至乡(镇)政府或者街道办事处,张榜公示。公示内容包括扶助对象姓名、年龄、扶助类别、扶助金额,公示期限为10天。区(县)人口计生委应当同时设立举报信箱,公布举报电话。

    6.如无异议,区(县)人口计生委应当自公示期满后2个工作日内,将确认结果、所需资金情况及名册向市人口计生委备案,并报同级财政部门,抄送乡(镇)政府或者街道办事处;如有异议,区(县)人口计生委应当重新审核。

    7.区(县)人口计生委对确认后的扶助对象,负责发放《计划生育家庭特别扶助发放证》(以下简称《发放证》);乡(镇)政府或者街道办事处负责向扶助对象送达《发放证》。

    (七)扶助资格的年审

    持有《发放证》的计划生育家庭特别扶助对象,应当在下一年规定的申请登记时间内到本人户籍所在地的村(居)民委员会办理审验手续,同时提交扶助年审申请表、身份证明以及申请人已有子女状况和是否有终止享受扶助资格情形的声明。

    村(居)民委员会收到规定的全部材料后,按照扶助资格的确认程序,进行逐级审验。

    (八)扶助资格的注销

    享受计划生育家庭特别扶助的人员,有下列情况之一的,终止享受扶助金:

    1.死亡的;

    2.户口迁出本市的;

    3.在境外定居的;

    4.生育或者收养子女的;

    5.独生子女康复的。

    如发现申请人以欺骗等不正当手段冒领或者骗领扶助金的,责令限期退回,并注销其扶助资格。

III. The Time of Enforcement and Basic Principles

1. The time of enforcement

These Procedures have been enforced in the whole Municipality since 2007. 

2. Basic principles 

(1) Unifying policies and conducting strict control. All district (county) population and family planning commissions shall, according to the provisions of these Procedures, confirm the objects of special support for families practicing family planning and ensure the consistency of policies.

(2) Overt and transparent, fair and impartial. Ensure the fairness in policy implementation by such means as putting up bulletins for announcement, level-by-level reviewing, the masses' reporting and social supervision.

(3) Providing direct support for specific families and specific persons. Subsidy shall be directly granted through existing channels. Any unit or person is strictly prohibited from such rule-violating behavior as holding up, keeping, diverting or falsely reporting or claiming the subsidy.

(4) Perfecting the mechanism and making step-by-step improvement. Formulating the supporting policy and measures and establishing and perfecting the management, service and supervision mechanism for the implementation of the system of special support for families practicing family planning. 

(5) The government leads and the society participates. Combining the implementation of the system of special support for families practicing family planning with the launching of activities such as "Happiness Project" and "Child-Birth Care" to form a good social morality and custom for supporting the poor and helping the distressed.

       三、实施时间和基本原则

    (一)实施时间

    2007年起,在全市实施。

    (二)基本原则

    1.统一政策,严格控制。各区(县)人口计生委应当依据本办法的规定,确认计划生育家庭特别扶助对象,确保政策的一致性。

    2.公开透明,公平公正。通过张榜公布、逐级审核、群众举报、社会监督等措施,确保政策执行的公平性。

    3.直接扶助,到户到人。依托现有渠道直接发放扶助金。严禁任何单位或个人截留挪用、虚报冒领扶助金等违规行为。

    4.健全机制,逐步完善。制订配套政策和措施,建立健全计划生育家庭特别扶助制度实施工作的管理、服务和监督机制。

    5.政府主导,社会参与。把实施计划生育家庭特别扶助制度与开展“幸福工程”、“生育关怀”等活动结合起来,形成扶贫济困的良好社会风尚。

IV. The Source, Management and Distribution of Funds

1. The source of funds

Following the principle of "hierarchical management and hierarchical responsibility shouldering", the funds needed for the special support for families practicing family planning shall be brought into the annual departmental budget by the district (county) finance department for arrangement and the preparation, implementation and accounting thereof shall be normalized according to the requirements of the departmental budget management. 

2. The distribution of funds

The subsidy shall be calculated on a monthly basis by person, distributed once a year and directly paid from the State Treasury. All district (county) financial bureaus shall, according to the lists of objects of support provided by the district (county) population and family planning commissions, appropriate the subsidy directly into the personal accounts of the objects of support through designated financial agencies.

The funds needed for support shall be paid by the district (county) government at the place where the household register of the object of support is located. For a person who has transferred his/her household register, attended to the application and registration formalities and passed the annual verification before the transfer, the subsidy for that year shall be paid by the district (county) government which handles the application and registration formalities for him/her. The district (county) population and family planning commission shall write off in a timely manner a person that has ceased enjoying the subsidy and submit the name list of the written-off to the municipal population and family planning commission for record and the finance department at the same level, with a copy of such list sent to the township (town) government or the sub-district office.

The subsidy shall be distributed by financial agencies. The designated financial agencies shall, before the 31st of August every year, appropriate the subsidy for the current year directly into the personal accounts of the objects of support.

3. The management of funds

The municipal finance bureau shall be responsible for guiding district (county) finance bureaus in the distribution of funds for support and supervising and managing the use of this Municipality's funds for support. Each district (county) finance bureau shall be responsible for the budget, final settlement and supervision and management of the funds for support within its jurisdiction. The district (county) financial gross budget accountant shall set up a special account for the funds for support, list them in the item account of "awards for families practicing family planning", the fund account of "population and family planning affairs" and the category item of "general public service", appropriate the full funds for support within its jurisdiction to the financial agency in a timely manner, supervise the financial agency to appropriate the full funds into the personal accounts in a timely manner and reflect level by level the situation of budget, final settlement and distribution of funds for support through financial statements. The balance realized from the funds for support shall serve to offset the corresponding quota of funds for support for subsequent years.

The municipal population and family planning commission shall be responsible for guiding the district (county) population and family planning commission to do a good job of the application, registration, confirmation, announcement and supervision of objects of support and cooperating with the municipal finance bureau in doing well the drawing up of the budget and final account of the funds for support. District (county) population and family planning commissions shall provide the lists of objects of support to the finance bureaus at the same level, cooperate with the financial agencies to establish personal accounts for the objects of support, get to know about the situation of distribution and management of the funds for support in a timely manner.

Each district (county) population and family planning commission shall, jointly with the district (county) finance bureau, choose and determine the financial agency within the district (county). The financial agency shall be responsible for formulating the measures and operation procedure for the distribution of funds for support, and shall submit itself to the supervision and administration of the finance and the population and family planning departments; it shall establish personal accounts according to the requirements of the agreement on commissioning service and the name list of objects of support provided by the population and family planning department and transfer the full funds for support appropriated by the district (county) finance department into personal accounts in a timely manner; it shall also give timely feedback on personal accounts and fund appropriation to the finance and population and family planning departments.

       四、资金来源、管理和发放

    (一)资金来源

    按照“分级管理,分级负担”原则,本市计划生育家庭特别扶助所需资金,由区(县)财政纳入年度部门预算予以安排,按部门预算管理要求规范编制、执行和核算。

    (二)资金发放

    扶助金以个人为单位按月计算,一年发放一次,实行国库直接支付。各区(县)财政局根据区(县)人口计生委提供的扶助对象清单,通过指定的代理金融机构,将扶助金直接拨付到扶助对象的个人账户。

    扶助所需资金由扶助对象户籍所在地的区(县)政府负担。对于户口发生迁移的人员,在迁出前已经办理申请登记手续并通过年审的,当年的扶助金由为其办理申请登记手续的区(县)政府负担。对于终止享受扶助金的人员,区(县)人口计生委应当及时注销,并将注销名册报市人口计生委备案,同时报同级财政部门,抄送乡(镇)政府或者街道办事处。

    扶助金由代理金融机构发放。指定的代理金融机构应当于每年的8月31日前,将当年的扶助金直接拨付到扶助对象的个人账户。

    (三)资金管理

    市财政局负责指导区(县)财政局做好扶助资金的发放工作,并监督管理本市扶助资金的使用情况。各区(县)财政局负责本地区扶助资金的预算、决算和监督管理。扶助资金由区(县)财政总预算会计设立专账,列入“一般公共服务”类级科目、“人口与计划生育事务”款级科目、“计划生育家庭奖励”项级科目,并将本地区扶助资金及时足额拨付到代理金融机构,监督代理金融机构将扶助金及时足额拨付到个人账户,通过财政报表逐级反映扶助资金预算、决算和发放情况。扶助资金形成的结余,抵顶以后年度相应扶助资金额度。

    市人口计生委负责指导区(县)人口计生委做好扶助对象的申请、登记、确认、公示、监督工作,配合市财政局指导区(县)做好扶助资金的预算和决算编制工作。区(县)人口计生委要向同级财政局提供扶助对象的清单,配合代理金融机构建立扶助对象个人账户,及时掌握扶助资金发放情况,了解扶助资金管理情况。

    各区(县)人口计生委会同区(县)财政局选择和确定本区(县)的代理金融机构。代理金融机构负责制定扶助资金发放办法和操作规程,接受财政和人口计生部门的监督、管理;按照委托服务协议的要求和人口计生部门提供的扶助对象名单,建立个人账户,将区(县)财政部门拨付的扶助资金及时足额划转到个人账户;将个人账户和资金拨付情况及时反馈给财政和人口计生部门。

V. Organization, Management, Inspection, Supervision and Work Assessment

1. Organization and management

The municipal population and family planning commission, the municipal finance bureau and the municipal disabled persons' federation shall be jointly responsible for coordinating and guiding the implementation of the system of special support for families practicing family planning in the whole Municipality. The municipal population and family planning commission shall be responsible for confirming the qualification of objects for support, the municipal finance bureau for the fund management and the municipal disabled persons' federation for confirming the disability grades of objects for support. The population and family planning commission, the finance bureau and the disabled persons' federation of each district (county) shall be responsible for organizing and coordinating the specific implementation of the system of special support for families practicing family planning within its jurisdiction.

2. Assessment, inspection and supervision

(1) The municipal population and family planning commission, the municipal finance bureau and the municipal disabled persons' federation shall jointly conduct a comprehensive assessment on the implementation of the pilot system once a year and entrust social intermediary agencies to conduct the performance assessment on the fund use and management, and supervise the guarantee, management and distribution of the funds for support. 

(2) Establish a system of information management of the system of special support for families practicing family planning, conduct dynamic management, regularly collect and analyze data and reflect in a timely manner the guarantee of special funds.

(3) Implement the system of open government and mass reporting, and conduct social and media supervision over the implementation of the support system in multiple forms.

(4) Each district (county) shall organize the discipline inspection, supervision, auditing and other departments to inspect and supervise the confirmation of qualification for support, the fund management, the fund distribution, etc. and invite deputies to the People's Congress and members of the Chinese People's Political Consultative Conference to inspect and supervise the implementation of the system of support.

3. Work assessment

(1) The implementation of the system of special support for families practicing family planning shall be integrated into the assessed contents of the target management responsibility system of the local population and family planning work. The units and individuals that make outstanding achievements in the implementation work shall be commended and rewarded; the principal leaders and relevant department shall be prosecuted for their liability if serious problems occur in the implementation of the system, giving rise to bad social influence.

(2) The funds for support shall be earmarked for their specified purposes only and shall be specially managed. It is strictly prohibited to use such funds for profit-making investment or fundraising in any form or balancing deductions from other personal funds. Any unit or individual person once found to have falsely reported, falsely claimed, embezzled, grafted, misappropriated or occupied the funds for support shall be seriously investigated and handled; those who violate the criminal law shall be prosecuted for their criminal liability according to law.

(3) Where the financial agencies fail to perform the duty of fund distribution according to the agency service agreement by holding back, defaulting or deducting the funds for support, their qualifications for distribution agency shall be cancelled and they shall be prosecuted for their legal liability according to law.

       五、组织管理、检查监督与工作考核

    (一)组织管理

    市人口计生委、市财政局、市残联共同负责协调、指导全市计划生育家庭特别扶助制度的实施。市人口计生委负责扶助对象的资格确认,市财政局负责资金管理,市残联负责扶助对象残疾等级的确认。各区(县)人口计生委、财政局、残联负责组织、协调辖区内计划生育家庭特别扶助制度的具体实施。

    (二)评估与检查监督

    1.市人口计生委、市财政局、市残联每年共同进行一次制度试点工作的综合评估,并委托社会中介机构开展资金使用管理情况的绩效考评,对扶助资金的到位、管理和发放情况进行监督。

    2.建立计划生育家庭特别扶助制度信息管理系统,实行动态管理,定期进行数据的汇总分析,及时反映专项资金的落实情况。

    3.实行政务公开和群众举报制度,利用多种形式对扶助制度执行情况进行社会监督和舆论监督。

    4.各区(县)组织纪检、监察、审计等部门对扶助资格确认、资金管理、资金发放等情况进行检查监督;邀请人大代表、政协委员对扶助制度执行情况进行视察、监督。

    (三)工作考核

    1.将计划生育家庭特别扶助制度实施工作纳入当地人口和计划生育工作目标管理责任制考核内容。对在实施工作中做出突出成绩的单位和个人,给予表彰和奖励;对制度执行中出现重大问题、造成不良社会影响的,追究主要领导及相关部门的责任。

    2.扶助资金实行专款专用,专门管理。严禁用扶助资金进行任何形式的盈利性投资、融资活动,不得将扶助金抵扣其他个人款项。对虚报、冒领、克扣、贪污、挪用、挤占扶助资金的单位和个人,一经发现,严肃查处;触犯刑律的,依法追究刑事责任。

    3.对资金代理金融机构不按照代理服务协议履行资金发放责任,截留、拖欠、抵扣扶助资金的,取消其代理发放资格,并依法追究其法律责任。

VI. Specific Requirements

1. Enhancing leadership, strengthening responsibility and implementing in real earnest the system of special support for families practicing family planning. The implementation of the system of special support for families practicing family planning has a direct bearing on the immediate interests of the broad masses, the implementation of the basic State policy of family planning policy and the harmony and progress of the society. All districts (counties) shall enhance in real earnest the leadership to ensure the implementation of the system of special support for families practicing family planning. Relevant departments shall perform their respective functions, `establish a regular communication and coordination system, study and solve the problems arising in work in a timely manner and earnestly do a good job of the implementation of the system.

2. Establishing and perfecting the operation mechanism of "four-power separation" of qualification confirmation, fund management, fund distribution and supervision & assessment, ensuring the fairness and impartiality in policy implementation, the safety of special funds and the direct distribution of funds for support to specific families and persons.

3. Perfecting the population and family planning benefit-oriented policy. The system of special support for families practicing family planning shall be closely combined with the reward and support system for certain rural families practicing family planning and the work of "Showing Loving Care for Girls", "Child-Birth Care" and "Happiness Project" to give full play to the comprehensive effect of various polices, thus gradually forming a perfect system of population and family planning benefit-oriented policy.

4. Doing a good job of the linkage of the system of special support for families practicing family planning with the reward and support system for certain rural families practicing family planning and the system of lump sum support for families with the single child injured, disabled or dead. For those who have agricultural household registers and meet the basic conditions of the system of special support for families practicing family planning, the reward and support system for certain families practicing family planning shall not be implemented again.

5. Intensifying the publicity and safeguarding the masses' right to know and right to supervise, and ensuring the transparency in policy implementation. Governments at all levels and social organizations shall, through multiple forms, help the families practicing family planning under special support. For those who meet the conditions for second childbirth, the population and family planning departments at various levels shall actively conduct consultation and guidance on reproductive health and provide various service items for second childbirth in a timely manner.

The municipal population and family planning commission, the municipal finance bureau and the municipal disabled persons' federation shall be jointly responsible for the interpretation of these Procedures in their specific application.

       六、具体要求

    (一)加强领导,强化责任,切实把计划生育家庭特别扶助制度落到实处。实施计划生育家庭特别扶助制度,直接关系到广大群众的切身利益,关系到计划生育基本国策的落实,关系到社会的和谐进步。各区(县)要切实加强领导,确保将计划生育家庭特别扶助制度落到实处。有关部门要各司其职,建立经常性沟通协调机制,及时研究解决工作中出现的问题,切实做好制度实施工作。

    (二)建立和完善资格确认、资金管理、资金发放与监督评估“四权分离”的运行机制,确保政策执行的公平公正,确保专项资金安全,确保扶助金落实到户到人。

    (三)完善人口和计划生育利益导向政策。要把实施计划生育家庭特别扶助制度与农村部分计划生育家庭奖励扶助制度、“关爱女孩”、“生育关怀”、“幸福工程”等工作紧密结合起来,充分发挥各项政策的综合效应,逐步形成完善的人口和计划生育利益导向政策体系。

    (四)搞好计划生育家庭特别扶助制度与农村部分计划生育家庭奖励扶助制度、独生子女伤残死亡一次性补助制度的衔接。对符合计划生育家庭特别扶助制度基本条件的农业户籍人员,不再重复执行农村部分计划生育家庭奖励扶助制度。

    (五)加大宣传力度,保障群众知情权和监督权,保证政策执行的透明度。对计划生育特别扶助家庭,各级政府和社会组织应通过多种形式给予帮助。对符合再生育条件的,各级人口计生部门要积极开展生殖健康咨询和指导,及时提供再生育的各项服务。

    本办法的具体应用问题,由市人口计生委会同市财政局、市残联负责解释。
