1. 终止。

Determination的这一层含义在翻译法律文件时常常容易被忽略。在很多情况下，当将determination译为“确定、决定”并不合适时，不妨考虑一下其“终止”这一含义，在这一情况下，determination相当于termination。元照英美法词典及Black Law Dictionary均有提及这一层含义：

Black Law Dictionary

The ending or expiration of an estate or interest in property, or of a right, power, or authority <the easement's determination after four years>.

如：

Once the Contract has entered into a sub-contract with a Named Sub-Contractor, the Contractor shall not determine or assign that sub-contract without the agreement in writing of the Employer, which consent shall not be unreasonably withheld. Where the Employer has agreed in writing to the termination of the Sub-Contract, the Employer shall as soon as reasonably practicable either name a replacement sub-contractor or direct the Contractor to complete the work or supply in question, with his own resources or by a sub-contractor of his own choice approved in Writing by the Employer.

一旦承包人与指定分包人签订分包合同，未经业主书面同意，承包人不得终止或转让该分包合同，但业主不得无理拒绝给予同意。如果业主书面同意分包合同的终止，业主应在合理可行的情况下尽快指定替代分包人，或指示承包人使用自有资源或自己选择且经业主书面批准的分包人完成相关工程或供应服务。

2. (法院的)裁判；判决

这一意思比较常见，多用于诉讼仲裁中。如：

If the witness claims privilege from disclosure of evidence on grounds of public interest immunity, the procedure as set out in the Council's resolution concerning the usage and practice in regard to the determination of claims of public interest privilege in Appendix I will be followed.

如证人引用“基于公众利益而获豁免”的理由，要求享有可获豁免作供或披露证据的特权，则须依循附录I的立法会决议所载的程序；该决议的内容关乎就“基于公众利益而享有特权”的要求作出裁定的常习及惯例。
