法律文件中request和require的区别及用法

requestrequire在法律文件中,均可用来表示“要求”,但是表示“请求”,常用“request”。对于requestrequire,在《元照英美法词典》中分别给出了如下的释义:

 

request 请求,要求

尤指请求债务的偿付或合同的履行。有时与「command」同义,如具有权威的人提出「要求」,只是一种婉转说法,实质上是以一种平和的方式下达的「命令」。

 

require 需要;要求;命令

该词源于拉丁文「requiro」,意指求取。该词虽然无疑有「需要」的含义,但这并非是它的主要或一般性含义。一般认为,该词最重要的义项应为「依权利要求」、「依授权命令」。

 

简单来说,request sb to do sth) 是请求(某人做某事),是下对上的要求;Require 表示order, demand, 命令,要求之意,指上对下的要求,比如法律条款对当事人的要求,业主对雇员的要求。

 

 

During the Relevant Period (except when the Register is closed), any Shareholder may inspect during business hours any Register maintained in Hong Kong without charge and require the provision to him of copies or extracts thereof in all respects as if the Company were incorporated under and were subject to the Companies Ordinance.

倘任何股东交出代表其所持股份之一张股票予以注销,并要求本公司按该股东可能指定之有关比例另发两张或以上代表该等股份之股票替代,则董事会可于就首张股票以外每张股票支付董事会不时厘定的有关费用(倘为任何于香港证 券交易所上市的股本,则该费用不得超过有关证券交易所不时规定或准许的最高金额,而倘为任何其他股本,则为董事会就有关股东名册所在地区而言属合理而可能不时厘定的以有关货币计值的有关款项,或否则于各情况下董事会可能不时厘定的有关其他款项)后酌情遵照有关要求。

 

If the lessee, members of his/her family or other persons, who live together with them, systematically destroy or damage the living spaces, or do not use them according to its purpose, or if by systematically breaching the common living rules make it impossible for others to live with them in the same apartment or in the same house, and the preventive and public constraint measures have not showed any progress, the evacuation of the guilty ones at the request of the leaser or other interested parties is made without a subsequent offer of another living space.

如果承租人、与其共同居住的家庭成员或其他人故意破坏或拆毁租住的房屋,或改变其既定的用途或故意违反共同居住原则,使得其他人无法与他们合住,而且相应的预防措施和公共约束手段都未产生任何效果,应出租人和其他利益相关方的请求,可以迫使从事上述破坏或违规甚至犯罪行为的住户搬走,而且不提供其他住所。
