To the high people's courts of each province, autonomous region, and municipality directly under the Central Government, PLA Military Court, and High People's Court of Xinjiang Uygur Autonomous Region Production and Construction Corps Branch:

The Tort Liability Law of the People's Republic of China (hereinafter referred to as the "Tort Liability Law") has become effective on July 1, 2010. To ensure a correct application of the Tort Liability Law, we hereby announce the relevant issues as follows:

   各省、自治区、直辖市高级人民法院,解放军军事法院,新疆维吾尔自治区高级人民法院生产建设兵团分院:

   《中华人民共和国侵权责任法》(以下简称侵权责任法),自2010年7月1日起施行。为了正确适用侵权责任法,现就有关问题通知如下:

1. With regard to civil dispute cases caused by acts of tort that occur after the implementation of the Tort Liability Law, the provisions of the Tort Liability Law shall apply. With regard to civil dispute cases caused by acts of tort that occurred before the implementation of the Tort Liability Law, the then-prevailing legal provisions shall apply.

    一、侵权责任法施行后发生的侵权行为引起的民事纠纷案件,适用侵权责任法的规定。侵权责任法施行前发生的侵权行为引起的民事纠纷案件,适用当时的法律规定。

2. The Tort Liability Law shall apply to civil dispute cases wherein a tort occurred before the implementation of the Tort Liability Law, but the damaging results arose after the implementation of the Tort Liability Law.

    二、侵权行为发生在侵权责任法施行前,但损害后果出现在侵权责任法施行后的民事纠纷案件,适用侵权责任法的规定。

3. When a people's court applies the Tort Liability Law to try a civil dispute case and decides to conduct medical damage appraisals upon an application of the party concerned or according to its duties and powers, it shall organize the appraisal in accordance with the Decision of the Standing Committee of the National People's Congress on Questions Concerning the Regulation of Expert Evaluation, the Provisions on the Administration of External Expert Appraisal Entrusted by People's Courts, and the provisions of relevant departments of the State.

    三、人民法院适用侵权责任法审理民事纠纷案件,根据当事人的申请或者依职权决定进行医疗损害鉴定的,按照《全国人民代表大会常务委员会关于司法鉴定管理问题的决定》、《人民法院对外委托司法鉴定管理规定》及国家有关部门的规定组织鉴定。

4. When a people's court applies the Tort Liability Law to try civil dispute cases, if the victim has dependents, it shall, according to Article 28 of the Interpretation of the Supreme People's Court on Certain Issues Concerning the Application of Law in Trying Cases Involving Compensation for Personal Damage, include the living expenses of the dependents thereof into the disability compensation or death compensation.

    四、人民法院适用侵权责任法审理民事纠纷案件，如受害人有被抚养人的，应当依据《最高人民法院关于审理人身损害赔偿案件适用法律若干问题的解释》第二十八条的规定，将被抚养人生活费计入残疾赔偿金或死亡赔偿金。

The people's courts at all levels shall report other major issues encountered during their application of the Tort Liability Law to us through a level-by-level procedure in a timely manner.

   各级人民法院在适用侵权责任法过程中遇到的其他重大问题，请及时层报我院。
