Manslaughter英美法系刑法中杀人罪的一种，翻译为“非预谋性杀人罪”，非预谋性杀人罪，是指非出于恶意或预谋地非法杀害他人的行为。

在普通法和现代制定法中，一般将非预谋性杀人罪分为自愿的非预谋性杀人罪和非自愿的非预谋性杀人罪两种：

自愿的非预谋性杀人罪（voluntary manslaughter），是指虽未有杀人的预谋，但杀人行为仍出于行为人本身的意愿，且这种行为附有减轻情节的杀人罪。除激情杀人之外，现代法律的趋向是将其他的一些故意杀人行为也归为自愿地非预谋性杀人罪，主要是进行自卫、防卫他人时，预防犯罪、紧急避险或抵抗他人胁迫的过程中，不合理造成他人死亡的行为。

非自愿的非预谋性杀人罪（involuntary manslaughter），是指杀人的行为或结果并非出于行为人的故意，更非具有杀人预谋的杀人行为。这类杀人罪可以又分为二种独立的类型：一是犯罪性疏忽的非预谋性杀人罪，即在进行合法行为的过程中没有适当的谨慎或小心而造成的非法杀人。二是非法行为的非预谋性杀人罪，即在进行或企图进行不包括重罪或造成他人身体严重伤害的其他非法行为过程，超出本意地造成他人死亡的行为。

Murder（谋杀罪）是Manslaughter的对称，是指有恶意预谋地非法杀害他人生命的行为。谋杀罪的主要特征是：行为人实施了杀害他人生命的行为。谋杀罪的表现形式，可以是积极作为的形式，也可以是消极不作为的形式。
