非法拘禁罪，crime of false imprisonment，是指故意非法拘禁他人或者以其他方法非法剥夺他人人身自由的行为。本罪的法益是人的身体活动的自由。非法拘禁罪不是危险犯（potential damage offense），而是实害犯（actual damage offense）。现实的自由主要包括身体的场所移动自由，从一定场所离开的自由以及在场所内的身体活动自由。

A person who unlawfully detains another person or unlawfully deprives him of personal freedom by other means shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or deprivation of political rights. If the circumstances of hitting or insulting another person exist, a heavier sentence shall be imposed.

犯前款罪，致人重伤的，处三年以上十年以下有期徒刑；致人死亡的，处十年以上有期徒刑。使用暴力致人伤残、死亡的，依照本法第二百三十四条、第二百三十二条的规定定罪处罚。

为索取债务非法扣押、拘禁他人的，依照前两款的规定处罚。

A person who, for the purpose of extorting the payment of debts, unlawfully distrains or detains another person shall be punished in accordance with the provisions of the preceding two paragraphs.

国家机关工作人员利用职权犯前三款罪的，依照前三款的规定从重处罚。

A public servant of a state organ who takes advantage of his post and commits a crime under the preceeding three paragraphs shall be sentenced heavily in accordance with the provisions of the preceeding three paragraphs.
