著作权，是指自然人、法人或者其他组织对文学、艺术和科学作品享有的财产权利和精神权利的总称。在我国，著作权即指版权。广义的著作权还包括邻接权，我国《著作权法》称之为“与著作权有关的权利”。

著作权的主体（著作权人）是指依照著作权法，对文学、艺术和科学作品享有著作权的自然人、法人或者其他组织。

著作权的客体是作品，是指文学、艺术和科学领域内具有独创性并能以一定形式表现的智力成果。

受著作权法保护的作品必须具备的要件：

(一)独创性，也叫原创性，是首要条件。指由作者独立构思而成的，作品的内容或表现形式完全或基本不同于他人已经发表的作品，即不是抄袭、剽窃、篡改他人的作品；

(二)可复制性，是能以某种物质复制形式表现的智力创作成果。复制形式包括印刷、绘画、摄影、录制等。这里不排除对未被有形载体固定的口头作品的保护；

(三)著作权作品是作者的思想表现形式，即单纯的思想或情感本身而不具有文学、艺术等客观表现形式的，不能成为著作权客体。

著作权不予保护的对象：

我国《著作权法》明确规定了不予保护的对象。本法不适用于：

（一）法律、法规，国家机关的决议、决定、命令和其他具有立法、行政、司法性质的文件，及其官方正式译文；

（二）单纯事实消息；

（三）历法、通用数表、通用表格和公式。

此外，创意、题材、操作方法、技术方案、实用功能等属于思想层面的，不构成作品，不受著作权法的保护。
