刑事拘留（Criminal detention）：在是公安机关、人民检察院对直接受理的案件，在侦查过程中，遇到法定的紧急情况时，对于现行犯或者重大嫌疑分子所采取的临时剥夺其人身自由的强制方法。刑事拘留是一种强制措施而非刑事处罚手段。

行政拘留（Administrative detention）：是公安机关依法对违反行政管理秩序的公民采取限制其人身自由的惩罚措施。依据《民事诉讼法》、《刑事诉讼法》、《行政诉讼法》，最长期限为十五日。

司法拘留（Judicial detention/custody）：人民法院对妨害民事诉讼、行政诉讼、刑事诉讼情节严重的人，在一定期间内限制其人身自由的一种强制措施。

（一）警告、通报批评；

（四）犯罪后企图自杀、逃跑或者在逃的；

（五）有毁灭、伪造证据或者串供可能的；

（六）不讲真实姓名、住址，身份不明的；

（七）有流窜作案、多次作案、结伙作案重大嫌疑的。
