第二十六条　父母对未成年子女负有抚养、教育和保护的义务。

成年子女对父母负有赡养、扶助和保护的义务。

第二十七条　父母是未成年子女的监护人。

      未成年人的父母已经死亡或者没有监护能力的，由下列有监护能力的人按顺序担任监护人：

      （一）祖父母、外祖父母；

      （二）兄、姐；

      （三）其他愿意担任监护人的个人或者组织，但是须经未成年人住所地的居民委员会、村民委员会或者民政部门同意。

Article 26 Parents have the obligation to raise, educate, and protect their minor children. Adult children have the obligation to support, help, and protect their parents.

Article 27 The parents of a minor are his guardians.

Where the parents of a minor are deceased or incompetent,  from the following category and in the following order, a person who is competent to be a guardian shall be appointed as guardian:

          1.paternal or maternal grandparents

          2.older brothers or sisters; or

          3.other individuals or organizations who are willing to act as a guardian,  provided that consent must be obtained from the neighborhood committee, village committee, or the department of civil affairs in the place of such    minor’s domicile. 

此部分要点有三：①抚养与赡养②祖父母、外祖父母③民政部门。

1.“抚养与赡养”。两者分别译为raise和support无异议，有译本翻译为maintain和assist，由于偏离愿意，不妥。

2.“祖父母、外祖父母”。翻译为paternal or maternal grandparents或者grandparents（paternal or maternal）为各国法律通用表达，无争议。但切记，不可用单数。.

Paternal意思Relating to or characteristic of a father or fatherhood; fatherly.  Maternal意思为relating  to or derived from one's mother.

Grandparent意为a parent of  your father or mother

3.“民政部门”。the department of civil affairs使用的是叠词，表达准确，符合法律英语风格。Legitimate，lawful，legal未见差异。

另外,“成年子女”译为adult children不妥,major children更合语体。neighborhood  committee翻译为residents’  committee也很常见，但是要遵循“译名同一律”。
