“Provided”在英文合同中常见的意思有两种:
一、作动词,表示“规定”。to state that sth will or must happen
If the seller fails to perform any of his obligations under the contract or this Convention,the buyer may:
(a) exercise the rights provided in articles 46 to 52;
(b)claim damages as provided in articles 74 to 77.
第45条(1)如果卖方不履行他在合同和本公约中的任何义务,买方可以:
(a) 行使第46条至第52条所规定的权利
(b) 按照第74条至第77条的规定,要求损害赔偿。
二、作连词,表示“如果;前提是”,常用来表示一种前提条件:
If one party's failure to perform any of his obligations in respect of any installment gives the other party good grounds to conclude that a fundamental breach of contract will occur with respect to future installments,he may declare the contract avoided for the future, that he does so within a reasonable time.
如果一方当事人不履行对任何一批货物的义务,使另一方当 事人有充分理由断定对今后各批货物将会发生根本违约,该另一方当事人可 以在一段合理时间内宣告合同向后无效。 前提条件就是要求“在合理的时间 内"。
A party who is bound to take steps to preserve the goods may deposit them in a warehouse of a third person at the expense of the other party provided that the expense incurred is not unreasonable.
有义务采取措施以保全货物的一方当事人,可以把货物寄放在第三方的仓库,由另一方当事人担负费用,但该项费用必须合理。前提条件是“费用合理”。
