Duty of care,

A duty of care is the legal responsibility of a person or organization to avoid any behaviors or omissions that could reasonably be foreseen to cause harm to others.

“For example, a duty of care is owed by an accountant in correctly preparing a customer’s tax returns, to minimize the chance of an IRS audit. Similarly, manufacturers owe a duty of care to consumers in making sure that their products are safe for public use.” (legaldictionary.net/duty-of-care/)

At the practical level, however, we consider that whether or not it may be said that bankers owe any contractual, fiduciary or general duty of care to their clients in this particular matter, it would be prudent banking practice for bankers to advise their corporate account holders that, as the law stands at the moment, it will only be the use of words indicating that the signatory signs for or on behalf of a principal or in a representative character which will be certain to avoid the personal liability to the payee of the authorized signatory on a dishonoured company cheque.

The lessons accumulated, by those who witnessed or survived the successive massacres and atrocities of the last hundred years, and those who study and think seriously about them today, cannot but lead to this humanist acknowledgement: in the roots of those juridical institutions (mandates, trusteeship, international administration of territories) we detect the belated consciousness of the duty of care for the human kind.
