法律专业词语是法律专业性文本构建的基本要素，包括一般法律词语和法律专业术语。一般法律词语指法律文本的本族语读者基本能结合法律语境从字面上解读并能按照词语所表达的意思行事的语言单位。这类词语在任何法律语言中都占主要成分，体现了法律作为“天下之程式的”宗旨。但正是这类词语会给跨语言的读者和翻译者造成不少障碍，如“shall”、“without prejudice to”、“pursuant to”以及“code”、“right”、“case”、“report”等一般法律词语，即使在法律语境中的含义也是多面向的。从专业的角度看，法律汉语分别应为“应当”、“得”、“在不影响⋯⋯的原则下”、“依照”、“法典”、“权利”、“案件”、“法律汇编”。法律汉语中的法律专业词语相对更加模糊，如“过错”、“杀人”、“告诉”、“故意”、“法”、“人”、“行为”，专业英语应为‘‘negligence"、“murder”、‘‘accuse”、“intent"、‘‘law"、“person”、“conduct”。需要说明的是，上述每一个英汉词语都不止一个对应的专业翻译，每一个词语在不同的法律语境中还有若干个表达式。即使同一个词在同一个法律语境中，不同译者也会有不同的理解和表达。下面分别节选英汉两个法条例句，及其对应的两种译文，比较英汉法律原文例句及其译本对同一个词语的不同翻译。

译文2：为此目的，技术法规除为实现正当目标所必须的条款外，不得有额外限制贸易的条款。考虑到正当目标未能实现可能导致的后果，技术法规应包括为实现正当目标所必须的条款。这里所说的正当目标是指国家安全要求；防止欺诈行为；保护人身健康或安全；保护动物、植物的生命或健康；保护环境。在评估未能实现上述正当目标所导致的风险时，尤其需要考虑到的因素有：现有的科学和技术信息，有关的加工技术或产品的预期最终用途。(四川经贸委译本，2004年)

法律汉语：县级以上地方人民政府统一负责、领导、组织、协调本行政区域的食品安全监督管理工作，建立健全食品安全全程监督管理的工作机制；统一领导、指挥食品安全突发事件应对工作；完善、落实食品安全监督管理责任制，对食品安全监督管理部门进行评议、考核。(《食品安全法》第5条)
