Declaratory judgment:a judgment of the court that explains what the existing law is or expresses the opinion of the court as to the rights and status of the parties, but which does not award relief or provide enforcement.
一种由原告请求法院确认其与被告之间是否存在某种法律关系的诉讼。通常起因于双方当事人对于法律关系之认识不一致,因此发生争议而至无法解决,此时便要求法院予以认定,以确定双方存在或不存在某种法律关系;这类诉讼并不要求被告履行一定的民事义务,一旦法院作出判决,消除当事人之间争议后,此案即告结束。
是指英美国家司法审査上一种私法救济手段,法院发出的不包含强制执行措施,只是宣告某种权利义务关系存在的判决。必须和一定的法律权利相联系。并赋予原告一定的利益,法院不能仅回答一些疑虑。最初由衡平法发展起来,后来由议会制定法在埋没状态中复活。
