Joint Tenancy

The term "joint tenancy" refers to a legal arrangement in which two or more people own a property together, each with equal rights and obligations. Joint tenancies can be created by married and non-married couples, friends, relatives, and business associates. This legal relationship creates what is known as a right of survivorship so if one owner dies, their interest in the property is directly passed on to the surviving party(s) without having to go through probate or court system.

共同共有是指二人以上共同享有某一财产,拥有平等的权利和义务,可由已婚夫妻和未婚夫妻、朋友、亲人和生意伙伴创建。这种法律关系创设了生存者取得权,即某一财产共有人死亡,其作为共有人的权益会直接由其他共同共有人享有,无需通过遗嘱验证或法院系统。

 

In order to create a joint tenancy with rights of survivorship, the prospective tenants need to declare their joint tenancy on the title document or deed of the property that they are sharing. When listing their names on the title, they would also indicate that they are holding the property "as joint tenants with right of survivorship." In order to establish a joint tenancy, each tenant must have an equal share, equal rights to the property, and acquire ownership at the same time and title.

You can usually sever a joint tenancy unilaterally, without the knowledge or permission of the other tenants. The simplest way to do that is by selling your interest in a property to someone else, who then becomes a tenant in common with the other joint tenants.

Tenancy by the Entirety

Tenancy by the entirety is a type of property ownership that only applies to married couples. The couple is treated as a single legal entity and mutually co-owns the property. The consent of each is needed to sell or develop it. A tenancy by the entirety also creates a right of survivorship—when one spouse dies the surviving spouse gains full ownership of the property.

A tenancy by the entirety is similar to a joint tenancy, where a property is co-owned by two or more people. In both types of tenancy, there is a right of survivorship: Upon the death of one owner, their share is automatically passed on to the other tenant, rather than being probated with their estate.

However, there are some differences. While tenants in the entirety are usually required to be a married couple, joint tenants can have any type of relationship: siblings, business partners, or even friends. Moreover, while a tenancy by the entirety can only be terminated by mutual agreement (or the death of a spouse), a joint tenancy can unilaterally be ended by any one of the tenants: All they need to do is sell or transfer their share to another person, who then becomes a tenant in common.

Tenancy in Common

Tenancy in Common (TIC) is a legal arrangement in which two or more parties share ownership rights in a real estate property or parcel of land. Each independent owner may control an equal or different percentage of the total property, whether commercial or residential. The parties are known as tenants in common. A TIC has no right of survivorship and when a tenant in common dies, their share of the property passes to their estate, where a beneficiary of the share of property may be named.

普通共有是指二人以上对某一房地产或宗地共同享有所有权。每个独立的共有人可对该地产(商业或住宅)享有同等或不同份额,被称作普通共有人。普通共有不享有生存者取得权,也就是说,若某一普通共有人死亡,其享有的财产份额会归入其遗产,由遗嘱受益人继承。

 

One or more tenants can buy out other members to dissolve the Tenancy in Common in a joint agreement. In cases where an understanding cannot be reached, a partition action may take place that may be voluntary or court-ordered.
