“action”在这里的确是诉讼的意思（指为实现个人权利、阻止个人非法行为或惩罚犯罪等而在法院进行的一种程序。在今天，action可以指各种诉讼，但更多的被用来指民事诉讼。）

但这里的“real”并不是真正的意思，而指的是物权或不动产的意思。

“real action”有两层含义：

(1)物权诉讼(罗马法)

(2)返还土地之诉；不动产权益诉讼(英格兰古法)

普通法中自由土地保有人〔freeholder〕为回复其土地或某种土地权益而进行的诉讼。它包括：１由权利令状〔writ of right〕开始的决定土地产权〔title to land〕的土地权利诉讼；２由大陪审团解决侵占〔disseisin〕问题而进行的土地占有诉讼；３由进占令〔writ of entry〕开始的土地占有诉讼。后来这些诉讼为驱逐之诉〔ejectment〕所取代。1875年之后，这些诉讼格式均被取消，统一为一般的诉讼。

A real action means an action brought for the recovery of land or real property.

In Civil law it refers to an action brought for protecting a real right, namely, the right of ownership and its dismemberments. Under Louisiana law it refers to an action brought for the protection of possession, ownership or other real rights in immovable property. It is an action to determine ownership or possession.

诉讼种类一共分为三种，“real action”是其中的一种，其他两种分别是对人诉讼〔personal action：是基于合同或侵权而针对特定个人提起的诉讼，其目的在于要求被告履行合同债务或是针对所造成的损害进行赔偿。〕和混合诉讼〔mixed action：在某种程度上包括对物诉讼与对人诉讼性质的内容，不宜简单地归纳为某一种诉讼，如同时要求恢复所有权和损害赔偿。〕
