court of Cassation来源法语术语cour de cassation，即最高法院或撤销法院，<法>法国民事、刑事最高上诉法院。成立于1790年，原名为撤销法庭〔tribunal de cassation〕，1802年拿破仑将其改名为撤销法院〔cour de cassation〕,实质上是最高法院。该法院有权撤销〔quash; casser〕下级法院的判决，其主要职能是保证法国法院系统内法律解释的一致性。它既不审查案件事实，也不受理对案件事实的上诉，也没有对立法合宪性的司法审查权，而只从是否正确适用法律这一角度来作出裁判。该法院由六个法庭〔chamber〕组成，一个刑事庭，五个民事庭，法庭对案件既不重新审理，也不接受上诉，只是听审有关法律适用问题的争端。最高法院可维持原判也可撤销该判决，在撤销之后应将该案移交原审法院的同级其它法院审理，再审法院可以不服从最高法院的意见而作出与被撤销的原判一致的判决，这时此案又交回最高法院，由其组成特别合议庭审理。如合议庭仍维持最高法院原来撤销原判的意见，该案再移交给与原审法院同级的第三个法院审理，该第三法院应遵从最高法院的意见。
