请问“personal appearance in court”与“enter an appearance personally”是否都表示“亲自出庭”?

根据Black’s Law Dictionary 9th Ed,“appearance”的解释如下:

“A coming into court as a party or interested person, or as a lawyer on behalf of a party or interested person; esp., a defendant’s act of taking part in a lawsuit, whether by formally participating in it or by an answer, demurrer, or motion, or by taking postjudgment steps in the lawsuit in either the trial court or an appellate court.”

 

《元照英美法词典》给出了对应的中文解释:

第一种含义是“出庭”,指作为诉讼的一方当事人或作为一方当事人的律师或代理人出席法庭;第二种含义是“应诉”,指被告人同意接受法院管辖:以出庭、提交书面答辩等方式使自己参加诉讼,成为一方当事人。”

 

基于以下内容,本人认为“appearance”在“personal appearance in court”中表示“出庭”,而在“enter an appearance personally”中表示“应诉”:

 

“Entering an appearance is a very important step as it indicates that the defendant intends to defend the proceedings. When the defendant receives the summons, they must enter an appearance to show that they are now a party to the case.

A defendant shall enter his appearance to an originating summons by delivering to the proper officer a memorandum in writing dated on the day of its delivery and containing the name of the defendant’s solicitor, or stating that the defendant defends in person. He shall at the same time deliver to the officer a duplicate of the memorandum which the officer shall mark with an official stamp, showing the date on which the appearance is entered and then return it to the person entering the appearance, and the duplicate memorandum so marked shall be a certificate that the appearance was entered on the day indicated by the official stamp.”

 

从上述描述可以看出,“enter an appearance”是被告在收到传票后表明其成为一方当事人的一种程序。比如,被告在收到原讼传票后,需向有关机构提交应诉通知书,其中载明被告律师姓名或指明被告亲自应诉。

 

因此,本人认为在遇到“appearance in court”和“enter an appearance”时,不应统称为“出庭”,应有所区分。
