Onerous即使在普通英语中也常用作正式场合,表示needing great effort; causing trouble or worry 费力的;艰巨的;令人焦虑的。
Onerous在法律英语中主要有三层含义:
(1)过度繁重的;引起困难的
(2)负有的责任或义务超过所得利益的
(3)具有相当对价的;有偿的

onerous gift,表示“附义务的赠与”,指对受赠人设定某种负担或条件的赠与。
onerous cause,表示“有相当价值的约因”
onerous contract,表示“有偿合同;有对价的合同”,是指该合同的双方都负有履行各自承诺的义务。
onerous title,表示“有偿取得的产权;婚后劳动所得的产权”,其中“有偿取得的产权”指以给付金钱或提供劳务等有价值的对价,履行该财产负有的负担或条件而取得的产权;“婚后劳动所得的产权”指在婚姻存续期间,由配偶一方通过自己的技能或劳动而取得的财产权利,与受赠或继承所得的财产相对。它一般被视为夫妻共同财产。
