“At the beginning of a collection call, a debt collector must recite wording that has come to be called the ‘mini-Miranda’ disclosure. It informs the consumer that the call is from a debt collector, that they are calling to collect a debt, and that any information revealed in the call will be used to collect that debt. The disclosure must also be included in written correspondence with consumers, such as a collection letter. This important provision is required by the Fair Debt Collection Practices Act to prevent debt collectors from calling under false pretenses and gaining information from consumers that can later be used against them.”

需要注意的是,这里的“Mini Miranda Warning”适用的是第三方债务催收人,也就是说,仅在第三方债务催收人以任何通信形式与债务人联系时才需作出该等声明,如果是债权人(原始债权人)通过电话、邮件或亲自与债务人联系,则债权人无需作出该等声明。债务催收人既可以是催收人,也可以是债务催收机构,nyc.gov对“债务催收人”的定义为:

“A private company or person - including a debt collection attorney or law firm - that attempts to collect personal or household debt from New York City residents. The debt collector may:

Own the debt (purchased from a creditor) and collect for itself; or

Be hired by a creditor or other company to assist in collecting the debt.

Mini-Miranda prevents a debt collector from using false pretenses in furtherance of collecting a debt. For instance, a heavily indebted person may use a fictitious name when answering the phone to avoid calls from collection agencies. While an easy solution for a debt collector would be to not reveal their true identity and the purpose of the call so as to get through to the indebted person, the Mini-Miranda specifically prohibits the use of such tactics.
