“false arrest” 在《英美法术语双解》一书中有如下释义：

any unlawful physical restraint of another's liberty, whether in prison or elsewhere.

既然释义中使用的是“unlawful”而不是“wrongful”， 那么其意思很明显就是“非法逮捕”，而非“错误逮捕”。

在英美法术语中，“false arrest” （非法逮捕、非法拘留）是“false imprisonment” （非法拘禁）的一种。指未经合法授权而剥夺、限制他人人身自由的行为，且不以行为人出于恶意为条件。受非法拘捕的人可对此提起民事侵权之诉，要求赔偿损失。如果行为人系出于恶意，则除补偿性的或名义上的赔偿外还应支付惩罚性的损害赔偿金。
